HomeMy WebLinkAbout750450.tiff RESOLUTION WHEREAS, a public hearing was held on August 25, 1975, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Ken Neuens, Route 1, Box 219, Erie, Colorado, seeking a conditional use permit for the erection of a home and treatment barn for equine practice on the following described property, to-wit: The West One-Half of the South One-Half of the East One-Half of the Southwest Quarter of Section 30, Township 2 North, Range 68 West of the 6th P.M. , Weld County, State of Colorado, containing 19. 566 acres, more or less, and WHEREAS, the petitioner was present, and WHEREAS, there was no oppostion to the request of petitioner for the location of said home and treatment barn for equine practice, and WHEREAS, the said requested location for the erection of a home and treatment barn for equine practice is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 (d) of the Zoning Resolution of Weld County, said location for said home and treatment barn for equine practice may be authorized upon the approval of the Board of County Com- missioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Ken Neuens, Route 1, Box 219, Erie, Colorado, for a conditional use permit to locate a home and treatment barn for equine practice on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That said conditional use permit herein granted is limited to the description of the operation submitted with application. 3. That a building permit for the erection of any structure or structures with said use shall be obtained prior to construction thereof. 4, That said conditional use permit herein granted is conditional only for a period of twelve (12) months from date hereof, on condition that petitioner proceed with due diligence to begin construction of said facilities; otherwise, the Board may, upon its own motion revoke the conditional use permit herein granted. 5. That all applicable subdivision regulations and zoning regula- tions shall be followed and complied with in accordance with the Zoning Pt_ c-7 750450 Resolution of Weld County, Colorado. Evaluation to determine suitability of soils for a septic tank and home site. 53-C and 41-B are deep well drained, sandy loam, and loam soils with slight to moderate limitations due to some bank sluffing and moderate percolation. These areas are not subject to flooding. 34-AB and 34P-AB are wet loamy soils with severe limitations for both home sites and septic tank filter fields due to a high water table of 20 - 40 inches and a hazard due to flooding. The soil survey is made on the basis of 50 to 60 inch borings.
