HomeMy WebLinkAbout20130052.tiffHEARING CERTIFICATION DOCKET NO. 2013-08 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT FINAL PLAN, PUDF12-0003, TO AMEND THE FINAL PLAT (BALDRIGE PUD-S-315) TO RECONFIGURE THE LOT TO CREATE TWO (2) C-3 BUSINESS COMMERCIAL ZONED PARCELS - MOUNTAIN VIEW FIRE PROTECTION DISTRICT A public hearing was conducted on January 2, 2013, at 10:00 a.m., with the following present: Commissioner William F. Garcia, Chair Commissioner Douglas Rademacher, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Bob Choate Planning Department representative, Kim Ogle Public Works representative, Don Carroll Public Works representative, Heidi Hansen Health Department representative, Lauren Light The following business was transacted: El I hereby certify that pursuant to a notice, dated December 12, 2012, and duly published December 17, 2012, in the Greeley Tribune, a public hearing was conducted to consider the request of the Mountain View Fire Protection District, for a Site Specific Development Plan and Planned Unit Development Final Plan, PUDF12-0003, to amend the Final Plat (Baldridge PUD S-315) to reconfigure the Lot to create two (2) C-3 Business Commercial Zoned parcels. Bob Choate, Assistant County Attorney, made this a matter of record. IR Kim Ogle, Department of Planning Services, presented a brief summary of the proposal, clarified the legal description, and reviewed the location, referral responses, and utility providers. Mr. Ogle explained the application intends to create two parcels: one containing the existing improvements and the other remaining open for future development. He discussed the applicant's waiver requests, reviewed the surrounding land uses, and entered the favorable recommendation of the Planning Commission into the record as written. In response to questions from the Board, Mr. Ogle submitted a copy of the referral response from the Firestone Fire Protection District, marked Exhibit B, and he displayed maps and photographs of the site and surrounding area. IP In response to Commissioner Kirkmeyer, Mr. Ogle explained the PUD standards in place at the time of approval did not require curb and gutter. Fl Don Carroll, Department of Public Works, provided a brief overview of the transportation plans and requirements. He indicated the site is located within the 1-25 RUA, therefore, roadway standards do apply, and he described the typical roadway cross sections. He reviewed the average daily traffic counts and on/off-site improvements, noting that the applicant is requesting waiver of the curb/gutter/sidewalk requirement. Mr. Carroll indicated the location 2013-0052 PL0047 HEARING CERTIFICATION - MOUNTAIN VIEW FIRE PROTECTION DISTRICT (PUDF12-0003) PAGE 2 of two approved access points, and stated the site is located within the MS4 area and drainage will be required. IF] In response to Commissioner Rademacher, Mr. Carroll explained Condition of Approval #2.6.2 is intended to address sign encroachment upon the setback which is necessary in order for the sign to be visible from the road. He further stated the word "fines" in Condition of Approval #2.B.6, is defined as being similar to gravel. F Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions. ID Steve Steinbicker, Architecture West, reviewed the site layout and waiver requests, and explained the location is intended to improve response times. In response to Commissioner Kirkmeyer, Mr. Ogle stated the curb/gutter/sidewalk waiver is applicable to both lots; however, some of the other requests are very specific to just the fire protection use on Lot 1, and Mr. Carroll stated it does meet the MS4 standards. Mr. Steinbicker displayed poster boards showing building renderings and reviewed the staffing levels and the location of the parking. He responded to further questions from the Board by reviewing the building layout and the area designated for potential future growth. F Mark Lawley, Fire Chief, explained they have no intension to add staff because there is the potential of building another facility at a separate location. Commissioner Kirkmeyer expressed support of the waivers in regard to Lot 1, but not for Lot 2, since the future use in unknown. F No public testimony was offered concerning this matter. Mr. Lawley clarified the entire Vista View Subdivision has no curb/gutter/sidewalks, therefore, that waiver request is for both lots. El Concerning the Access Standards in Criteria paragraph #1.6.1, Mr. Carroll confirmed there is curb/gutter/sidewalk internal to the site around the buildings. Commissioner Kirkmeyer reiterated her agreement with the waiver on Lot 1, but not Lot 2, which should be consistent with the remainder of the Vista View PUD, and not waiving the paving of all driving surfaces. Mr. Ogle proposed adding "for Lot 1" to the final sentence, and the Board and applicant agreed. F Concerning the Bulk Requirements in Criteria paragraph #1.6.2, Mr. Ogle reviewed the topography and visibility for placement of the sign, which will remain on private property. He explained the request is for public notice due to the emergency nature of the use, which will be accessing the roadway at an uncontrolled intersection. The Board agreed the variance applies only to Lot 1. F Concerning the Circulation standard in Criteria paragraph #1.6.3, the Board agreed to waive the public right-of-way curb/gutter/sidewalk requirements for both Lots 1 and 2. 2013-0052 PL0047 HEARING CERTIFICATION - MOUNTAIN VIEW FIRE PROTECTION DISTRICT (PUDF12-0003) PAGE 3 ID Concerning the Design Standards and Improvements Agreement standard in Criteria paragraph #1.6.4, the Board agreed to apply the waiver only to Lot 1. Fl Concerning the Landscaping standard in Criteria paragraph #1.B.5, the Board agreed to apply a waiver only to Lot 1. El Concerning the Parking Lot Surface standard in Criteria paragraph #1.B.6, the Board agreed to apply the waiver only to Lot 1. El Concerning the Parking Requirements standard in Criteria paragraph #1.B.7, the Board agreed to apply the waiver only to Lot 1. Fl Concerning the Urban Scale Development standard in Criteria paragraph #1.B.8, the Board agreed to apply the waiver to both Lots 1 and 2. Mr. Lawley requested a note on the plat that the drainage requirements have been met. Mr. Ogle proposed adding language under Condition of Approval #1.E.4, and following discussion, he proposed refined language. Mr. Lawley stated the pond was designed to accommodate the proposed use for Lot 1, in addition to any future use on Lot 2; therefore, an independent review when Lot 2 is developed is unnecessary. El Brian Shear, Shear Engineering Corporation, discussed the County drainage criteria and stated he designed the pond to accommodate highest impervious runoff coefficient from both lots. Fl Heidi Hansen, Department of Public Works, explained what is typically reviewed and required during the Site Plan Review process. Following discussion, and subsequent to the hearing, the following language was proposed by staff in Exhibit C to be added as Condition of Approval #1.E.4: "It is the intention that the detention volume requirements for Lot 2, Baldridge PUD, First Filing, First Replat, have been accommodated with the detention pond volumes provided with Lot 1, Baldridge PUD, First Filing, First Replat, based on Weld County drainage design criteria current at the time of recording the final plat for Baldridge PUD, First Filing, First Replat, and based on the approved Final Drainage, Erosion Control and Water Quality Report for Baldridge PUD, First Filing, First Replat. The Master Drainage Plan for Lots 1 and 2 of Baldridge PUD, First Filing, First Replat, shall be reviewed at the time of Site Plan Review for any development of Lot 2." El Commissioner Rademacher proposed Condition of Approval #2.R be modified to replace the word "will" with "may" and the Board concurred. In response to Commissioner Kirkmeyer, Mr. Ogle clarified Condition of Approval #1.C requires vacation of the outdated, underlying Use by Special Review permit. El In response to Chair Garcia, Mr. Lawley stated he and the applicant have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as proposed and modified. 2013-0052 PL0047 HEARING CERTIFICATION - MOUNTAIN VIEW FIRE PROTECTION DISTRICT (PUDF12-0003) PAGE 4 e Commissioner Conway moved to approve the request of the Mountain View Fire Protection District, for a Site Specific Development Plan and Planned Unit Development Final Plan, PUDF12-0003, to amend the Final Plat (Baldridge PUD S-315) to reconfigure the Lot to create two (2) C-3 Business Commercial Zoned parcels, based on the recommendations of Planning staff, with the Conditions of Approval as entered into the record and amended. His motion included changing all references from "Mountain Valley" to "Mountain View" throughout the supporting documents, incorporating all of the waivers as previously discussed, adding new language under Condition of Approval #1.E.4 concerning review of the detention pond, amending Condition of Approval #2.R to replace the word "will" with "may", and accepting the revisions as recommended by the Planning Commission. Commissioner Freeman seconded the motion. Commissioner Kirkmeyer moved to also correct the legal description throughout the Resolution. The motion was seconded by Commissioner Conway and it carried unanimously. There being no further discussion, the motion to approve the application, as amended, carried unanimously.
