The capacity of a 1.5" meter is 120 gallons per minute on a continuous basis. Also transmitted is a copy of the Water Tap Assignment form that is signed by both buyers and sellers at the time of closing. The original Information Application, Tap Fee Agreement, Rate Schedule, Tap Fees and Supplemental Service Policy referencing the surcharge in Item D-5, and the Meter Water Rates and Service Charges are also attached. Box 237 LaSalle, CO 80645 RE: Tap #744 Dear Mr. Miller, According to the District's records, a 1" tap was purchased for the feedlot in September 1973 and was assigned to the W Yx of Section 1, Township 4 North, Range 66 West of the 6t° P.M., Weld County, Colorado. In March of 1998, the I" tap was upsized to a 1.5" tap. As with all District taps, this tap is assigned directly to the land it is situated on and cannot be sold off or relocated to another piece of property other than that for which the legal description states. Miller hereinafter called Customer, WITNESSETH: WHEREAS, District has been organized as a legal body and is known as the Central Weld County Water District, and 1973 WHEREAS, Customers are toxoaying electors within said District, or desiring to join said District, or and, WHEREAS, Customers are desirous of purchasing nno water tap of 1" inches in diameter from the said District, NOW, THEREFORE, in consideration of the premises and the terms of this agreement, it is mutually agreed as follows: 1. Tentative Fees: meets '6" and larger must be accepted individually by Board action. 2. Standby Taps: Standby Taps are taps purchased but not activated. Standby taps are subject to the extension policy in effect when activated and are subject to renewal at the option of the District Board after five years from date of purchase. All standby Tap purchases are subject to approval by the Board. 3. A separate meter is required for each individually -owned property, except by a written agreement with the District. 3a. The Board of Directors of the Central Weld County Water District may consider special requests regarding the use of a tap to provide water service to one or more parcels of land. If an individual has owned the land to be considered for a minimum of five (5) consecutive years, then a single tap may provide water service to divided parcels until at which time the divided parcels change ownership then an additional tap or taps will be required to provide additional water service to those divided parcels. This policy may he amended based on specific circumstance. 4. For mainline extensions, services and appurtenances required to serve individual taps, subdivisions or other developments, the customer and%or developer shall he responsible for all costs. Where required by District for future expansion, customer and/or developer may be required to front necessary monies for oversizing of the District mains. A separate written agreement is required. 5. Where land is subdivided into lots, the Developer and/or Owner shall meet the requirements of the District fur the water system. 1'he Owner and/or Developer shall be responsible for all cost and the installation of all water mains and appurtenances within the Subdivision. Prior to construction, completed plans and specifications must be submitted to the District and approved ir, writing. All materials and installations shall be subject to the approval of the District. Advance written notice shall be given to the District prior to any construct on. After final written acceptance by the District, Owner shall deed the water system to the District. Complete and acceptable reproducible maps of record drawings of system must be provided to the District. 6. The District shall not be committed to future taps beyond that amount paid in tap fees, except by separate written agreement. The District will not reserve capacity in water mains for future taps, unless by separate written agreement. 7. The District shall require any developer requesting 10 or mare taps to (prosier CBI' water to the District for said number of taps. B. Administrative and Study Fees: I. For consideration for a new water service, the potential customer shall pay an Administrative Study Fee. Where a District line extension is required to save customer, said fee amount shall be doubled. 2. Where more than one tap is being considered, .$5.00 is required for each equivalent dwelling unit in addition to the designated fcc. 3. Letters indicating service availability will he provided only if property owner has paid an Administrative Study Fee. 4. For Subdivisions a $1,000.00 Administration and Study fee will be required. C. Capital Improvement Fee: The Capital Improvement Fee may be reduced by $200.00 where Teter and service installations are not installed by the District. (Applies primarily to subdivisions and requires separate written agreement) D. Minimum Raw Water Requirements: 1, Raw water Fee subject to review and change by Board at any dine. 2. Subject to approval by the Board of Directors, customers may trnsfer raw water in ownership to the District and said customer's annual allotment shall he increased in the amount of 300,009 gallons for each C.B.T. unit transferred, Windy Gap shall be increased in the amount of 300.000 gallons for each 1,100 unit transferred. Meter Reading and Customer Service: Meters am read and billed on a monthly basis. Customer must pay for all water registered by the meter, regardless of how the water has been used. Customer is responsible for the water system on customer side of the meter. The District assumes no responsibility for failures from high pressure, freezing, etc. 2. Multiple Dwelling Units and/or Business Units: Where one meter serves more than one dwelling anchor business unit, the following shall apply: A monthly surcharge of $3.50 for each dwelling and/or business unit for two or more units shall be paid to the District in addition to the regular rate schedule in effect for the master meter. For motels, a $1.75 surcharge per dwelling unit shall apply. Other services, such as laundry, etc. shall be considered as one or more equivalent dwelling unit for basis of surcharge. 3.* C.B.T. Raw Water Surcharge: For C.B.T. Water, a surcharge of S .18 per 1,000 gallons shall be paid for all water used over the annual allotment for the applicable water year (November Y' to October 31g). 4.** Windy Gap Raw Water Surcharge; In addition to the monthly surcharge shown for Windy Gap water, a surcharge in the amount of 80% of the lowest base rate per 1,000 gallons shall be paid for all water used over the annual allotment for the applicable water year (November l ° to October 311. 5. Pumping Surcharge: A 10% surcharge may be added to monthly water service charges where water is pumped for delivery. 6. Special Service Charges: Special service charges shall be applied to customers requiring services which are not used regularly by all customers. A partial list of special service charges are as follows: Inactive Service Status: A customer may transfer from an active tap status to an inactive service status. The monthly charge rate during the inactive status period shall he 50% of the normal monthly rates. The customer must provide advance written request with a minimum of three (3) months prepayment and an advance service charge of $25.00 for each meter shutdown and activation. B. Defilement Accounty Payments for vunddy service changes shall be due within 10 days following the billing date. If payment is not received in District on or before the 20* of the following month, a Termination Notice will be sent and a $10.00 handling charge will be assessed. If payment is not received within 10 days after the mailing date of the notice, water will be shut off without further notification to the customer. In order to restore water service, charges will be assessed as follows: I) First Re -activation (a' $25.00 2) Second Re -activation (2 $50.00 3) Third Re -activation and each re -activation thereafter a $75.00 4) Following the third re -activation, the District Board shall have the right to discontinue service and establish special conditions to assure that payment vviil be made for water service. 5) To have service restored after the third termination, 40% of the total bill must be paid with arrangements to pay the current bill plus 10% of past due every month by the 10th of each month following until current. C. Water service may not be terminated without a 10 day prior written notification from the District to the landowner and/or the tenant, This applies to water service fees either current or not current. The District will not terminate water senice based on a landowner's intent to evict a tenant. Any Monies paid for activation shall be paid at the District office.
