Dear Petitioner:
On August 01, 2013, the Board of County Commissioners of Weld County Colorado
convened and acting as the Board of Equalization, pursuant to C.R.S. Section 39-8-101 et seq.,
considered your request to approve and adopt a valuation of your property arrived at by a
Stipulation between you and the Weld County Assessor, for the year 2013.
The Board of Equalization found that the evidence presented at the hearing supported the
stipulated value placed upon the above -described property as set forth below. Such evidence

The Assessor establishes property values. The local taxing authorities (county, school district, city,
fire protection, and other special districts) set mill levies. The mill levy requested by each taxing
authority is based on a projected budget and the property tax revenue required to adequately fund
the services it provides to its taxpayers_ The local taxing authorities hold budget hearings in the fall.
If you are concerned about mill levies, we recommend that you attend these budget hearings.

In reviewing the assessor's increase in tax basis, first, Ag residential, this is a tenant home which ages each year
more on a farm than in a city because of the elements. This can't rise in value like a residence in a city because it is
an integral part of a farm operation; therefore it has a completely demographic (value basis) not addressed by the
"city" standard the assessor applied. At most, there is no way it should increase more than 3% oveLc last
assessment. Next, second line element, the land, was a 62.5% jump upward from the previdtls es ;essment basis.
There is no substantive difference (farming or soil quality) between land in Section 7 (we own) and Section 8
valued 74.7% increase higher than Section 7's increase. That is an irrational, arbitrary and capricious increase the
assessor cannot rationally support and it was is inappropriate analysis. The Section 8 land evaluation should have
remained at the previous year's evaluation which would have been 3% increase over Section 7's land base value;
so no increase from the previous $370.98 per acre assessment was warranted (see attached). Finally, reference the
third line, the assessor raised this buildings assessment by 976.4% over the previous. This is criminal. Building wise,
nothing has changed over the last 10 years except to demolish the old farm house and some deteriorating other
out -buildings. There is absolutely no logic to raise that assessment, either there, 3% over one period to the next, in
this economy. Any tax increase of over 3% over the previous basis or assessed values of the residence, $163,992,
the land, $61,137 and the buildings, $2,559 is totally unwarranted and unacceptable to us, the owners. If an
assessed value is assigned higher than those numbers, it will be appealed to. Board of Assessment Appeals, or the
Distric Court which wastes many government people's time and ours. We plead for common sense and fairness.
APPEAL PROCEDURES

This piece of property is situated between the Great Western Railroad rail bed, the highline ditch, feeder ditches
that supply water to other farms and the County road. This land is disrupted by these features and almost
impossible to farm or irrigate because of these substantial major boundary obstacles. It used to have a small
tenant house on the property which was run-down, which has since been demolished and removed. This land is
vacant, has not and is not used for farming and hasn't produced any crops or harvest products in over 25 years.
Any tax increase of over 3% over the previous basis (the assessor's is 38% increase) or an assessed value of $2,613
is unwarranted and unacceptable to us, the owners. If an assessed value is assigned higher than $2,613, it will be
appealed to Board of Assessment Appeals, or the District Court which wastes many government peoples time and

In reviewing the assessor's increase in tax basis, it was a 25.2% jump upward from the previous assessment basis.
In the last year quite a few acres have been negated by the requirement of the oil companies drilling wells, placing
tanks and separators on the land and building containment areas for their oil capture endeavors. Since this land's
mineral rights were donated by your federal government on every odd section across our country, we are not the
prime recipient of this land confiscation utilization which devalues farm land use. Any tax increase of over 3% over
the previous basis (the assessor's is 25.2% increase) or an assessed value of $171,257 is unwarranted and
unacceptable to us, the owners. If an assessed value is assigned higher than $171,257, it will be appealed to Board
of Assessment Appeals, or the District Court which wastes many government people's time and ours. We plead for
common sense and fairness.

Appeal General Statement
Our appeal is based upon the prior assessment of this parcel. We have assumed
because we cannot challenge prior assessments that the prior assessment we were
refer to is accurate. Taking that fact, the arbitrary increases the assessor has levied
are outrageously large and unsupportable. You do not increase assessments a
large percentage unless something has material changed on the property or about
the property. Unfortunately the Assessor "rubber stamped" their denial hoping
these "hayseed sorts" would not pursue the unwarranted increases. Well we
disagree with the assessor staff's work and increase and we intend to challenge
these increase in court if that is course of action to get more reasonable work
from the assessor's office.
