RE: APPROVAL OF RECORDED EXEMPTION NO. 425, AN AMENDMENT TO
MINOR SUBDIVISION #19 - DENNIS KUEHL, ET AL.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, Dennis Kuehl, et al. , have requested approval of
Recorded Exemption No. 425, an amendment to Minor Subdivision #19,
on property described as Part of the Northeast Quarter of Sec-
tion 5, Township 4 North, Range 68 West of the 6th P.M. , Weld
County, Colorado, and
WHEREAS, said request is to amend Minor Subdivision #19 by
reducing the size of Lot A by adding a half acre, more or less,
to Lot B. The resulting lots will be 7 . 0 acres, more or less
(Lot A) and 8 . 0 acres, more or less (Lot B) and are more parti-
cularly described as follows:

All that portion of the Northeast Quarter of
Section 5, Township 4 North, Range 68 West
of the 6th Principal Meridian, in the County
of Weld, State of Colorado, more particularly
described as follows : Beginning at the North-
east corner of said Section 5; thence along

WHEREAS, the Board of County Commissioners of Weld County,
Colorado has considered the request by Dennis Kuehl, et al. , and
finds that said request should be approved.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the request of Dennis
Juehl, et al. for Recorded Exemption No. 425, an amendment to
Minor Subdivision #19, be, and hereby is, approved subject to
the applicants providing an additional 30 foot reservation for
highway right-of-way along the South side of Colorado Highway
60 and that said reservation be added to the Recorded Exemption
plat prior to recording it in the Clerk and Recorder' s Office.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 17th day of
October, A.D. , 1979 .

RE: Recorded Exemption #425, an amendment to Minor Subdivision #19
Dear Commissioners:
The attached application, plat , and related items are in reference to
a request to amend Minor Subdivision #19 from Dennis Kuehl, et al . The
property is described as Pt . NE* Section 5, T4N, R68W of the 6th P.M. ,
Weld County, Colorado. This property is located 2-1/2 miles west of
I-25 on the south side of Colorado Highway 6 .
The request is to amend Minor Subdivision #19 by reducing the size of
Lot A by adding a half acre more or less to Lot B. The resulting lots
will be 7. 0 + acres and 8. 0 + acres. Each lot does have an existing
residence located on it.
Based upon the information submitted, the Department of Planning Services
Staff recommends approval of this requested amendment in that the request
does not substantially differ from what was originally approved by the
Board of County Commissioners. The Department of Planning Services'
recommendation for approval is subject to the applicants providing an
additional 30 feet reservation for highway right-of-way along the south
side of Colorado Highway 60. This has been requested by the Colorado
State Department of Highways in a letter dated October 9, 1979. The 30
foot right-of-way reservation should be added to the recorded exemption
plat prior to recording it in the Clerk and Recorder' s Office.

Dear Mr. Cunliffe:
As requested by your letter dated September 5, 1979, we are explaining
the reason for this transfer of land.
In October of 1977, I requested to plant some trees on the half acre
of the southern part of Mr. Philpott' s land. Mr. Philpott agreed at that
time to let me plant the trees. My house was 10 yards from his property,
so it was easiest to plant the trees on his land for a windbreak.
In May of 1979, Mr. Philpott requested an easement to bring irrigation
water across my property. After some flea bargaining, Mr. Philpott and
myself agreed to make the exchange as noted on the contract.
So the reason for the request is so that I may own the property that
my trees are on and Mr. Philpott may have an easement for his water.
I hope this is a satisfactory explanation and that this matter can be
absolved quickly and efficiently from this time.

We have reviewed the Dennis Kuehl , et al . , Recorded Exemption.
Projected traffic on State Highway 60 indicates the need for a total
of 120 feet of right of way, 60 feet each side of the centerline.
We ask that additional right of way to meet this need be protected
by reservation.
Since access to this property is provided by existing drive-
ways, we also ask that no additional access be considered.
