For the consideration of Ten (10) Dollars and other valuable consideration, FAYE G.

right, title and interest, estate, claim and demand in the following described real estate
situated in WELD County, State of Colorado, to wit:

THIS DEED is made by Charles L. Fagerberg, 1975 28th Avenue #20, Greeley, Colorado
80634 as Personal Representative of the Estate of Jerry L. Gress, Deceased, Grantor, to Patsy
Ruggles, 6678 Algonquin Drive, Loveland, Colorado 80537 and Michael Galbreath, 4246 Peach
Tree Court, Loveland, Colorado 80538, Grantees.
WHEREAS, the above -named decedent in his lifetime made and executed his Last Will
and Testament dated October 26, 1994 which Will was admitted to formal probate on April 26,
2000 by the District Court in and for the County of Weld and State of Colorado, Probate Case
No. 00 PR 118; and
WHEREAS, Grantor was duly appointed Personal Representative of the said estate on
April 26, 2000 and is now qualified and acting in said capacity; and
WHEREAS, on or about August 3, 2000, Faye S. Lair irrevocably renounced and
disclaimed the interest to be transferred to her under Article 2, Paragraph 5 of the decedent's will;
and
WHEREAS, by reason of the disclaimer Patsy Ruggles and Michael Galbreath, survivors
of Faye S. Lair's deceased daughter, Jill Galbreath, are to receive the devise to Faye S. Lair as
set forth in Article 2, Paragraph 5 of decedent's will; and
WHEREAS, a Stipulation dated December 12, 2000 and signed by Charles L. Fagerberg
as Personal Representative of the Estate, Michael Galbreath, Patsy Ruggles, Faye S. Lair,
Colorado State University Foundation, Inc., University of Colorado Foundation, Inc., and
University of Northern Colorado Foundation, Inc. determined the assets distributable from the
estate to satisfy the specific devise set forth in Article 2, Paragraph 5 of decedent's will; and
WHEREAS, Grantees are determined to be the persons entitled to distribution of the
hereinafter described real property, and Grantor is authorized and directed to distribute the same
to Grantees.
NOW, THEREFORE, pursuant to the powers conferred upon Grantor by the Colorado
Probate Code, Grantor does hereby convey, assign, transfer and set over unto said Grantees as
tenants in common, the following described real property situate in the County of Weld, State of
Colorado:
An undivided one-half ('h) interest in and to the Southwest Quarter (SW 1/4) of Section
Thirty (30), Township Four (4) North, Range Sixty-six (66) West of the 6th Principal
Meridian, Weld County, Colorado together with 3 registered and adjudicated irrigation
wells and the pumps thereon and 20 shares of the capital stock of the Farmers Independent
Ditch Company; together with an undivided one-fourth (1/4) interest in the minerals
underlying the Southwest Quarter SW1/4) of Section Thirty (30), Township Four (4)
North, Range Sixty-six (66) West of the 6th P.M., except for a strip 200 feet wide
containing 12.30 acres, deed by Alfred Cribbin et ux. to the Union Pacific Railroad
Company by deed dated May 8, 1908, recorded in Book 280 at Page 187 in the office of
the Weld County Clerk and Recorder
together with all appurtenances but subject to covenants, easements and restrictions of record, and
encumbrances pertaining to the property.
