RE: RECORDED EXEMPTION NO. 251 - EUGENE AND PEGGY CLARK.
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado at a public meeting
held on the 7th day of March, 1977, in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that
a certain parcel of land, being the property of Eugene and
Peggy Clerk, Weld County, Colorado, more particularly des-
cribed as follows:
The Northwest Quarter (NWq) of Section 27 , Town-
ship 7 North, Range 65 West of the 6th P.M. , Weld
County, Colorado, being more particularly described
as follows:
Beginning at the Northwest Corner (NW Cor) of said
Section 27, and considering the West Line of said
NW4 of Section 27, as bearing South 00°17 ' 16" West,
with all other bearings contained herein relative
thereto;
Thence South 00°17 ' 16" West, along said West Line,
2644. 74 feet;
Thence South 88°47 ' 19" East, 2646. 78 feet;
Thence North 00°15 ' 16" East, 2682. 58 feet to a
point on the North Line of the NW4 of said Section
27;
Thence North 89°36 ' 28" West, along said North Line,
2644. 88 feet to the Northwest Corner (NW Cor) of
said Section 27, said point being the Point of

Said described parcel of land contains 161. 780 acres,
more or less, including a strip of ground 30 feet in
width along the North and West Lines of said NWa of
Section 27, reserved for County Road Right-of-Way
purposes and is subject to any rights-of-way or other
easements as recorded by instruments of record or as
now existing on said described parcel of land.

101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-1A(3) of the Weld County Subdivision
Regulations;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by Eugene and Peggy Clark, be exempt
franthe definition of the terms, "subdivision" and "subdivided

RE: Recorded Exemption 251
Dear Commissioners :
The attached application, plat, and related items are in
reference to a request by Eugene and Peggy Clark for a
recorded exemption. The parcel of land in question is
described as the NW* of Section 27, T7N, R65W of the 6th
P.M. , Weld County, Colorado. The subject property con-
tains 161.780 acres of Class I and II irrigated soils.
The request is to split the property into parcels of 160.690
acres and 1. 090 acres. The Clarks currently reside on the
160.690 acre parcel where they also have their dairy oper-
ation. Their stated intent is to split off the 1. 090 acre
parcel which they will convey to their son, Terry Clark, who
works for his parents in the dairy business.
Based upon the information submitted and the adopted policies
in the County, the Planning Commission staff recommends the
request be approved for the following reasons:
1. The proposed split conforms with the intent clause of the
Recorded Exemption procedure (Section 9-2 of the Weld
County Subdivision Regulations) , the intent clause of the
Agricultural District (Section 3. 3A of the Weld County
Zoning Resolution) , and the Weld County Comprehensive Plan
since the use would be compatible with the surrounding
agricultural uses.
2. The request complies with the provisions of Section 9-4(A)
of the Weld County Subdivision Regulations,
