Approved with Conditions
The Weld County Department of Planning Services has determined through an administrative review that the
standards of Section 24-8-40 of the Weld County Code have been met. This Recorded Exemption is
approved with the following conditions in accordance with information submitted in the application and the
policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. The Applicant has proposed a well as the source of adequate water for Lot A. Property owners are
advised that the quantity of water available for usage may be limited to specific uses, i.e., "Domestic

Use Only," etc. Because each situation is unique, the Department of Planning Services encourages
property owners to contact the Office of the State Engineer, Division of Water Resources (1313
Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581), to discuss each
individual situation.
3. Topographic or physical features of the proposed Lot A, such as ravines, ditches, streams etc. may
limit the area available for a new or replacement septic system. Prior to recording the plat the Weld
County Department of Public Health and Environment recommends that the applicant review the Weld
County Code pertaining to septic systems to assure that any installed septic system will comply with
all setback requirements found in the Code. In the event the proposed lot is not of sufficient size to
allow the installation of a septic system the lot may need to be enlarged.
4. Prior to recording the plat:

The plat shall be titled: Recorded Exemption No. 1469-20-3 RE -4282
The applicant shall submit a copy of well permit #109843-A to the Department of Planning
Services.
Lot A is granted one access, no circle drives or additional accesses shall be granted. The
access road shall be graded and drained to provide all weather access. Accesses shall be
placed in such a location as to have adequate sight distance in both directions, shall not be
placed below the crest of a hill or where physical obstructions are present.
Lot B shall use the existing residential / agricultural / oil and gas / ditch road access points
necessary for agricultural operations as no additional accesses shall be granted.
All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld
County Department of Public Works to determine if a culvert is necessary at any approved road
access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe (CMP) is Weld
County's minimum size. If the applicant chooses to place a larger culvert please contact the
Weld County Department of Public Works to adequately size the culvert.
County Road 6 is classified by the County as a collector road, which requires 80 feet of right-of-
way at full build out. The applicant shall verify the existing right-of-way and the documents
creating the right-of-way. If the right-of-way can not be verified, it shall be dedicated. The plat
shall delineate the existing right-of-way and the documents which created it along with any
additional right-of-way reservation required.
County Road 15 is classified by the County as a local gravel road, which requires 60 feet of
right-of-way at full build out. The applicant shall verify the existing right-of-way and the
documents creating the right-of-way. If the right-of-way can not be verified, it shall be dedicated.
The plat shall delineate the existing right-of-way and the documents which created it along with
any additional right-of-way reservation required.
The applicant shall attempt to address the requirements (concerns) of City of Dacono , as stated
in the referral response dated 11/3/05. Evidence of such shall be submitted in writing to the
Weld County Department of Planning Services.
The applicant shall attempt to address the requirements (concerns) of Mt. View Fire Protection
District , as stated in the referral response dated 11/1/05. Evidence of such shall be submitted
in writing to the Weld County Department of Planning Services.
The applicant shall address the requirements of Weld County School District RE -8 as stated in

the referral response dated 10/24/05. Evidence of such shall be submitted in writing to the Weld
County Department of Planning Services.
The applicant shall complete and submit the appropriate zoning and building permit applications
and pay the appropriate fees to the Weld County Department of Building Inspection.
Lot A shall comply with the two and one-half (2 1/2) acre net minimum lot size required by
Section 24-8-40.L of the Weld County Code.
The applicant shall provide the Weld County Department of Planning Services with a Statement
of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original
parcel.
N. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.
No building or structure as defined and limited to those occupancies listed as Groups A,
B, E, F, H, I, M and R in Section 302.1 of the 2003 International Building Code, shall be
constructed within a 200 -foot radius of any tank battery or within a 150 -foot radius of any
wellhead. Any construction within a 200 -foot radius of any tank battery or 150 -foot radius
of any wellhead shall require a variance from the terms of the Section 23-3-10 of the
Weld County Code.
2) Any future structures or uses on site must obtain the appropriate zoning and building
permits.
3) Lot A is not eligible for a future land exemption in accordance with Section 24-8-20.C.1
of the Weld County Code.
4) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Recorded Exemption number.
5) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that Lot A has an adequate water supply of sufficient
quality, quantity and dependability. The existing well on Lot B, permit number 109843-A
can not be shared.
6) Potential purchasers should be aware that Lot A may not be eligible for a domestic well
permit which allows for outside irrigation and/or the watering of stock animals. The State
Division of Water Resources issues all well permits.
7) Potential purchasers should be aware that groundwater may not meet all drinking water
standards as defined by the Colorado Department of Public Health and Environment.
The Weld County Department of Public Health and Environment strongly encourages
well users to test their drinking water prior to consumption and periodically there after.
8) Potential purchasers should be aware that approval of this Recorded Exemption does
not guarantee that well permits will be issued for the lots. Any lot may be deemed non -

buildable if the lot owner is unable to obtain a well permit. The State Division of Water
Resources issues all well permits.
9) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
10) Building permits shall be obtained prior to the construction of any building. Buildings that
meet the definition of an Ag Exempt Building per the requirements of Section 29-1-20
and Section 29-3-20.B.13 of the Weld County Code do not need building permits,
however, a Certificate of Compliance must be filed with the Planning Department and an
electrical and/or plumbing permit is required for any electrical service to the building or
water for watering or washing of livestock or poultry.
11) Effective January 1, 2003, Building Permits issued on the proposed lots will be required
to adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-11)
12) Effective August 1, 2005, Building Permits issued on the proposed lots will be required
to adhere to the fee structure of the Capital Expansion Impact Fee and the
Stormwater/Drainage Impact Fee. (Ordinance 2005-8 Section 5-8-40)
13) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of agricultural
products sold. The rural areas of Weld County may be open and spacious, but they are
intensively used for agriculture. Persons moving into a rural area must recognize and
accept there are drawbacks, including conflicts with longstanding agricultural practices
and a lower level of services than in town. Along with the drawbacks come the incentives
which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife,
lack of city noise and congestion, and the rural atmosphere and way of life. Without
neighboring farms, those features which attract urban dwellers to rural Weld County
would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off -site impacts, including noise from tractors
and equipment; slow -moving farm vehicles on rural roads; dust from animal pens, field
work, harvest, and gravel roads; odor from animal confinement, silage, and manure;
smoke from ditch burning; flies and mosquitoes; and the use of pesticides and fertilizers
in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply
be moved out of the way of residential development without threatening the efficient
delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found
to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and County roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to

emergencies. County gravel roads, no matter how often they are bladed, will not provide
the same kind of surface expected from a paved road. Snow removal priorities mean
that roads from subdivisions to arterials may not be cleared for several days after a major
snowstorm. Snow removal from roads within subdivisions are of the lowest priority for
public works or may be the private responsibility of the homeowners. Services in rural
areas, in many cases, will not be equivalent to municipal services. Rural dwellers must,
by necessity, be more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of the
farmer's livelihood. Parents are responsible for their children.
5. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County
Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar
plat along with all other documentation required as conditions of approval. The Mylar plat shall be
recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services'
Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld
County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from
the date the Administrative Review was signed. The applicant shall be responsible for paying the
recording fee.
6. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this
Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable
GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00.
The preferred format for Images is .tif (Group 4). (Group 6 is not acceptable). This digital file may be
sent to maps(co.weld.co.us.
7. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat not
be recorded within the required sixty (60) days from the date the Administrative Review was signed a
$50.00 recording continuance charge may be added for each additional 3 month period. (Department

8. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application is
based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to meet any
one of these conditions within 60 days of approval, then this case will be forwarded to the Weld County
Board of County Commissioners with a staff recommendation for denial.

County. An annexation decision will be addressed in the future by the owner should the
property become part of a proposed annexation.

Environmental Health Services has reviewed this proposal; the following conditions are
recommended to be part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic system(s)
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
Additionally, please note the following:
1. This application is proposing a well(s) as its source of water. The applicant
should be made aware that while they may be able to obtain a well permit from
the Office of the State Engineer, Division of Water Resources, the quantity of
water available for usage may be limited to specific uses, i.e. domestic use only,
etc. Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public
Health and Environment. We strongly encourage the applicant to test their
drinking water prior to consumption and periodically test it over time.
2. Topographic or physical features of the proposed lot, such as ravines, ditches,
streams, etc. may limit the area available for a new or replacement septic
system. Prior to recording the plat the Division recommends that the applicant
review the County Code pertaining to Septic Systems to assure that any installed
septic system will comply with all setback requirements found in the Code. In the
event the proposed lot is not of sufficient size to allow the installation of a septic
system the lot may be need to be enlarged.

I have reviewed the submitted material pertaining to the recorded exemption for the Totems
property, located at 7173 Weld County Road 6 (Case Number: RE -4282). The Fire District does
not object to the request, but does have the following comments and requirements should a
residence be constructed or a modular home be installed on the parcel created:
All construction shall be in accordance with the provisions of the Fire Code, as ratified by the
Weld County Commissioners, and all other codes and ordinances, as enforced by Weld
County.
Water supply for fire protection may be required for a new dwelling. In instances when a
request is for a recorded exemption and not a subdivision, water supply for fire protection is
not required for a single family residence that is not larger than 3,600 gross square feet and is
placed on at least a 2.5 acre site. If a residence exceeds 3,600 gross square feet, or is placed
on less than 2.5 acres, water supply for fire protection may apply. All other structures may
require water supply for fire protection depending on the use of the new structure.

Thank you for referring the Timothy and Janice Totems Recorded Exemption to
the School District. Based upon expected student generation rates from what
appears to be the possibility of one new single-family unit on approximately
4 acres, the new home would generate approximately 1 new student to be
accommodated within district. Bus transportation would likely be provided.
It is understood that approval of the proposed new lot does not yet add a
residential unit to enrollment potential. However, certain school issues
should be considered at this important juncture, including school site
planning, transportation access and facility capacity.
The current facilities that would serve this lot are Twombly Elementary or
Butler Elementary, Fort Lupton Middle School and Fort Lupton High School.

Dear Michelle:
The City of Dacono has reviewed the Totems application for a recorded exemption. This
property is in the City Planning Area and designated for Ultra Low Density land use.
This designation has a density of one dwelling per 5 acres. The proposed Lot A is about
4 acres. Weld County Road 15 is designated as a Minor Arterial Street in the City's
Master Transportation Plan. This street will require an 80 feet wide right-of-way. The
County Road currently has a 60 feet wide right-of-way. This property is not now eligible
for annexation however the northwest corner is adjacent to the City limits.
The City encourages the land owner to divide out a full 5 acre parcel for Lot A in accord
with the projected land use. If Weld County elects to approve this application the City of
Dacono requests the approval be made subject to the following conditions.
1. The owner dedicate to the public the east half of County Road 15
right-of-way; a 40 feet wide strip from the centerline east for the
length of the property.
2. The owner agree to annex the property to the City of Dacono when
the property is eligible for annexation.

This request is for a subdivision exemption for a property line adjustment
submitted by Alyce Totems, et al. The parcel of land (80 acres) under
consideration is known as part of the SW4 of Section 20, T1N, R67W of the 6th
P.M., Weld County, Colorado. The parcel is located at 6989 Weld County Road 6.
This property is also recorded as RE -428. Access for the site is provided by
Weld County Road 6, a paved county road. The parcel is served by well permit
#109843 and sewer service is provided by septic systems. Currently, there are
three residential dwellings on site. All three of the dwellings have private
accesses off of Weld County Road 6.
The intent of the application is twofold; to vacate existing Recorded Exemption
#428 and to adjust property lines. A favorable recommendation would result in
the creation of four lots, one of which would be not be eligible for a building
permit until which time a Use by Special Review permit would be approved.
The Department of Planning Services recommends approval of this request. The
proposed boundary changes concur with the intent of the Weld County Comprehensive
Plan, and by granting this request the outward appearance and use of the property
will not deviate from its compatibility with surrounding properties.
The staff's recommendation is conditional upon:
1. A Weld County Septic system is required for any proposed home. The septic
system shall be installed according to the Weld County Individual Sewage
Disposal Regulations.

The attached application, plat and related items are in reference
to a request from Mrs. Zella Glardon for a recorded exemption.
The parcel of land on which this request has been made is described
as Pt. WiSW* Section 20, T1N, R67W of the 6th P.M., Weld County,
Colorado. This property is located 2-1/2 miles south and 1/4 mile
east of Dacono. The property contains approximately 79 acres of
Class II and III irrigated soils. The request is to split the pro-
perty into parcels of 1.00 acres and 77.949 acres.
On August 22, 1979, the Board of County Commissioners approved a
request by Mrs. Glardon for a lot size variance so she could make
application for this recorded exemption. At the time they made the
decision on that request, the Department of Planning Services sub-
mitted a letter of recommendation to the Board. A copy of that
letter of recommendation is included in the attached packet. Nothing
has been recei'ed by our office that would change our recommendation
of denial for this request as outlined in the letter to the Board of
County Commissioners dated August 15, 1979. This request complies
with the provisions of Section 9-4 A. of the Weld County Subdivision
Regulations.

RE: APPROVAL OF LOT SIZE VARIANCE NO. 96 - ZELLA GLARDON
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined
at a public hearing held on the 22nd day of August, 1979, in the
Chambers of the Board of County Commissioners of Weld County,
Colorado, that a certain tract of land is owned by Zella Glardon,
which land is more particularly described as follows:
Part of the West Half of the Southwest Quar-
ter of Section 20, Township 1 North, Range 67
West of the 6th P.M., weld County, Colorado
WHEREAS, the owner of said tract of land desires to obtain
a variance from the minimum lot size requirement so that said
applicant may make application to the Board of County Commis-
sioners for a recorded exemption, as set forth in Section 9-4.A.(6)
of the Subdivision Regulations, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado feels that the applicant has shown good cause for
granting a lot size variance under Section 9-4.A.(6) of the Weld
County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that a variance from lot size
requirements be, and hereby is, -granted to Zella Glardon for the
abovedescribed parcel of land.

NO.6 - asks for a letter of explanation detailing the sit-
uation indicating the reasons why the above request,
-1. Our mother, Marguerite Totems, was widowed in February of
- 1953. She kept up the house and yard as best she could until
about four years ago she had a severe stroke that disabled
- her and she no longer could care for the house and yard. During
her partial recovery my brother, Lawrence Totems and I. Zella
Glardon, took care of the house and yard according to the time _
we had which did not do justice. Our mother now is living _
with my brother but I have her about four days out of the week. We share her. In the meantime, my daughter and husband sold
their home in Thornton and moved into the home and have been
redoing it (painting, insulating, etc.) They would like to
•buy,the place and we would like to sell it to them.
2. Mother will never be able to take care of herself or be
responsible since she is 9? years old. She visits her old home
and enjoys the family and feels free to visit there where she
has lived since 1917. We prefer selling it to family since
the house is so close to Lawrence and family.
We hope this explains our situation. We hope you will

Dear Commissioners:
The attached letter and related materials are in reference to a request
for a lot size variance from Mrs. Zella Glardon. The parcel of land
is described as Pt. WISW; Section 20, T1N, R67W of the 6th P.M., Weld
County, Colorado. This property is located 2-1/2 miles south and 1/4
mile east of Dacono. The property contains approximately 79 acres of
Class II and III irrigated soils. The request is to obtain a variance
from the minimum lot size requirement, Section 9-4A(6) so that Mrs.
Glardon may make application for a recorded exemption.
If this lot size variance is granted, Mrs. Glardon will proceed with
an application for a recorded exemption to divide the property into
two parcels. The smaller parcel will be sold to Mrs. Glardon's
daughter and son-in-law who are presently living in the residence on
the parcel. The larger parcel will be retained as an agricultural unit
by Mrs. Glardon and her brother, Lawrence Totems.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be denied for the following reasons:
1. The proposed request does not comply with the Weld County Compre-
hensive Plan in that it would promote non-agricultural use of
agricultural land and it would encourage urban encroachment on
rural land use.
2. This request is not in compliance with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County Sub-
division Regulations). Said clause states:

"The intent in establishing the Recorded Exemption
Procedure is to provide, in accordance with the Weld
County Comprehensive Plan, a means whereby non-
productive agricultural lands may be developed for
higher and more productive uses, insofar as such uses
are compatible with surrounding agricultural uses in
areas where such land divisions are proposed." (Rev.
4/17/74)
The Comprehensive Plan urges residential development to be closely
connected to and served by municipal utilities, and towns should be
encouraged to service new developments within a reasonable service
area from the town. The Plan further indicates subdivision of land
should conform to the overall development goals and policies.
3. It is the opinion of the staff that the proposal is not consistent
with the intent clause of the A -Agricultural Zone District which
states:
"Intent - The intent in establishing the A -Agricultural
Zone District is to allow all agricultural related uses
in those areas in which agriculture is and should con-
tinue to be the predominant land use. This district is
intended to discourage encroachment of incompatible uses
upon the agricultural land in the district, to encourage
agricultural uses as the highest and best use of the land
in the district as compared with other uses in conflict
therewith, and to provide for the orderly expansion of
urban growth in conformance with the Weld County Compre-
hensive Plan." (Rev. 12/29/76)
The nature of the request is not, however, providing for the orderly
expansion of urban growth in conformance with the Comprehensive Plan.
The request would allow another residence on the larger agricultural
unit and would therefore double the residential density on the parcel.
Increasing the residential density will place a greater demand on
the services which residential development requires and, therefore
increase the costs of those services provided.
