RESOLUTION RE: APPROVE VACATION OF RECORDED EXEMPTION, RE -4239 - THOMAS AND CAROLAN DUNN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on December 20, 2005, Planning Services staff administratively approved the application of Thomas and Carolan Dunn, for Recorded Exemption, RE -4239, for the creation of two parcels equaling 4.37 acres and 4.64 acres, more or less, and WHEREAS, said property is located in part of the SE1/4 of Section 32, Township 2 North, Range 67 West of the 6th P.M., Weld County, Colorado, being more particularly described as Lots A and B of Recorded Exemption, RE -4239, and WHEREAS, the Board has received a letter, dated October 17, 2013, from the current property owners, Thomas and Carolan Dunn, 7923 CR 14, Fort Lupton, Colorado 80621, to vacate said Recorded Exemption, RE -4239, which was recorded on January 3, 2006, Reception #3352005, in the records of the Weld County Clerk and Recorder, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacation. We plan to refinance the notes we have on the property and the lending institution has said they cannot use two pieces of property as collateral for the note and that in order to secure a new loan it is to our advantage to vacate the Recorded Exemption and return the property to a single piece. I have done two quit claim deeds, one making the original single piece of property into two lots. I have then done another quit claim deed making the two lots into a single piece of property. I have recorded each of these transactions with the Weld County Clerk and Recorder. I also have two maps, one representing the original single piece of property and the second representing the property divided into two lots. The original Land Survey Plat is signed by the surveyor with his signature and his stamp. The second map is also signed and with the seal of the surveyor. The original map will serve to represent the configuration of the property when the Recorded Exemption is vacated. I trust 1 have done this procedure in the appropriate order and proper fashion. If you see anything I have done that is improper or needs to be corrected prior to my meeting with the Board, please advise me. First, the structure we built is a gambrel roof barn. It fits nicely onto our ten acres and complements our house and garage. It is no way looks awkward nor out of place. In fact, an observer would and has in the intervening years assumed the barn belongs to our property. While we made an initial feeble attempt at a driveway off of CR 17, it has never been used and in farming the property in wheat, that initial driveway has long since disappeared. We have used the barn to store our tractor and various implements over the years and will continue to do so. Second, after thinking about the quit claim deed, it may still be necessary for us to file such an instrument, even though we never filed for a deed for the second Lot B. I am willing to do whatever you direct me to do. And although it's been several years since we did the RE, I may have provided the Clerk and Recorder with a map that needs to be redone. This Recorded Exemption was finalized and signed on December 20, 2005. The initial request was an expression of an intention to divide our 10.25 acres into two lots. We had some grandiose plans that never materialized. We built a structure on the divided piece (identified as Lot B in the RE). That structure has essentially been vacant since it was completed, having been used occasionally for storage. We are now in the process of refinancing our property and the lending agency has urged us to vacate the RE for the sake of the total value in the upcoming appraisal. In addition to having grandiose plans, we were also naive. We did not understand it was our responsibility to go through some proceedings to create a title for Lot B. When we initiated the refinancing process we realized that we never titled Lot B. Therefore we assume we will not need to prepare a quit claim deed. We also assume that the existing map is the actual map, already recorded with Clerk and Recorder, since that map has never been altered. I will provide you with a map of the property as it existed initially, then with the changes to property lines after the RE was completed. The original map will represent the property as it will be after the Recorded Exemption has been vacated. All these maps will be from photocopies of the original map, along with all legal descriptions and measurements. That should all be in your hands by Monday, September 30, 2013.
