Commissioners of Weld County, Colorado, at a public hearing
held on the 24th day of January, 1977 in the Chambers of the

Together 4ith 2.08 shares of the capital stock of The Fanners Reservoir 6 Irrigation Co.
WHEREAS, Ruth M. White and Betty Jo Hadley desire to split
the hereinabove described tract of land into two parcels, and
WHEREAS, Section 9-4A (6) of the Weld County Subdivision
Regulations requires that a lot size variance be obtained
before a Recorded Exemption is granted to the applicants , and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, feels that the applicants have shown good cause for
granting a lot size variance under Section 9-4A (6) of the Weld
County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED that a variance from
lot size requirements be granted to Ruth M. White and Betty Jo
Hadley for the above described parcel of land.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 24th day of
January, A.D. , 1977.
The above and foregoing Resolution was read into the record
and signed on the 26th day of January, A.D. , 1977.

Re: Lot size variance, 40:77:1
Dear Commissioners:
The attached letter and related materials are reference to a request by
Ruth M. White and Betty Jo Hadley for a lot size variance. The subject
property is described as part of the SW* of Sec. 9, TIN, R68W of the
6th P.M. , Weld County, Colorado. Said property is located one and one-half
miles east and one mile north of Erie. The property in question contains
approximately 17 acres of non-irrigated land with Class III and VI non-
irrigated soils. The request is to obtain a variance from the minimum lot
size requirement, Sec. 9-4 (A)(6),so that they may make application to
apply for a Recorded Exemption. Sec. 9-4 (A)(6) states;"that the original
tract or parcel of land to be divided under this section meets the minimum
lot size requirements established by the Weld County Zoning Resolution;
variance from this requirement being allowed only upon good cause being
shown to the Board of County Commissioners or where said tract or parcel
of land lies within the Comprehensive Plan area of an existing incorporated
town of Weld County. (Revised 4/17/74. )"
If this lot size variance is granted, Ms. White and Ms. Hadley will proceed
with their application for a Recorded Exemption to divide the property into
two lots. One lot is proposed to contain approximately 7 acres with an
existing set of improvements. The second lot is proposed to contain approxi-
mately 10 acres. Although the second lot does not presently contain an
existing set of improvements there is a 1,000 gallon septic tank and garage
located on this proposed parcel. This septic tank was utilized by the owners
of the property on a temporary basis while they were building the existing
residence on the proposed 7 acre parcel.
Based upon the information submitted and the adopted policies in the County,
the Planning Commission Staff recommends the request be approved for the
following reasons:

1. The request complies with the intent clause of the Recorded
Exemption procedure in that non-productive agricultural land
(Class III and VI non-irrigated soils) is proposed to be split
and utilized for residential purposes which would be compatible
with land uses in the surrounding area.
2. The seventeen acre parcel in question has low utility for
agricultural use due to the small acreage involved and the poor
soils underlying the property.
3. As explained above, utilities presently exist (septic, water
supply, and electrical service) on the proposed 10 acre parcel.
4. The Erie Planning Commission has indicated that the Town of Erie
has no objections to the granting to this lot size variance

Gentlemen:
I am representing Ms. White and Hadley in the sale of the above cap-
tioned property. They have asked me to apply for a lot size variance to
divide their 17 acres into two parcels. They now reside out of state and
the property has been vacant for over a year. During this time we have
been unable to sell it as is. We now have a contract for sale on the prop-
erty contingent upon two factors: t1 the
acreage
between
father
and son and 2. , obtaining a permit for he father to
retirement.
The enclosed plat shows access, domestic well, two septic systems
and all other improvements, plus how they propose dividing the land. You
will note one septic system is located just North of the garage. This is
still operable and was first installed and used when the owners lived in
a trailor while building the existing house. The trailor has been removed
and if the lot size variance is granted the house will be built at this
approximate location to utilize the water, septic and electrical hook-ups
already installed.
I will very much appreciate your help in this matter and both myself
and the purchasers will be happy to meet with you or furnish any further
information you may need.
