RE: ACCEPT REQUEST OF DAVID AND KAYLEEN HUNT, CIO A&W WATER SERVICE,
INC., TO WITHDRAW APPLICATION FOR A SITE SPECIFIC DEVELOPMENT PLAN
AND USE BY SPECIAL REVIEW PERMIT, USR12-0064, FOR A MINERAL
RESOURCE DEVELOPMENT FACILITY, INCLUDING OIL AND GAS SUPPORT AND
SERVICE (WATER HAULING) IN THE A (AGRICULTURAL) ZONE DISTRICT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 2nd day of
January, 2013, at the hour of 10:00 a.m., in the Chambers of the Board for the purpose of
hearing the application of David and Kayleen Hunt, 14460 County Road 40, Platteville, Colorado
80651, c/o A&W Water Service, Inc., do Leeburg and Associates, 707 Hawthorn Avenue,
Boulder, Colorado 80304, for a Site Specific Development Plan and Use by Special Review
Permit, USR12-0064, for a Mineral Resource Development Facility, including Oil and Gas
Support and Service (water hauling) in the A (Agricultural) Zone District, on the following
described real estate, to -wit, and:
Lot B of Second Corrected Recorded Exemption,
RE -3929; being part of the NW1/4 of Section 33,
Township 4 North, Range 66 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, at the request of the applicant, the Board deemed it advisable to continue
the matter to February 20, 2013, to allow the applicant addition time to attempt to address
requirements of the Colorado Department of Transportation, and
WHEREAS, on February 20, 2013, the Board was presented with an email
correspondence from the applicant, dated January 5, 2013, requesting the withdrawal of the
application, due to a change in market conditions and decreased demand for use, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and all of the exhibits and
evidence presented in this matter and, having been fully informed, accepts said request for
withdrawal.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of David and Kayleen Hunt, c/o A&W Water Service,
Inc., to withdraw the application for a Site Specific Development Plan and Use by Special
Review Permit, USR12-0064, for a Mineral Resource Development Facility, including Oil and
Gas Support and Service (water hauling) in the A (Agricultural) Zone District, described above
be, and hereby is, accepted.

The above and foregoing Resolution was, on motion duly made and seconded, adopted

At this point, with the change in market conditions for truck load outs the costs associated with permitting these sites is
not economical and is not as large a demand for us as once was.
