Weld County is one of the highest producing Counties in the state of Colorado along with Yuma and Garfield Counties. There was no active solicitation of input from Weld County as there was a lack of names of the Local Government Designees in the Setback Review Stakeholders List. Initially, in October 2012 the Regular Analysis calculated for a 350- foot Exception Zone Location Rule, but was later updated to 500- foot in December of 2012 without any notice. Therefore not allowing a new comparison of the probable costs and benefits of the proposed rule to the probable cost and benefit of inaction. The Proposed new Setback and Notification Rules will impact tax revenue, employment, and income in Weld County and the local community, and was not taken in account. The Statement or Regulatory Analysis does not detail scientific and technological issues, instead is found primarily political. There seems to be hurry in the rulemaking to attempt to circumvent possible legislation, as it could have a negative impact against the COGCC and the oil and gas industry. As the Airport Board we support oil and Gas development in Weld County and oppose the New Setback and Notification Rules. The 500 -foot Exception Zone Location Rule will have a negative impact on our facilities.
