RE: CONSTRUCTION OF A PORTION OF COUNTY ROAD 13 DURING 1977.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, are vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the County Engineer of Weld County, Colorado, has
recommended to the Board of County Commissioners that county crews
perform the construction workon a 2-mile portion of County Road
13 between County Road 18 on the north, and State Highway 52 on
the south, during the calendar year, 1977.
NOW,_ THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the County Engineer of
Weld County be, and hereby is directed to use county employees and
road and bridge crews to construct a 2-mile portion of County Road
13, bordered by County Road 18 on the north and bordered by State
Highway 52 on the south, said construction to be performed during
the calendar year 1977.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 16th day of
February, A.D. , 1977.
The above and foregoing Resolution was read into the record
and signed on the 14th day of March, A.D. , 1977.

SUBJECT: ROAD, 13
Design of Road 13 is complete. Preliminary negotiations with
involved property owners have proceeded satisfactorily with the
exception of a single property owner within the town limits of
Firestone.
Further negotiations for this particular right-of-way are
totally dependent on de-annexation of the property from the Town
of Firestone by its owner. A county cannot construct roadways
within corporate limits of any municipality.
All adjacent property has been de-annexed by the Town of
Firestone upon petition of the affected parties. The County
Attorney's Office has submitted petition forms for de-annexation
to the property owner. The Town of Firestone has expressed a
willingness to act favorably on the petition.
