HomeMy WebLinkAbout20132537.tiffRESOLUTION RE: GRANT REQUEST CONCERNING EXTENSION OF TIME FOR SUBMITTAL OF PLANNED UNIT DEVELOPMENT FINAL PLAN, PF #1048, MOREA MANOR NORTH - WELD 45 ACRE, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on November 5, 2008, by Resolution #2008-2726, the Board approved the application of Weld 45 Acre, LLC, 9202 South Rockport Lane, Highland Ranch, Colorado 80126, requesting a Site Specific Development Plan and Planned Unit Development Final Plan, PF #1048, for eight (8) lots with E (Estate) Zone uses (24.1 acres) and three (3) non-residential outlots (18.9 acres) for open space - Morea Manor North, for a parcel of land located on the following described real estate, to -wit: Lot B of Recorded Exemption #2812; being part of the S1/2 NW1/4 of Section 2, Township 2 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, on October 26, 2009, by Resolution #2009-2808, the Board granted a two-year extension of the submittal of the Planned Unit Development Final Plat for recording, as required by Sections 27-8-60 and 27-8-70 of the Weld County Code, with said Final Plat to be submitted by October 26, 2011, and WHEREAS, on July 13, 2011, by Resolution #2011-1678, the Board granted an additional two-year extension of the submittal of the Planned Unit Development Final Plat for recording, as required by Sections 27-8-60 and 27-8-70 of the Weld County Code, with said Final Plat to be submitted by October 26, 2013, and WHEREAS, the Board has been presented with a supplemental request from the applicant, c/o Lee Petrides, for an additional two-year extension of the submittal of the Planned Unit Development Final Plat for recording, as required by Sections 27-8-60 and 27-8-70 of the Weld County Code, with said Final Plat to be submitted by October 26, 2015, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, studied the request of the applicant and the recommendation of the Department of Planning Services, and, having been fully informed, finds that this request shall be denied and an extension be granted for an additional one-year period, with the Final Plat to be submitted by October 26, 2014. On October 26, 2009, The Board of County Commissioners granted a two-year extension for recording of the final plat until October 26, 2011. J On Ju.i 13, 2011, The Board of County Commissioners granted a two-year extension for recording of the final plat until October 26, 2013. (In this instance, the applicant had requested a three-year extension until October 26, 2014). Request: The applicant, in an e-mail dated August 19, 2013, is requesting a 2 -year extension (or until the market improves) for recording the final plat and beginning construction on PF-1048 (Morea Manor North). This extension is requested to allow the applicant time to provide Weld County with proof of collateral for the improvements agreement for this project. The applicant has indicated that he is having difficulty getting collateral (Surety Bond) for Morea Manor North due to market conditions. Staff Recommendation: Since this is the third extension request for this PUD. I am still having a difficult time getting a surety bond for Morea Manor North. Please let me know if the County will approve my request for putting the Morea Manor North project on hold with out penalty for the next 2 years or as soon as the market improves to the point that banks feel comfortable in securing loans.
