WHEREAS, on August 11 , 1976, a public hearing was held in the chambers of the Board of County Commissioners , Weld County, Colorado, for the purpose of hearing the application by Jerrald A. SUBJECT: Minutes MOTION: By Harry Ashley, to approve minutes of June 2, 1976 as submitted, Seconded by Percy Hiatt. A unanimous vote of "aye". Motion carried. Page 1287 On March 8, a meeting was held with State Department heads; on March 15, a meeting was held with the State Health Department; on March 24, a meeting was held with the Weld County Planning staff; on April 14 a meeting was held with Environmental groups to present the process of solution mining. On May 13, a public presentation , advertised in the paper, was held in Greeley. On June 10th, the Planning Commission made a field trip to this site. Wyoming Minerals is also asking for approval to initiate construction activities prior to approval of the Special Use Permit. State Health Department and Wyoming Minerals Corporation are jointly seeking a consultant to review subsurface disposal permit. State has not responded to the County with specifics at this time. Mr. Eisenbarth gave a brief presentation of what solution mining is. Weld County Planning staff recommends the request be tabled for the following reasons: 1 ) The Weld County Health Department cannot make a recommendation until the study has been completed by the Colorado Department of Health, Water Quality Control Division; 2) The Colorado Department of Health, Water Quality Control Division will not be able to respond to the application until a consultant' s report has been completed and a public hearing has been held; 3) The Colorado Geological Survey needs more time to review the additional information which they requested; and 4) Development and reclamation standads need further clarficiation. Development standards shall address: A) Specific aspects of moving on site; B) Installation; C) Operation, and D) Removal and rehabilitation. MOTION: By John Weigand, to table this request. CASE NUMBER: SUP 305 SUBJECT: Auto salvage wrecking and storage APPEARANCE: Mr. Jamison ISCUSSION: There are 320 acres divided into 40-acre parcels. Automobile wrecking operation will be set back 500 feet. The actual wrecking operation will be concealed by a 5' berm of dirt. A mobile home will be on property for a full-time manager. Spaces will be rented out to people for the purposes of wrecking and storing automobiles. Weld County Planning Commission staff recommends the request be approved for the following reasons: 1 ) The request is in com • - pliance with the permanent industrial zoning which was granted on November 12, 1969 by the Board of County Commissioners; 2) The Weld County Health Department recommended approval of the request; Page 1292 i 3) The Weld County Engineering Department indicated that each access must be built with a 50' radius. No other engineering problems were cited. Mr. Scribner, surrounding property owner stated that if some kind of grass was planted to prevent soil from blowing onto his property he would not object. There was lengthy discussion regarding what type berm should be planted. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners approval of this request for an auto salvage wrecking and storage operation subject to staff recommendations and subject to the berm, as shown on the plat, being seeded, a wind break being placed at the berm and the balance of the 500 foot buffer area being seeded. These three are to be in compliance with Soil Conservation Service requirements for seeding, planting , and maintenance. A Soil Conservation plan for the above shall be submitted to the Plan- ning Commission Office prior to advertisement for the Board of County Commissioners' hearing. Motion by Chuck Carlson. SUBJECT: Geologic Hazard and Floodplain Supplementary Regulations to Zoning Resolution and Subdivision Regulations (Tape 631 (#1263 - 1552) DISCUSSION: These proposed regulations had previously been discussed at a special meeting set for that purpose. Changes made in Sections IIIB and IIIC were read into record. It was pointed out that maps still have to be adopted for this set of regulations. RESOLUTION: Be it therefore recommended to the Board of County Commissioners adoption of these Geologic Hazard and Flooplain Supplementary Regulations as submitted. Motion by J. Ben Nix. DATE : STAFF : • V Jamison Special Use Permit Development Standards (Proposed) 1 . The permitted use on the hereon described parcels shall be an auto salvage and wrecking yard and associated facilities. Each parcel shall consist of various size rental spaces as shown hereon which shall be developed as demanded. Each 75' X 150' rental space shall be permitted one 15' X 30' garage or storage building. Each 140' X 315' rental space shall be permitted one 25' X 30' garage or storage building. One mobile home shall be permitted on both Parcel A and Parcel B to provide 24 hour security. Additionally, one 4 stall masonary or steel shop building shall be permitted on both Parcel A and Parcel B. 2. Each rental space shall be fenced on all four sides with 6' chain link as spaces are utilized for a permitted use. 3. All rental spaces to be utilized for salvage and wrecking yards shall be set back a minimum of 500' from the edge of the right-of-way of County Road 41 . 4. A 4' - 5' high berm shall be located immediately east of the rental spaces within the 500' buffer setback. Said berm shall be seeded and maintained as per the attached Soil Conservation Service recommendations. A wind break shall be placed at the berm and maintained as per the attached Soil Conservation Service recommendations. 5. Guard dogs shall be used for security. ' I 6. Floodlights to be used for security purposes shall be placed in such a manner so as not to be offensive,to surrounding property. 7. Each of the two accesses onto County Road 44 shall be built with a 50' i radius. Internal roadways shall be graveled with 3/4" (washed) gravel 4" deep. 8. The Special Use Permit area shall be maintained in such a manner as to prevent fugitive dust, soil erosion, and the growth of noxious weeds. The 500 foot buffer area shall be seeded and maintained as per the attached Soil Conservation Service recommendations. 9. Construction on Parcel A shall begin within one year of approval by the Board of County Commissioners. 10. Prior to any development on Parcel B, the applicant shall come before the Weld County Planning Commission and Board of County Commissioners for re- view of the impacts of the developed Parcel A. At this time determination will be made as to allowing or disallowing the development of Parcel B as shown on the attached plat. Prior to the issuance of any building permits or any development occurring on Parcel B as shown hereon, the applicant shall submit: a) Evidence that Parcel A has been fully developed, b) A well permit approved by the State Engineer for Parcel B, and (De_ _ )pment Standards - Jamison SUP) c) Approval of a sewage disposal system 11 . Two cisterns each with a holding capacity of a minimum of 1250 gallons and each with an 18" manhole cover, shall be installed in the area adjacent to the mobile home and shop building. 12. The Special Use Permit shall be limited to the plans submitted and governed by the development standards stated above. Dig three holes 4-12 inches in diameter in a triangular pattern in the area which the proposed absorption field is to be located. Holes should be approximately 20 feet apart (see diagram). Test holes should be approximately 3 feet deep. B. Dj, the three holes at least 8 hrs and not more than 36 hours prior to running the percolation test. Fill the holes with water immediately after digging and cover with boards or similar material if weather is cold and inclement to keep foreign material out and to keep holes from freezing. C. Leave adequate water at the site for the holes to be refilled for the percolation test. (15-25 gallons) D. One hole of post hole size or larger must be dug to a depth of 8 feet to determine the soil conditions at the site, and the ground water depth.
