As a community our current facilities are maxed out. As it is in most small towns it is no different in Eaton Colorado in the fact that the schools tend to be the hubs of the community. Currently people in town and out of town are using the school facilities and parks that the town has for their recreational purposes. The parks and buildings are booked out and children and adults are having to book facilities in Greeley and Evans just to get practice time. This has put a great burden on our citizens and additionally it has burdened the Greeley/Evans system for time slots. We are doing a IGA with the Rec Center and the school district since the pool will be used by the school district for competitions and for classes that they work into their curriculum to teach children how to swim. The current pool that the community uses is at the high school and is getting to a point because of its age that it is almost unusable. The proposed Community Rec Center is a facility that can be utilized by all of the areas residents. With a proposed community room that can be used for events such as weddings, plays, graduation events ect., along with a kitchen to serve meals to senior citizens, there is also basketball/ volleyball courts, leisure pool, and baseball/ softball, and soccer fields. This is a facility where as we are trying to be as fiscally responsible with the tax payers money as possible so we are not doubling up on facilities, and we are expiring the construction part of the mill levy upon payoff. We strongly believe this Community Rec Center will be a draw to the Eaton area which will help it to grow businesses and provide much needed jobs in the area. District Brad Attached for your records are copies of the letters sent 8/21/2013 in response to the referral notices to Severance and Ault about the proposed "Eaton Recreation District", which incorporates portions of each municipality. I do not know why they were not received by Michelle. Ault has elected not to pursue its objection, as it is years from seeking its own recreation District. Severance, however, has concerns and will seek to exclude its territory from this District unless it has alternate assurances that will allow the same result for the future. Since I had a Board meeting in Berthoud last night, I was unable to stay for the final determination. What did the Planning Commission decide? If they forwarded it to the commissioners, when is that hearing? The property is zoned agricultural though I do not meet the surface area of 40 acres, the property is closer to Galeton and Ault than Eaton, which is almost twice as far away as either of the other two towns. In that the property is not in the city limits of Eaton I do not feel that I should be made to pay for their parks and recreation programs. There is just something wrong with towns trying to impose taxes on county residences that are not in their city limits. Their rules and regulation should stop at the city limits, where do they go next, do they try to collect sales taxes, building permits and impose other city ordinances on county residences. They do not even provide fire service out here, that comes from the Galeton fire district so why should they collect taxes for something as unnecessary as Parks and Recreation. Parks and Recreation should be self funding from fees, if they do not attract enough people, then don't do it, supply and demand. If there is no demand then don't supply it, run the town like a business not a charity for someones pet project. Thank you for removing my property from the proposed "Eaton area Parks and Recreation District". Should there be the need to file any other paper work please let me know or if I need to make arrangements to appear at any meetings to make this opt -out final. Box 758 Greeley, CO 80632 Subject: Petition for exclusion from the Eaton Area Park and Recreation District RECEIVED SEP 15 W2 WELD COUNTY COMMISSIONERS Commissioners I'm assuming that my only chance for representation for this possible taxation to my property is to write a letter. The notice is vague at best as to what procedures I have to follow to request exemption from this tax other than to request that my property be excluded. No other information is given as to where to send the notice and how or if I'm notified of your decision. It lists two public hearings but I, as most people, work during those times and would have to take time off to attend. I would bet that most that receive this notice won't take the time to write and like myself can't attend the hearings. This district to me is something they want not need. I'm sure they list many reasons as to the benefits of creating such a district but given the economy and the fact that many have struggled to keep their homes during tough times, is imposing an additional mill levy to our properties really a good idea? I've endured a state government that has imposed higher fees on my vehicles under the guise of better roads; they're in some of the poorest condition I've ever seen. They imposed emission tests on my vehicles with no discernible benefit to air quality. Xcel energy imposes a tier program in the summer doubling my rate for electricity but I can't go anywhere else to purchase electricity, nor can anyone tell me where that money goes or what it is used for. Now the Governor is asking to increase my income tax to throw money at a broken education system. I've lived within my means and have worked hard my whole life only to see government take more and more. There are many things I want but I live with what I need and only after saving do I take the luxury of purchasing something I want but don't need. I have vehicles that the newest is 11 years old, sure I'd like a new car but I don't need one and I chose not to have the payment. You as Commissioners have chosen to explore secession from the state. You've stated you want the Governor to know you're tired of being ignored and bypassed for the interests of the Denver Metro area. Weill, too, am tired of everyone thinking that taxpayers work to fund every project that they come up with or that money fixes broken systems. This district while it may be worthwhile to residents of Eaton, people in the rural areas, although in the Eaton School district will see little or no benefit; there is no public transportation I can use to send kids to town to use the facility. We end up driving them and then picking them up just to be able to use the EXHIBIT Ins 2--(3b OD, recreation facilities and many farming families work (yes even the kids) in the summer yet they're taxed the same as the ones living in town. The notice also states that property over 40 acres zoned agricultural are exempted from this tax unless consent is obtained from the owner. How many consent forms do you think you'll see? Eaton has always been one of the most affluent agriculture communities in the area yet some of the owners that could afford the tax the most are automatically exempted. This district is not needed at this time and if they can't live without it then limit it to within the town's boundaries where it will be used the most, not cast the net to the entire school district. If the mills don't raise enough money with just that tax base then they wait until they collect enough to move forward. I am respectfully requesting that the district service plan be disapproved as it is not needed at this time, however, if you feel it is in the best interest of the citizens I request that my property be excluded from the district as I will never benefit from such a facility and I pay enough taxes for things I derive nothing from. I live on the edge of the Eaton School District and own both attached and unattached mineral rights so I think I am well qualified as someone that the Planning Commissioners apparently are concerned about. I understand I can opt out of the district if I so choose and hopefully you will allow me the opportunity to express my position with a vote. More importantly I also understand that I am a part of the community and I have an obligation to its members, because at times my mineral rights ownership can impact their everyday life. As a result I am grateful that the community allows the production of oil unlike some other counties in Colorado. I understand the Commissioners voted down the Kersey application due to large land owner that was not given the chance to opt out of the District and apparently did not know what was going on, while I understand his concern I am embarrassed for him as a mineral rights owner. At times I have been concerned with the whole " 51st state" movement as a distraction. But, the most important point in this exercise has been "allow the people to vote". I am asking that you follow that same guidance as you consider to allow the Eaton Recreation District to have the same self- determination. Raising our taxes is only the beginning of this project. Consider the long term outlook of building any and all structures, maintenance, operation costs, and employees for all structures. We have lived long enough to know this District is just the tip of the Iceberg for raising taxes. More mill levy hikes will follow. 2. Locals should not be impacted by any large new buildings as it will impose too big of an annual tax burden on local and district residents to build and operate. Plus, I would imagine there would be a daily or monthly fee for anyone to use it. You may call this an entrance fee. It is a tax. A rose is a rose is a rose... 3. Think about how much these tax payments will add up to and then consider who will be getting their money's worth in terms of usage. I know we won't. 4. My spouse and I own and operate horse property for our hobby and pleasure. We moved to weld county in 2012 for retirement purposes with our horses. We will shortly be on a fixed income. Both of us are in our mid to late 60's, raised real estate taxes will not be a comfortable for our income. We get plenty of exercise & recreation working with our horses and growing hay on our property. 5. Private owners can't compete with a public subsidy, so it's likely that one or more of the clubs in the area will go under, pulling the rug right out from under hard-working business people just when the economy is recovering. 6. Do we really need another public recreation facility in this area? There are already facilities in Greeley and Fort Collins. Have any of you used them? We have not. 7. The need for a new facility is something I believe has yet to be proven conclusively. 8. I do not believe that taxpayers should be responsible for the wishes of special -interest groups over the needs of the community as a whole. As grandparents we have the joy and responsibility to support our grandchildren in their athletic endeavors. Unfortunately the overcrowding of the Greeley recreation programs and their facilities sometimes makes this very difficult. The parking at both Monfort Park and Roach ball fields is a nightmare. When the parking lots at Monfort Park are full we sometimes have to find parking in the neighbors on the west side. There are no sidewalks in that part of Greeley so we have to either trespass on private property or walk in the street just to get to the park entrance. With programs and facilities in Eaton, more families would be able to participate close to home and the over -crowding in Greely would be eased which would be a benefit to both communities. Also we are excited about the provisions being made for the Senior citizens of Eaton. To have an inside track where we can walk without being subjected to adverse weather conditions would be a plus. I have lived in Eaton, at the address above, with my wife and two high school age daughters for 8 years. We received a notice of hearings on September 16th announcing a public meeting the very next day with the Weld Planning Commission. I was unable to attend that meeting, and I am not sure of the outcome. This notice was the first I had heard about this proposal, and to be honest, the notice's language about an increased tax for a "recreation district" surprised me a bit. I read through the notice, and later did a little research online finding the Facebook page of the proposed district, and their Service Plan dated July 15, 2013. I have several issues I'd like to raise to your attention that threw up some red flags for me. I'll outline some of my concerns below including the need, location, and scope of this proposal. I have a little trouble following the "Need for the District" section of the plan. On page 2 of the service plan, they talk about a survey that was completed in December of 2012 in which "249 surveys were completed by residents of the Town and surrounding area." The results were "overwhelmingly in favor of a multi -faceted community/recreation center" I have a few problems with this as support of this lofty project — first, page 6 of the plan shows the proposed district has a current population of 8000 people — 249 surveys represents about 3% of the population; hardly "overwhelming". The second problem is, there is no mention of how the survey was worded; if it was worded to ask "if" people felt a recreation complex and tax district was justified, or simply what kind of things people would "like" to have if given the chance. This is an important difference that I believe would make a big difference in responses. On the subject of need, it was not long ago that Eaton built a new Police station with an attached Recreation Center. I realize this is not the same "class" of space they are proposing, but it is a facility that is available to the public, and I believe it is VERY underutilized. There are a few classes that are scheduled through the Town Recreation department, but other than that, the space is often unused. Eaton currently has two commercial "workout" centers — a Crossfit, and a Snap Fitness center. These commercial offerings allow people an opportunity for recreation and fitness in a "pay your own way" model rather than a blanket tax. We have had a few other commercial ventures in town including a Curves fitness center that were unable to sustain their business, which makes me wonder how sustainable a community recreation center would be. Page 2 of the service plan also Weld County Commissioners October 9, 2013 Page 2 discusses some regional recreation center options such as Greeley and Windsor's centers. Greeley has two Recreation Centers, the Greeley Rec Center, which is 8.7 miles away (13 minutes), and the Family Fun Plex which is 10.5 miles away (19 minutes). Windsor also has a Town Recreation Center that is 13.5 miles away (24 minutes), and an outdoor pool at Chimney Park that is 13.8 miles away (23 minutes). The plan talks about these options as being unusable due to distance, but I believe many people along the Front Range of Colorado, as well as around the country would be very happy to have that kind of access. I also don't believe spending $24 million taxpayer dollars is justified to cut that time down for a small number of people. Another major issue I have with this proposal is around the location. First of all, the land that is planned to be used is owned by the Eaton School District, and was purchased in 2011 with taxpayer money for future school expansion. The total land area is just under 100 acres, and the plan is to use 35 acres for this recreation center that would be owned by the Recreation District, which is a pretty large misrepresentation of this land purchase if it was truly not needed by the School District. Exhibit B in the plan shows the proposed recreation facility and grounds as it exists today — farmland with a wellhead and tanks located almost in the center. If you overlay Exhibit F, showing the site plan, that wellhead would be located at about the corner of the swimming pools part of the building, or in the parking lot just outside. I'm assuming there will be a significant cost to relocate that wellhead that I don't see anywhere in the plan. On page 10 of the plan, compatibility of the center is discussed. Although the building design (Exhibit D), does have some architectural similarities to the old depot and sugar factory building (recently torn down), I believe it would look more at home in Cherry Creek, Aspen, or any large town. It is a giant building that will be built on the edge of town, surrounded by corn fields and single family homes. In their quest to fit in, I don't believe the committee has taken into account the two baseball diamonds and soccer fields that are directly behind a group of homes. I'm sure the noise and stadium lights located just feet from their back yards will not increase their property values. We currently live 4 blocks away from the High School baseball field, and have to deal with the stadium lights shining in our bedroom windows and PA announcements until 10-11 pm on most summer nights. I don't know how the people who live across the street from there now can sleep when it's nearly daylight outside their homes. This plan will put another field 4 blocks in the other direction from my home, which I don't look forward to. Another issue in relation to compatibility is that the primary access into this large campus from town will be on third street, currently a dead end, which will increase traffic through the area, as well as a school zone by the middle school which is already congested and dangerous. The Eaton Police Department is there daily during the school year to help shepherd traffic as it is. I believe the scope of this project is overly ambitious for our small community. I did some quick fact checking on the City of Greeley's website, and found that the Greeley Rec Center is 105,000 square feet, which is smaller than the proposed center in Eaton by 10,000 square feet. In 2006 the City of Greeley built the Family Fun Plex to expand their recreation offerings to a city of 88,000 people plus the surrounding area. This expansion is similar to the plan being proposed in that it includes an outdoor recreation area with ball fields, a community park, indoor pools for recreation, and water park area. The Family Fun Plex was built for under $20 million dollars. The plan calls for an annual maintenance budget of $1.2 million dollars, which, while being a very large number, seems low to me to properly maintain a 35 acre campus, a 115,000 square foot building, and 3 swimming pools. There are also salaries to be paid for staff, lifeguards, etc, and I'm sure this will need to be insured. Even if this amount does cover the associated costs, the mill levy assessment to keep the doors open and pay off the $24 million dollar debt will be approximately equivalent to the levy paid for Aims Community College, which I would argue is a more beneficial use of tax dollars for a larger group. Weld County Commissioners October 9, 2013 Page 3 After reading through the plan, I was left with many unanswered questions that I'd like to see addressed. • On page 5 of the plan, the district boundaries are limited to the Eaton School District Boundaries, even though we have 3 other small towns in very close proximity who probably have the same recreational needs that we do. Was any attempt made to include these other towns? It seems like a no-brainer to create a larger district with more tax base and potential users. • Has any research been done in reference to current utilization as a percentage of population for existing recreation centers in Greeley or Windsor to help predict what usage may be in our center? • On page 10 of the plan, the committee talks about being "able to undertake the immediate development and improvement from Town recreation department." Does this mean that the Town recreation department will be eliminated, and our tax assessment will be reduced? • Can we see a comprehensive list of what the $1.2 million dollar annual budget includes? Has any research been done with existing recreation centers showing their actual costs? • What kind of message does this send to the small businesses that are providing recreation services? • On page 11 of the plan, as well as in the Notice of Hearings, there is wording around a "Maximum Debt Mill Levy" of 50 mills. I'm unclear of what exactly that all means, but it appears if needed, we could be accessed much more than the planned 6.924 mills. Does this allow the new district to vary the mill levy up to 50 mills? • I don't see any mention in the financials of costs associated with relocating the well head and tanks currently on the property, am I missing that? When I printed off the plan, I noticed that the Eaton Area Park and Recreation District Organizing Committee, who has been nameless, faceless, and had no contact information until now, listed a contact on the front of their plan. I found it very interesting that the contact for this new district is also the Superintendent of the Eaton School District, who will be providing the land "through a long-term lease or sale by the Weld County School District RE -2 in partial exchange for use of the recreation center facilities." (Page 13 of the plan) At best this looks like a big conflict of interest. As I looked over this plan, I couldn't understand how the need was being justified, why this location was chosen, and why it seemed to be so over scoped for our small town. It wasn't until I saw who all the players were that I put this all together. This proposal is a huge win -win for the School District, and a big sham for the tax payers. I believe the land that the school district bought just two years ago was a part of this plan. The Eaton School District places a lot of importance on school sports, and I believe they feel without multi -million dollar, state of the art facilities, they are not providing what the students athletes need. It appears to me, through the general wording in this plan, that the real plan is to build a new high end sports complex under the guise of a "community recreation center". Then, when the School District builds a new High School right next door without enough room for sports facilities, the solution will be obvious, since the School District so generously "leased" the land to the Recreation District. The School District will get a nice new sports complex without spending a dime of School District tax money, or having to pay to maintain it. Meanwhile, the entire school district (minus any farms), will be double taxed — once for the schools, that no longer have to buy or maintain their sports facility, and again for the "recreation district", which will be synonymous with the school sports programs. Weld County Commissioners October 9, 2013 Page 4 I am not opposed to the possibility of an area recreation district, or a small tax increase to fund one, but I think if we as a community agree to the need, we need to aim for a much smaller scale project with options available for future expansion as the area continues to grow. We need to plan for manageable, responsible growth, which I believe Weld County is known for. I believe a regional facility would make much more sense, and this current plan to "share" a facility with the School District is really a plan to double tax citizens for a public school facility. The City of Greeley is neutral on the substantive issue of forming a parks and recreation district, but it does have a request to modify the proposed and future boundaries relative to existing and future City limits. This modification was preliminarily discussed with Mr. Hoimsberg at the meeting referenced above, with his initial reaction of openness to the possibility. Please see the attached map, which illustrates which areas of the proposed district overlap existing City limits. The same also shows areas that are anticipated to urbanize and be in City limits in the future (referred to as the "Long -Range Expected Growth Area"). Based on our conversation and review of the application, we understand this to be a proposal for a special taxing district (not a metropolitan district) that would have boundaries coincident with the existing Eaton RE -2 School District boundaries. A few observations emerge: • Existing City residents currently pay property taxes for City services, including parks and recreation. Including them in the District would essentially result in double -taxation. As such, students may in fact go to the newly -proposed recreation center in Eaton for indoor school -sponsored sports, particularly in high school. However, just as likely is the situation that students — particularly elementary aged — would participate in club sports, and those would be more likely to take place at the Greeley Recreation Center and nearby parks than in Eaton. • While the stated purpose of creating the District is to only build a recreation facility in Eaton, future urbanizing areas north of Greeley will need to be serviced by parks. These will be built and funded with city taxes, which may again create confusion for future residents about why their tax bills would show a separate 6.9 mills for a parks and recreation district that does not service their area with parks. City of Greeley Request The City requests that, if approved by the Weld County Commissioners, that as a Condition of Approval the District Service Plan be amended to exclude land that is currently in the Greeley City limits from the Service Area boundaries, and that a clause be included in the District Service Plan requiring the District to seek exclusion from the Service Area, at the District's cost, of any lands that are subsequently annexed in the future into the City of Greeley, using the due process established by state and local law. With this Condition of Approval, future Greeley citizens will be appropriately provided with park and recreational services, without a detriment to their taxing structure or confusion about service providers. To the Eaton School District residents: Around September 14. you received or should have received 'The Proposed Eaton Area Park & Recreation District mailing. The mailing confained Notice of Hearings, and other vital information for consideration of the Organization of the Eaton Area Park and Recreation District. In that letter it stated there would be a 3 mill levy increase for the operations of the facilities and another 3.924 mill levy increase to build the proposed Recreation Center. That's a total increase of 6.924 mill levy. If a property within the school district is 40 acres or more and zones agriculture, they would not be included in the .tax, unless the property owner opts In. Box 758 Greeley, CO 80632 To The Honorable Weld County Commissioners: I am writing on behalf of the Boys & Girls Clubs of Weld County (BGCWC) to express our overwhelming support for the Eaton School District's efforts, which has assembled with other community leaders in an effort to form a parks & recreation district. BGCWC has partnered with the Eaton school district since 2003 and currently serves up to 50 youth a day at the Galeton Clubhouse. However, BGCWC is currently unable to serve more Eaton youth during the school year due to the lack of available public or private facilities for our programs. We understand that Eaton's efforts to form a park & recreation district include the proposed future construction of a recreation center. BGCWC has engaged in preliminary and informal discussions with the Eaton community regarding an expanded partnership that would entail BGCWC's use of the recreation center if funded and constructed. While we support Eaton's efforts to improve the quality of life and critical success outcomes for youth in their community, we also want to clarify that BGCWC has not committed at this time to provide any private funding for the construction of the proposed recreation center facility. The feasibility of BGCWC's future involvement with the project will, be determined by: 1) an evaluation of the support and demand for our programs and services (likely through a school -based summer program), and 2) the level of volunteer leadership and philanthropic support BGCWC is able to receive from the local Eaton community. We firmly believe in the benefits of `seamless' youth development and academic support program that the BGCWC can provide in partnership with a local community and school district. We thoroughly trust that you will review Eaton's proposal with the best interest of the youth of Weld County and the Eaton school district in mind. This important project will help offer much needed recreation facilities to both residents and students alike. In 2012, Anadarko paid over $75 million in taxes in Weld County in and expects to greatly increase that number in 2013. We have increased the low -end of our estimated recoverable resource range in our Wattenberg asset to between 1 billion barrels equivalent (BOE) and 1.5 billion BOE, an effective increase of approximately 500 million barrels. The application of technology in the Wattenberg field is the key to safely unlocking the area's tremendous resource potential. The combination of horizontal drilling and hydraulic fracturing is extending the productive life of this prolific area, expanding the economic benefits for Colorado, and playing an important role in reducing America's need for imported energy. Anadarko plans to invest more than $2.5 billion in capital over 2013 and 2014 as it expands horizontal drilling activity in the Wattenberg area and continues to explore additional opportunities outside the field's core. We feel this will be a great facility for the Eaton community - a project that will release stress on over used and dilapidated facilities, along with providing a huge economic spark for the community to help attract new business and housing opportunities. District Brad Attached for your records are copies of the letters sent 8/21/2013 in response to the referral notices to Severance and Ault about the proposed "Eaton Recreation District", which incorporates portions of each municipality. I do not know why they were not received by Michelle. Ault has elected not to pursue its objection, as it is years from seeking its own recreation District. Severance, however, has concerns and will seek to exclude its territory from this District unless it has alternate assurances that will allow the same result for the future. Since I had a Board meeting in Berthoud last night, I was unable to stay for the final determination. What did the Planning Commission decide?
