RESOLUTION
D WHEREAS , heretofore by Treasurer ' s Deed dated
L" February 8 , 1957 , the County Treasurer of Weld County,
Colorado, granted and conveyed unto Frank Komatz all min-
erals and coal underlying certain lands known as Evans
Addition (Evanston) , more particularly described in Dis-
claimer and Quit Claim attached hereto and made a part
o
hereof by reference, and

`o WHEREAS, uncertainty exists as to the right and
authority of said Weld County Treasurer to convey the min-
erals contained within the aforesaid lands, which the County
of Weld, acting by and through its Board of County Commis-
sioners wishes to clarify and correct, as resolved at its
regular meeting on the 22nd day of December, 1975, and
`‘`crLD WHEREAS , a Disclaimer and Quit Claim hereinabove
mentioned has been presented to the Board for its review,
and
WHEREAS, the Board believes it to be in the best
interest of the County to execute said Disclaimer and Quit
Claim.
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County Commissioners, Weld County, Colorado, that the Dis-
claimer and Quit Claim, as presented, copy of which is at-
tached hereto and made a part hereof by reference, be, and
it hereby is approved, and that the signatures of the Board
be affixed thereto, attested by the County Clerk and Recorder.
The above and foregoing Resolution was, on motion
duly made and seconded, adopted by the following vote this
24th day of December, 1975 .

DISCLAIMER AND QUIT CLAIM
WHEREAS, by Treasurers Deed dated February 8, 1957, recorded
February 8, 1957, in Book 1469 at page 605 of the Weld County

Records, the County Treasurer of Weld County granted and conveyed

unto Frank Komatz all minerals and coal underlying the following
o described lands in the County of Weld, State of Colorado, to wit:
Township 2 North, Range 67 West, 6th P .M.
Section 30: W/2 SW/4
and
,„ WHEREAS, the above described lands are also known as Evans
`�J Addition (Evanston) pursuant to a Subdivision Plat filed for record
on October 21, 1907; and
WHEREAS, uncertainty exists as to the right and authority of
said Weld County Treasurer to convey the minerals underlying certain
lots and blocks contained within the aforesaid lands which the
County of Weld, acting by and through its Board of County Commis-
sioners wishes to clarify and correct; and
WHEREAS, at its regular meeting on the 22nd day of December
1975, the Board of County Commissioners of said County, being fully
apprised of the situation, has resolved to clarify and cure any
uncertainty with respect to said lands , which said resolution was
duly entered of record in the Minutes of the said Board of County
Commissioners of said County;
NOW, THEREFORE, for and in consideration of the sum of One
Dollar ($1. 00) and other valuable consideration, to said Weld
County in hand paid, the receipt and sufficiency of which is hereby
acknowledged, the said County of Weld, State of Colorado, acting
by and through its duly elected and serving Board of County Com-
missioners, and pursuant to the aforesaid Resolution, does hereby
disclaim all interest in any and all minerals underlying the afore-
said W/2 SW/4 of Section 30, Township 2 North, Range 67 West, of
the 6th P .M. ; does ratify and affirm the aforesaid Treasurers
Deed as if the same had conveyed the minerals underlying the said

lands pursuant to order of the Board of County Commissioners;
' and does further quit claim to the present owner or owners claim-
ing under the aforesaid Treasurers Deed all of its right, title
and interest in all minerals and coal underlying the W/2 SW/4 of
Section 30, Township 2 North, Range 67 West, of the 6th P.M. ,
Weld County, Colorado.
