ORDINANCE NO. 26
IN THE MATTER OF A SUPPLEMENTAL APPROPRIATION FOR THE YEAR 1978.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS
OF WELD COUNTY, COLORADO
WHEREAS, the Board of County Commissioners of Weld County,
r_ Colorado, has been advised that certain expenditures by Weld
County are necessitated according to provisions established by

the State Department of Highways , Division of Highways - State

of Colorado Special Provisions, Colorado Project No. PMS 0004 (6) ,
c> and
WHEREAS, the State Department of Highways requires that
said special provisions take precedence over Specifications or
Li_ Plans, and supplement the Standard Specifications for Road and
Bridge Construction regarding Colorado Project No. PMS 0004 (6) ,
and
WHEREAS, the Weld County Road and Bridge Department has
determined that its expenditures for said project will amount
to THIRTEEN THOUSAND TWO HUNDRED AND SEVENTY DOLLARS ($13,270.00) .
The State Department of Highways will reimburse said sum to Weld County in the
form of a grant under Project No. PMS 0004 (6) , and
WHEREAS, pursuant to the provisions required by the
State Department of Highways, the Board of County Commissioners
deems it advisable and in the best interest of Weld County to
appropriate the State Department of Highways grant to the
Weld County Road and Bridge Fund, and
WHEREAS, by Section 29-1-114 , CRS 1973, as amended, the
governing body of a county does, in an emergency situation,
have authority for the expenditures of funds, by ordinance,
duly adopted by a two-thirds (2/3) vote of the members of said
governing body.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Com-
missioners of Weld County, Colorado, that the expenditures in
the amount of $13, 270 . 00, as more fully set forth on the attached
copy, and being incorporated herein by reference, be, and hereby
are, approved.
BE IT FURTHER ORDAINED that said expenditures have been
appropriated from a special State Department of Highways grant
to the Weld County Road and Bridge Fund.

BE IT FURTHER ORDAINED that an emergency exists which re-
quires that this Supplemental Appropriation Ordinance be en-
acted forthwith, and therefore, this Ordinance No. 26 is de-
clared to be an emergency ordinance under the provisions of
Section 3-14 of the Weld County Home Rule Charter.
The above and foregoing Ordinance No. 26 was, on motion
duly made and seconded, adopted by the following vote on the
22th day of February, A.D. , 1978.
