WELD COUNTY, COLORADO
JULY 29, 2013
The Board of County Commissioners of Weld County, Colorado, met in regular session in full
conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County
Administration Building, Greeley, Colorado, July 29, 2013, at the hour of 9:00 a.m.
El ROLL CALL: The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:

MINUTES: Commissioner Kirkmeyer moved to approve the minutes of the Board of County
Commissioners meeting of July 24, 2013, as printed. Commissioner Conway seconded the motion,
and it carried unanimously.
r= CERTIFICATION OF HEARINGS: Commissioner Rademacher moved to approve the
Certification of Hearings conducted on July 24, 2013, as follows: 1) USR13-0019 - Mark Birkin, c/o
Adam Gorove. Commissioner Kirkmeyer seconded the motion, which carried unanimously.
AMENDMENTS TO AGENDA: There were no amendments to the agenda.
CONSENT AGENDA: Commissioner Rademacher moved to approve the Consent Agenda as
printed. Commissioner Conway seconded the motion, and it carried unanimously.
PRESENTATIONS:
El 1) RECOGNITION OF UNITED WAY DAY OF ACTION VOLUNTEERS: Staci Datteri-Fry
introduced Team Weld, including Commissioner Conway, noting that many participants brought their
families and all worked hard, and she introduced Carly Koppes, team captain. Ms. Koppes explained
the group's activity for the day, which was cleaning up the City of Greeley's Sheep Draw Trail to make
new areas ADA compliant and thanked the Board for the opportunity to work with United Way.
Commissioner Conway thanked the volunteers for giving up a Saturday of their own time.

PUBLIC INPUT: Doris Williams, County resident, in regard to the Sundowner Ranch in Keota,
said she heard someone wants to start an animal sanctuary on six (6) acres and is concerned that is
too small a parcel, noting there is no water on the property and it is in bad shape. Ms. Williams said the
group has a website, and she requested a work session with the Commissioners on this, as they are
already moving animals in. In response to Chair Garcia, Ms. Williams said she has not yet contacted
the Planning Department. Chair Garcia noted what she is describing would require a Use by Special
Review. He asked Ms. Williams to submit her notes for the record, marked Exhibit A. Commissioner
Kirkmeyer stated she would look the notes and website over and pass the information along to Tom
Parko, Director of the Department of Planning Services. In addition, Ms. Williams mentioned that Weld
County owns property in the Town of Keota that needs maintenance. Commissioner Conway invited
her to talk to Toby Taylor, Director of Buildings and Grounds, in regard to that issue. Chair Garcia said
a work session would be delayed until more information is available. Ned Sprague, County
resident, also spoke to the issue in Keota. He noted that some years ago he had requested use of the
town well, and was declined, but these new people have moved in and appear to be utilizing the well,
which is owned by Weld County. He also addressed the dust issue at the intersection in Keota, brought
before the Board two weeks prior. Commissioner Conway said he would see if getting a counter to that
intersection could be expedited. Mr. Sprague said he estimated 1,000 vehicles per day taking 103 to
390 and said traffic on 105 and 104 is also very bad. Doug Meyer, County resident, spoke in
regard to a recent article in the Greeley Tribune regarding a ban on Weld County employees politically
campaigning on county property. He said that he feels that this is petty, because you should be able to
drive your own car to work with a campaign advertisement on it. Commissioner Conway replied that
the Weld County Code is explicit in stating Weld County employees are not allowed to campaign at
work, and noted that if exceptions are made, there is concern regarding proliferation. Commissioner
Kirkmeyer noted this activity is disallowed in the Charter as well and noted the difference between an
"employee" and an "elected official". She told Mr. Meyer that some employees have actually taken a
leave of absence in order to campaign without breaking the rules. There was also some discussion in
regard to an extension of term limits done via a ballot measure in 2007.
BIDS:
1) APPROVE BID #B1300131, SPRINKLER SYSTEM AND SOD (340 MAPLE STREET,
FREDERICK) - DEPARTMENT OF BUILDINGS AND GROUNDS: Toby Taylor, Director of the
Department of Buildings and Grounds, said staff recommends the low bid from Panorama Coordinated
Services. Commissioner Conway moved to approve said bid. The motion was seconded by
Commissioner Freeman, and it carried unanimously.
2) APPROVE BID #B1300132, ROOF REPLACEMENT ON EXTENSION BUILDING -
DEPARTMENT OF BUILDINGS AND GROUNDS: Mr. Taylor said staff recommends the second low
bid from Central States Roofing be approved, as there was a clerical error in the low bid and it was
withdrawn. Commissioner Rademacher moved to approve said bid. The motion was seconded by
Commissioner Kirkmeyer, and it carried unanimously.
3) APPROVE BID #B1300134, HVAC EQUIPMENT (1950 O STREET) - DEPARTMENT OF
BUILDINGS AND GROUNDS: Mr. Taylor said staff recommends the low bid from Horizon Mechanical
Solutions. Commissioner Freeman moved to approve said bid as recommended by staff. The motion
was seconded by Commissioner Conway, and it carried unanimously.

a 4) APPROVE BID #B1300137, ISLAND GROVE CHAIRS/CARTS (QTY. 3,000) -
DEPARTMENT OF BUILDINGS AND GROUNDS: Mr. Taylor said that staff recommends withdrawing
this bid in order to lower specifications to a 450 lb. minimum load. Commissioner Kirkmeyer noted that
comfort should also be considered. In response to Chair Garcia, Mr. Taylor said he did not know what
the chairs currently being used are rated and staff is also considering seat area and height.
Commissioner Rademacher suggested having a work session, and Commissioner Conway said he
supported staff's request to rebid this. The Board concurred on postponement and scheduling a work
session. Commissioner Kirkmeyer moved to dismiss said bid. The motion was seconded by
Commissioner Rademacher, and it carried unanimously.
NEW BUSINESS:
1) CONSIDER CONTINUATION APPLICATION FOR COLORADO PREVENTION
PARTNERSHIP FOR SUCCESS AND AUTHORIZE CHAIR TO SIGN: Judy Griego, Director of
Department of Human Services, explained Weld County is the fiscal agent and pass -though for these
dollars; North Range Behavioral Health acts as the program administrator, and the Interagency
Oversight Group acts as the planning entity for this grant, which is funded through the Colorado
Department of Human Services, Alcohol and Drug Abuse Division, to reduce substance abuse in Weld
County. Commissioner Freeman moved to approve said continuation application for funding and
authorize the Chair to sign. The motion was seconded by Commissioner Kirkmeyer, and it carried
unanimously.
2) CONSIDER THREE (3) COLORADO WORKS PROGRAM AND CHILD WELFARE
AGREEMENTS FOR SERVICES AND LEASES WITH VARIOUS PROVIDERS AND AUTHORIZE
CHAIR TO SIGN: Ms. Griego said these agreements are for the Compass Program, formerly known as
the Multidisciplinary Assessment Team (MVAT) to provide intervention services for child welfare.
Commissioner Rademacher moved to approve said agreements and authorize the Chair to sign. The
motion, which was seconded by Commissioner Freeman, carried unanimously.
a 3) CONSIDER CHILD PROTECTION AGREEMENT FOR SERVICES AND OFFICE LEASE
AND AUTHORIZE CHAIR TO SIGN — PRIDE DIALECTIC, LLC: Ms. Griego said this program
addresses youth gang involvement and noted the Department of Human Services will house the
program for one year. Commissioner Freeman moved to approve said child protection agreement for
services and office lease and authorize the Chair to sign. Seconded by Commissioner Conway, the
motion carried unanimously.
4) CONSIDER CHILD PROTECTION AGREEMENT FOR SERVICES AND AUTHORIZE CHAIR
TO SIGN - GLENN KNIPSCHEER, DBA GLENN KNIPSCHEER AND ASSOCIATES POLYGRAPH
SERVICES, INC.: Ms. Griego reviewed the terms of the agreement for polygraph services.
Commissioner Conway moved to approve said agreement and authorize the Chair to sign. Seconded
by Commissioner Freeman, the motion carried unanimously.
EI 5) CONSIDER TWO PURCHASE OF SERVICES AGREEMENT AMENDMENTS WITH
VARIOUS PROVIDERS, AND AUTHORIZE CHAIR TO SIGN: Ms. Griego explained that these are
amendments to service agreements, through the Area Agency on Aging, with Greeley Gopher
(transportation services) and the University of Northern Colorado Dining Services (meals) for the senior
nutrition program. Commissioner Conway moved to approve said amendments and authorize the Chair
to sign. The motion was seconded by Commissioner Freeman, and it carried unanimously.

6) CONSIDER RESUBMITTAL OF CONTINUATION GRANT FOR FEDERAL ASSISTANCE
FOR WELD COUNTY YOUTH CONSERVATION CORPS, AMERICORPS PROGRAM, AND
AUTHORIZE ELECTRONIC SUBMITTAL: Ms. Griego said this is year two of a three-year grant, the
resubmittal will reflect 10 member service years, as opposed to 15, in response to a decrease in federal
funding. Commissioner Rademacher moved to approve said resubmittal of continuation grant and
authorize the electronic submittal. Commissioner Freeman seconded the motion and it carried
unanimously.
• 7) CONSIDER TASK ORDER CONTRACT FOR DTAP WINNABLE BATTLE AND CIIS
SENTINEL SITE PROJECTS AND AUTHORIZE CHAIR TO SIGN: Commissioner Conway moved to
continue the matter until Wednesday, July 31, 2013, in order for staff to be present. Seconded by
Commissioner Rademacher, the motion carried unanimously.
a 8) CONSIDER AGREEMENT FOR PROFESSIONAL SERVICES AND AUTHORIZE CHAIR TO
SIGN - LINDSEY SIDES: There was some discussion in regard to the involvement of the Department
of Human Resources. Commissioner Conway moved to continue the matter until Wednesday, July 31,
2013, in order for staff to be present. Seconded by Commissioner Rademacher, the motion carried
unanimously.
• 9) CONSIDER TEMPORARY CLOSURE OF CR 398 BETWEEN CRS 59 AND 63: Amy Joseph,
Department of Public Works, presented a temporary road closure for six weeks, for Martin Marietta's
road improvements on CR 398, and she addressed dust abatement and the detour route.
Commissioner Rademacher moved to approve said temporary road closure. The motion was
seconded by Commissioner Kirkmeyer, and it carried unanimously.
• 10) CONSIDER OF RENEWAL APPLICATION FOR TAVERN LIQUOR LICENSE FROM
VIPER2, INC., DBA BORDERLINE AND AUTHORIZE CHAIR TO SIGN: Brad Yatabe, Assistant
County Attorney, said there are no significant changes and no negative comments by staff. Pete
Wagner, Weld County Sheriff's Office Deputy, described one incident - a traffic accident between a
vehicle and the building; he said no intoxication was involved and no one was hurt. Commissioner
Freeman moved to approve said renewal application and authorize the Chair to sign. The motion was
seconded by Commissioner Conway, and it carried unanimously.
g I 11) CONSIDER RENEWAL APPLICATION FOR TAVERN LICENSE FROM THE FORT 21,
LTD., DBA THE FORT 21 AND AUTHORIZE CHAIR TO SIGN: Mr. Yatabe introduced this application
noting no significant changes; he said the department of health had noted some food violations but did
not recommend denial at this time. Deputy Wagner said there have been no incidents reported at this
establishment. Commissioner Rademacher moved to approve said renewal application and authorize
the Chair to sign. The motion was seconded by Commissioner Freeman, and it carried unanimously.
a 12) CONSIDER APPLICATION FOR A TEMPORARY TAVERN LIQUOR LICENSE FROM
ROOM 119, TO EL RANCHO GRANDE NIGHT CLUB, LLC, AND AUTHORIZE CHAIR TO SIGN:
Mr. Yatabe introduced the application for a temporary license pending approval of a transfer of license
from the state. He said there are two partners, Jose Ibarra and Olga Galindo, who will act as manager,
and background checks are pending. He related two potential concerns: a suspension in 1998 for sale
to minors and a fine for serving a visibly intoxicated customer. The applicants have signed affidavits
affirming they have no criminal background. Mr. Wagner said the incidents on record seem to be
related to the hotel on -site and not the establishment. The applicants, Olga Gallindo and Jose Varra,
said they are trying to re -open the place, clean it up and make it a success. Chair Garcia opened the

floor and there was no public comment. Commissioner Rademacher clarified that if the background
check presents any concern the matter may be revisited. Commissioner Rademacher moved to
approve said application for a temporary permit and authorize the Chair to sign. The motion was
seconded by Commissioner Kirkmeyer, and it carried unanimously.
13) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL
AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN
- LONETREE ENERGY AND ASSOCIATES, LLC: Bruce Barker, County Attorney, said this tract is less
than an acre, and recommended approval. Commissioner Conway moved to approve said request,
accept the lease, and authorize the Chair to sign. Seconded by Commissioner Rademacher, the
motion carried unanimously.
Ca 14) CONSIDER APPOINTMENTS, REAPPOINTMENTS AND REASSIGNMENT TO PLANNING
COMMISSION: Commissioner Conway moved to approve said appointments, reappointments and
reassignment to the Planning Commission. The motion was seconded by Commissioner Rademacher,
and it carried unanimously.
15) FINAL READING OF CODE ORDINANCE #2013-5, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION, CHAPTER 3 HUMAN
RESOURCES, CHAPTER 5 REVENUE AND FINANCE, AND CHAPTER 14 HEALTH AND ANIMALS,
OF THE WELD COUNTY CODE: Commissioner Kirkmeyer moved to read by title only. The motion
was seconded by Commissioner Rademacher, and it carried unanimously. Mr. Barker read the title for
the record. Mr. Yatabe said there have been no changes since the second reading and reviewed the
changes made at that time and discussed in work sessions. Ms. Mika noted changes in Chapter V
Administration. Mr. Barker also noted no additional changes were made to the Mineral Leasing Policy.
Chair Garcia opened the floor for public comment. Commissioner Conway moved to approve said
Code Ordinance #2013-5 on final reading with amendments as noted by staff. Commissioner Freeman
seconded the motion and it carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinance #2013-5 was approved on Final Reading, with amendments.

Animal sanctuary needs money, help
Accepts abused, neglected horses, animals

The Sundown Ranch horse and animal
sanctuary needs donations and volunteers bad
set in Keota the ranch is located on six acres of
land nestled in the historic Pawnee Buttes.
Although it did not intend to go into business
quite so soon, it is already receiving animals,
said Marcia Weaver, which is causing a dire
need for help.
The ranch has been inundated vifith calls about
rescues, and has taken in several recently, she
said.
"We are hurrying up and putting up as many
stalls and corrals as we can," Weaver said. "We
are in great need of donations right now as we
are just starting up.9
The ranch is currently being reconstructed. The
idea is to rehabilitate, house and rovide

The Sundown Ranch, INC. is located on 6 acres of land in Keota, Colorado nestled in the historical
Pawnee Buttes. The ranch is currently being reconstructed and will soon be rehabilitating, housing and
providing veterinary care for horses and livestock that have been abused, neglected and abandoned.
The Sundown Ranch INC. is a non-profit, no -kill organization that rescues all types of Equine; mares,
stallions, draft horses, miniatures, ponies, yearlings, mares in foal and all types of livestock; cows,
calves, chickens, goats, kids, pigs and lambs. Our rescue is not limited to assisting the healthy but also
providing assistance to different types of horses and livestock in all different types of circumstances.
