Sekich, Route 1, Box 274, Longmont, Colorado, requesting a change of zone from "C" Commercial District (Planned Unit Development) to "C" Commercial District (Planned Unit Development, Amended), and WHEREAS, the petitioners were present, and WHEREAS, there was no opposition to the change of zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, and WHEREAS, the Board of County Commissioners has studied the request of the petitioners and studied the recommendations of the Weld County Planning Commission as submitted, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the petition of Nick Sekich, Sr, and Fred M. NW4 Sec. 26 T3N R68W C-UD to C-UD Amended November 4, 1975 Before consideration of action on this application the following portions of the Weld County Comprehensive Plan should be considered: "Commercial development in the unincorporated area of Weld County has not been extensive thus far. However, almost all of this development has occurred along the major highways, I-25, U.S. 34 and U.S. 85. This trend should not be allowed to con- tinue, for such commercial development works against the primary purpose of transportation arteries, the rapid and safe movement of large volumes of traffic. Land along major arterials cannot be used for commercial use without disrupting the controlled access which is such an essential aspect of the proper function- ing of arterials. Even along I-25, which is a grade separated, controlled access highway, extensive commercial development will disrupt the functioning of the interchanges, which were not de- signed to provide commercial crossroads. The motivation to lure traffic from high speed, controlled access roads conflicts with the very purpose of these roads. Commercial development should be restricted to the incor- porated areas of municipalities unless necessary to provide absolutely essential highway services. Gasoline stations, restaurants, motels and other auto-oriented services should be located with care at areas where problems of access and traffic conflict can be minimized. Location of commercial use out- side of existing municipalities will encourage dispersed growth and will be of little aid to the econmic well being of the municipalities. The public has a right to control develop- ment along these major transportation routes, for it is the in- vestment of public treasure in these roads which makes them attractive for commercial use. Commercial land use in the county should be limited primarily to those agri-business functions that cannot be located, in a municipality. The following policies will guide commercial development in Weld County: 1 . Commercial development will not be encouraged in the unincorporated areas of the county unless it can be shown by the developer that the proposed commercial use cannot reasonably be located in an urban area. 2. Commercial development designed to serve the agri- cultural base of the county should be located wherever practical within a municipality; however, Z-266 SEKICH Page 2 whenever a distance from a municipality makes this an impractical or unprofitable establishment of such commercial service, facilities within easy access to each agricultural area will be encouraged. 3. Auto-oriented commercial services will be encour- aged to locate either within existing municipalities or at well planned and located areas along the major highways and thoroughfares. When located outside the municipalities, the developer will be asked to furnish justification of the need for the proposed commercial facility and to show, through a detailed Planned Unit Development approach, how the development will accomodate the traveling public without interference with the ongoing traffic." When the existing zoning was approved by the Board of county Com- missioners on March 27, 1974, and by the Planning Commission on January 7, 1974, it was approved based on the Planned Unit Development as submitted, and upon the following policies contained in the Weld County Comprehensive Plan. 1 . "The expansion and development of agri-business and agricul- turally oriented industry will be encouraged, provided these enterprises do not adversely affect the total economy or environment;" and 2. Commercial development designed to serve the agricultural base of the county should be located wherever practical within a municipality; however, whenever distance from a municipality makes this an impractical or unprofitable establishment of such commercial service, facilities with- in easy access to each agricultural area will be encour- aged. In the latter case, it was determined at the time the zoning was granted that the agricultural equipment dealership could best serve the agricultural community in the location at which it now exists. Since the time the zoning was granted, the following actions have occurred in violation of Weld County Regulations: Z-266 SEKICH Page 3 1 . A restaurant facility has been constructed on the premises without the benefit of proper zoning; 2. The original building proposed on the site was constructed without the benefit of inspections by Weld County Building Inspec- tion Department. 3. An additional building, not approved as part of the original zoning was constructed without a building permit; and 4. An additional access to Highway 66, not approved in the original Planned Unit Development has been created. After reviewing the above policies , and assessing the actions which have occurred since the original zoning on this property was approved, the staff has made the following findings: 1 . The restaurant, as it is now operated, does not violate the intent of the zoning as it was originally approved in March, 1974. So long as the applicants ' intent is to serve primarily employees, farmers and residents of the immediate area, the restaurant remains an accessory use to the equip- ment dealership. As defined by the Weld County Zoning Resolution an accessory use is "a use naturally and normally incidental to, subordinate to, and devoted exclusively to the main use of the premises. " In view of the policies set forth in the Weld County Comprehensive Plan and the intent set forth in the original zoning of the property, it is the opinion of the staff that the restaurant should not be allowed, if viewed as other than an accessory use to the equipment dealership. The restaurant should not be utilized as a means of "luring" traffice from I-25 and thus become a truck stop or tourist attraction similar to facilities located in the Del Camino and other similar areas. If this occurred, it would indeed violate the intent of Weld County policies and the intent under which the original zoning was approved. 2. The actions enumerated above as violations of Weld County Regulations are actions which violate the meaning and intent of Weld County Regulations and policies. Such actions should not be tolerated, and only serve to negate the overall meaning and objectives of policies designed to protect the health, safety and welfare of the residents of this County. It is thus the opinion of the staff that any further approval of additional uses on the property in question must clearly circumscribe the conditions which will have to be adhered to in order for such use to continue. Z-266 SEKICH Page 4 In view of the above findings, the policies enumerated in the Weld County Compre- hensive Plan, and the intent set forth in approving the original zoning of this property, the staff recommends approval of the proposed use under the following conditions; which limitations should be added to the amended Unit Development Plan prior to approval : 1 . The hours of operation of the restaurant facility will be limited to the hours between 6 A. M. and 6 P. M. 2. No outdoor signs will be utilized to advertise the restaurant facility which is in essence a use accessory to the equipment dealership. The above conditions will serve to significantly reduce the possibility that the restaurant would serve to lure traffic from high-speed roadways adjacent to the property and thus become a principle, rather than an accessory use of the property. 3. The two accesses shown on the P.U.D. will be designated for one-way traffic and signed so as to provide one exit and one entrance to the property. Signs establishing such control of ingress and egress, to and from the property, shall be placed by the applicant prior to January 1 , 1976. This condition will tend to reduce the congestion inherent in direct access to arterial highways. Such accesses tend to reduce the ability of such arterials to serve their primary function, the safe and efficient movement of traffic. 4. Placement of buildings or any similar structures on the property will be limited to those shown on this amended Unit Development Plan. Structures and buildings placed on the premises which are not in conformance with the Unit Development Plan shall be removed by the owner at his expense. 5. Prior to any allowed structure or building being con- structed or remodeled on the property, the owner shall obtain necessary building permits from the Weld County Building Inspection Division. Any structures con- Z-266 SEKICH Page 5 structued without such permits will be subject to removal at the owner' s expense. 6. Uses on the property and within the structures defined by this amended P. U. D. will be restricted to the uses permitted under this amended P. U. D. Uses conducted in violation of the uses permitted or conditions defined by this amended P.U.D. will be subject to discontinuance and/or removal at the owner's expense. No. The parcel has been zoned- C-UD but the original application sub- mitted by the former owners, Theodore and Elizabeth Rademacher was not complete in its detail; i.e. , it requested the use to be a John Deere dealership which excluded the sale of other brands of equipment; too, it does not show two access drives onto S.H. 66 and it further did not include provisions for a restaurant facility. The land has been de- veloped and inspected by the Building Inspection Department, the Weld. County Health Department and other entities. 2. Yes. It has been zoned C-UD by Weld County with the exclusion of the restaurant facility. This C-UD has been approved. 3. Yes. This facility is needed to serve our employees and the immediate area, including our farmer customers and those who serve them con- stitute 75% of our patronage as well as oil field workers in our vicinity. There appears to have been a breakdown in communications upon our part because Nick Sekich, Jr. , after his visit with you, was under the impression that the matter could be resolved and did most generously appreciate your kind cooperation and patience in attempting to alleviate a problem not of our solicitation or desire. Needless to say, Mr. Sekich, who is a farmer, was not familiar with either the procedure or process of planning and zoning, the comprehensive plan or the apparent violation under the approved zoning of this site. Not being developers proficient in the area of zoning, it was our thought that when Mr. Nick Sekich, Jr. was in your office after our establishment was "tagged" that we would be provided with necessary forms to process our restaurant into conformance with the zoning regu- lations. Our plans which are a part of your records do indicate a cafeteria or food service area for the purpose of our employees in that section of our main building. When it was expanded (in use) to the public it never occurred to us that we were violating any zoning regulations because it is frequently patronozed by Weld County employees, State of Colo- rado employees including the Highway Department and State Patrol. It is our sincere request at this time that we be permitted to ini- tiate a process to bring our total operation into compliance because of our misinterpretation of permitted use. It is not known to us whether or not we should request a variance or proceed through the Planning Com- mission for such a use. We note in the third paragraph of your letter, from which we quote: "It is the intention of this office to assist and cooperate with the resi- dents of Weld County without imposing undue hardships . . .
