Dear Ms. Velasquez:
On Friday, June 21, 2013, the Board of County Commissioners of Weld County received a copy of an e-mail
sent to you on that date from Bart Smith, Publisher of the Greeley Tribune. Mr. Smith's e-mail "requests that
you announce the three original bids that you received for legal advertising, and to award that bid using the
criteria in your request for bid documents." His e-mail was in response to an e-mail you sent earlier that
afternoon to the Greeley Tribune, the Windsor Beacon, and the Fort Lupton Press, announcing that you were
rejecting all bids, and that you intend to "issue a new solicitation with revised specifications."
C.R.S. § 38-37-104(8) states the following:
(8) Each public trustee who is appointed by the governor shall be subject to the state "Procurement Code",
articles 101 to 112 of title 24, C.R.S., for any purchase of twenty thousand dollars or more and for any
multiple year purchase agreement; except that, if the procurement rules established for the county in
which the public trustee serves require an open and competitive bidding process, the public trustee
may apply the county procurement rules.
Enclosed is a copy of Article 4, Chapter 5 of the Weld County Code, regarding Purchasing Policy. As you
have decided to reject all bids and "issue a new solicitation," if you choose to "apply the county procurement
rules," the Board will require that you submit your request for proposal to the County's Purchasing
Department. The proper "application of the county procurement rules" requires following all of the rules set
forth in the enclosed Purchasing Policy, including choosing the low bidder unless there are stated reasons not
to do so. Additionally, the decision as to which bid is accepted will be made by the Board of County
Commissioners.
