RE: APPROVE VACATION OF RECORDED EXEMPTION, RE -2973 - SWINK FAMILY
FARMS, LLLP / SWINK FAMILY FARMS, LTD. / ENCANA OIL AND GAS (USA) INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on December 26, 2000, Planning Services staff administratively approved
the application of Swink Family Farms, Ltd., for Recorded Exemption, RE -2973, for the creation of
two parcels equaling 77.5 acres and 2.5 acres, more or less, and
WHEREAS, said property is located in part of the W1/2 SE1/4 of Section 21, Township 1
North, Range 68 West of the 6th P.M., Weld County, Colorado, being more particularly described
as Lots A and B of Recorded Exemption, RE -2973, and
WHEREAS, the Board has received a letter, dated October 4, 2013, from the current
property owners, Swink Family Farms, LLLP, and Swink Family Farms, Ltd., authorizing Encana
Oil and Gas (USA) Inc., c/o Baseline Corporation, 710 11th Avenue, Suite 105, Greeley, Colorado
80631, to vacate said Recorded Exemption, RE -2973, which was recorded on August 5, 2004,
Reception #3206278, in the records of the Weld County Clerk and Recorder, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of the
Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Recorded Exemption, RE -2973, be, and hereby is, vacated.

SUBJECT: Request to vacate Recorded Exemption No. RE -2973
located in the W2 SE4 of Section 21, Township 1 North,
Range 68 West of the 6th P.M., Weld County Colorado
On August 5, 2004 Recorded Exemption No. 1467-21-4 RE -2973 was recorded via Reception
number 3206278 creating two parcels of land, (Lot A) being 2.5 acres and (Lot B) being 77.5
acres, more or less.
Terry Swink, General Partner for Swink Family Farms LLLP and Swink Family Farms Limited
being current property owners of land described as Lot A and Lot B of Recorded Exemption
number RE -2973 are requesting that this Recorded Exemption be vacated.
The planning staff requests that the Board of County Commissioners accept this request and
vacate RE -2973.

Baseline Corporation is representing Encana Oil & Gas (USA) Inc. to process an application for the vacation
of a Recorded Exemption. This application proposes to vacate the plat identified in RE2973 in order to
further establish a plat for the Encana Oil & Gas (USA) Inc. Liquids Handling Hub. The RE is currently all of
parcels 146721400001 and 146721400002.
Several reasons support the request to vacate RE#2973:
• The RE was not created per county standards.
• Lot B, as identified on the plat, was not surveyed.
• The legal description of this parcel is neither complete nor surveyed.
• The RE does not show the platted ROW of the Community Ditch (Book 63, Page 464).
• The owners of the Community Ditch were not signatories on the plat.
