A Use by Special Review permit for RV and boat storage.
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
CR 15 is a collector road and requires an 80 -foot right-of-way at full build out. There is presently a 60 -foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
The applicant will utilize the existing access. No additional accesses will be granted. Show the approved
access on the plat and label with the approved access permit number (will be provided).
Please label the turning radiuses into the site. A minimum of 45 foot radiuses are required to allow trucks
or RVs with trailers to turn.
The gate must be set back 75 feet from future right-of-way to allow a truck or RV and trailer to pull
completely off of the roadway and open the gate.
The provided calculations for the Water Quality Area are acceptable. The Water Quality Area shown on
the plat is acceptable.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
REQUIREMENTS:
1. Show the approved access on the plat and label with the approved access permit number (will be
provided).
2. Label the turning radiuses into the site. A minimum of 45 foot radiuses are required to allow
trucks or RVs with trailers to turn.
3. The gate must be set back 75 feet from future right-of-way to allow a truck or RV and trailer to pull
completely off of the roadway and open the gate after the future road widening..
4. Add the following notes to the plat:
a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All
vegetation, other than grasses, needs to be maintained at a maximum height of 12
inches until the area is completely developed.
b. The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent

property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.
c. Weld County is not responsible for the maintenance of drainage related features.

Environmental Health Services has reviewed this proposal for outside recreational
vehicle storage in the A (agricultural) zone district. The application indicates there will
be one part time employee and no dump station or buildings will be constructed. There
will be 50 to 75 storage spaces.
As this is a full time business, permanent drinking water and sewage disposal facilities
are required if the number of customers exceeds 10 per day as indicated in Policy
2.2.K.
Policy 2.2.K Use of portable toilets and bottled water (revised 5/8/12)
Purpose: To define when portable toilets and commercially bottled water are
allowed.
Policy: Bottled water from a commercial source is allowed in the following
circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive
hours a day
Policy: Portable toilets are allowed in the following circumstances:

and/or one of the following:

Note: Records of maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County and shall contain hand sanitizers.
The dust abatement plan indicates the access drive and parking spaces will be
graveled. A sign will indicate a maximum speed of 5 mph and a water truck will be
utilized if necessary.
The waste handling plan indicates there will be a trash dumpster on site that will be
serviced by Gallegos Sanitation Inc.
We have no objections to the proposal; however, we recommend that the following
requirements be incorporated into the permit as development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The applicant shall operate in accordance with the
approved "waste handling plan", at all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.

6. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility. If the facility does not exceed 10
customers or visitors per day and 4 part time (20 hour week) employees, portable
toilets and bottled water are acceptable. Records of maintenance and proper
disposal for portable toilets shall be retained on a quarterly basis and available
for review by the Weld County Department of Public Health and Environment.

7. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or
change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove,
convert or replace any electrical, gas, mechanical or plumbing system, or to cause any such work to be
done, shall first make application to the building official and Weld County to obtain the required permit.

Subject: USR12-0063 — Murdoff Holdings LLC
Dear Ms. Aungst:
The Town of Windsor Planning Commission reviewed this referral at its regular meeting on October 17, 2012. The
subject property is located inside the Town's Growth Management Area (GMA) and is depicted as Single Family
Residential on Windsor's Land Use Plan Map. The Windsor Comprehensive Plan states that the Single -Family
Residential land use depiction provides for "...single-family detached homes at medium to medium -high densities at
densities of two to six dwelling units per acre." This application proposes outside recreational storage of boats,
campers and utility trailers on an existing 2.2 acre property. The proposed use is inconsistent with the Town's land use
depiction and with the adjacent land uses.
The subject property is located within the Town's Growth Management Area (GMA) and is directly east of the Town of
Windsor 15th Street Park Site Annexation. On October 8, 2012 the Windsor Town Board approved on Second Reading
Ordinance No. 2012-1437, which includes the 27.75 -acre triangular property on the west side of WCR 15 as well as the
full -width of the right-of-way from the intersection of Great Western Railway north for approximately 1,475 feet. The
Town of Windsor Comprehensive Plan states, "the GMA is intended to define those specific areas within the planning
area where it is most logical to extend urban services in the near term, that is, within the next five to ten years." The
Town of Windsor's Engineering Department has commented that due to the fact that the WCR 15 right-of-way has
now been completely annexed into Windsor, the applicant will need to comply with all access requirements of the
Town's Municipal Code since the use of the property is changing.
Therefore, based on the aforementioned information, the Town of Windsor Planning Commission recommends that
Weld County deny the proposed USR and refer the applicants to the Town of Windsor for annexation.

Dear Ms. Aungst:
I have reviewed the plans for the above referenced project. The plans arc not acceptable to the Windsor - Severance Firc
Rescue. The following comments will need to be addressed prior to issuance of a permit:.
I. The requirements of the Firc Code, Building Code (with regards to fire and life safety issues), and NFPA
standards currently adopted at the time of building construction will have to be met.
2. Hydrant placement shall meet the following criteria with distances measured by vehicular travel path:
Commercial - 400' from all points of structure, plans did not show any fire hydrants near this property.
The minimum fire flow and flow duration for buildings other than one and two family dwellings shall be as
specified in the adopted fire code.
4. The maximum dead-end length for a drive aisle is 150 -feet.
A Knox Box will be required at your gates to allow for fire department access at all times in case of an
emergency.
6. Turning radius shall meet the B40 turning template.
7. All access roads must have at least 12 inches of all weather road base that can be maintained year around.
8. The maximum distance from an approved fire lane to any point of the structure is 150 -feet.
9. Inspections shall be scheduled at least 48 hours in advance by calling the Windsor -Severance Fire Rescue at
