Garcia, Chair Commissioner Douglas Rademacher, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Bob Choate Planning Department representative, Kim Ogle Public Works representative, Jennifer Petrik Health Department representative, Mary Evett The following business was transacted: ta I hereby certify that pursuant to a notice dated June 14, 2013, and duly published June 19, 2013, in the Greeley Tribune, a public hearing was conducted to consider the request of Kerr-McGee Gathering, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0028, for a Mineral Resource Development, Oil and Gas Support and Service, including oil and gas processing facilities and related equipment, including, but not limited to, eight (8) compressors associated with gas processing or which compress gas to enter a pipeline for transport to market, and one (1) seventy-foot in height communications tower in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. El Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He said the site is in proximity to Fort Lupton, Firestone and Frederick, reviewed surrounding land use, and displayed photographs. el Jennifer Petrik, Department of Public Works, provided a brief overview of the transportation plans and requirements. She said the site is unmanned, with 30-40 personnel Ct; ei t, Fwe HI- x'/20 2013-1942 PL2232 HEARING CERTIFICATION - KERR-MCGEE GATHERING, LLC (USR13-0028) PAGE 2 per day during construction only and noted that the applicant has requested an early release of grading permit. 02 Mary Evett, Department of Public Health and Environment, reviewed the water and sewer provisions, and Waste Management Plan. She said coolants and oils will be collected and recycled, she noted Development Standard #10 regarding noise abatement may be deleted, as it is covered under #16. In response to Commissioner Conway, she clarified that Non -specified Zone noise limits are equivalent to the Agricultural Zone. Ms. Petrik suggested modifying Development Standard #22 to end at the word "site." Pa Nathan Smith, applicant, thanked Planning staff and presented a slideshow of the project. He gave a brief history of the site and reviewed the noise abatement plan. He said the compressor station will have feeds from other facilities and a new pipeline and then be piped underground to the Lancaster Facility. He showed the site plan. El No public testimony was offered concerning this matter. e Commissioner Kirkmeyer asked about Condition of Approval #1.B, and Ms. Petrik recommended deletion due to the early release of grading permit; done by assent of the Board. Commissioner Kirkmeyer suggested adding in a new Condition of Approval #3, stating "Prior to operation the applicant shall develop an Emergency Operations and Safety Plan with the Office of Emergency Management and the Fort Lupton Fire Protection District." Commissioner Kirkmeyer addressed Development Standard #6, and Ms. Petrik explained they will have used oil and coolants, and, although under the Colorado Oil and Gas Conservation Commission rules waste handling is already addressed, the Board decided to retain #6 in order to have a record of the plan. By assent of the Board the last sentence of Development Standard #7 regarding the Dust Abatement Plan was stricken. Commissioner Rademacher recommended keeping the first sentence for construction; done by consent of the Board. The clerk's attention was directed to a typo in Development Standard #9; Development Standard #10 was deleted and on #20 Mr. Ogle confirmed this is part of the building permit application process. Finally, Development Standard #22 was amended by assent of the Board to end after the word "site." In response to Chair Garcia, Mr. Smith said he and the applicant have reviewed and agree to abide by, the Conditions of Approval and Development Standards, as amended. Commissioner Conway moved to approve the request of Kerr-McGee Gathering, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0028, for a Mineral Resource Development, Oil and Gas Support and Service, including oil and gas processing facilities and related equipment, including, but not limited to, eight (8) compressors associated with gas processing or which compress gas to enter a pipeline for transport to market, and one (1) seventy-foot in height communications tower in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Rademacher, and it carried unanimously. Commissioner Kirkmeyer reminded the applicant that noise attenuation plans must be in place and levels 2013-1942 PL2232 HEARING CERTIFICATION - KERR-MCGEE GATHERING, LLC (USR13-0028) PAGE 3 remain below 50-55 decibels. There being no further discussion, the hearing was completed at 11:20 a.m. This Certification was approved on the 5th day of August, 2013.
