RE: APPROVAL OF LOT SIZE VARIANCE NO. 98 - ELECTA ISAKSON
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined
at a public hearing held on the 22nd day of August, 1979, in the
Chambers of the Board of County Commissioners of Weld County,
Colorado, that a certain tract of land is owned by Electa Isakson,
which land is more particularly described as follows:
Part of the East Half of the West Half of
Section 28 , Township 6 North, Range 64 West
of the 6th P.M. , Weld County, Colorado
WHEREAS, the owner of said tract of land desires to obtain
a variance from the minimum lot size requirement so that said
applicant may make application to the Board of County Commissioners
for a recorded exemption, as set forth in Section 9-4 .A. (6) of
the Subdivision Regulations, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado feels that the applicant has shown good cause for
granting a lot size variance under Section 9-4 .A. (6) of the Weld
County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that a variance from lot size
requirements be, and hereby is, granted to Electa Isakson for the
abovedescribed parcel of land.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 22nd day of
August, A.D. , 1979.

RE : Lot Size Variance #98
Dear Commissioners :
The attached letter and related materials are in reference to a
request for a lot size variance from Mrs. Electa Isakson . The
parcel of land is described as Pt . EZWZ Section 28, T6N, R64W of
the 6th P.M. , Weld County, Colorado. This property is located
1/2 mile west of the Town of Gill . The property contains approxi-
mately 73. 8 acres of Class IV irrigated soils. The request is to
obtain a variance from the minimum lot size requirement , Section
9-4A(6) so that Mrs. Isakson may make application for a recorded
exemption.
If this lot size variance is granted, Mrs . Isakson will proceed
with an application for a recorded exemption to divide the property
into two parcels . Mrs. Isakson ' s daughter and son-in-law who are
presently farming the property wish to build a residence on the
smaller parcel . They will continue to operate the agricultural
operation on the larger parcel . The larger parcel presently con-
tains the residence of Mrs. Electa Isakson.
Based upon the information submitted and the adopted policies in
the County, the Department of Planning Services Staff recommends
the request be approved for the following reasons :
1. The proposed split conforms with Section 9-2 of the Weld County
Subdivision Regulations ( intent clause of the recorded exemp-
tion procedure) , Section 3. 3 A. of the Weld County Zoning
Resolution (intent clause of the Agricultural Zone District ) ,
and the Weld County Comprehensive Plan in that the use will be
compatible with surrounding agricultural uses. The request
will allow agricultural and related uses to be the predominant
land use. There will be no reduction in the amount of land
currently being used for agricultural production.

2. This request complies with the provisions of Section 9-4 A. (6)
of the Weld County Subdivision Regulations because in the
opinion of the Department of Planning Services Staff , the
applicant has shown good cause for the variance.

Mrs. Tsakson's attorney, Mr. R'1ph Waldo, has suggested. that a small
Parcel of land be split from the entire !arm so we would not pay inheritance
to re-- on our own house.
?. The present house was built by Nils A. T >aknon (my wife'>-. grandfather)
in 1Q11 and is not large enough for m-r family with five children. Mrs.
isakson e0nnot afford, to move to town on her limited i.nnome and is
de'iendent on us for. transp:orta.ti.nn i.e. she dots not drive. She has a heart
oondi t1 on and diabetes .so we feel it would be better if we 1 i ved closer
to her. She prefers to remain in her present home but does not like to be
alone on the fcl.rm as mush as she i.s since my father-in-law passed away
in 1.977. They lived on this farm most of their married 111'e. She also
likes to bP near. her. �ra.ndnhildren.

sincere desire to keep the entire farm An our family.

7. T was born and raised i.n this area of Weld County and have a great deal

COMMENTS:
Parcel is primarily irrigated corn, hay and potatoes. The improvements
parcel is dryland and is cut off from the remainder of the property by
an irrigation ditch. There is presently one residence and several barns
or outbuildings on the dryland parcel. Parcel skirts an old reservoir
to the south. Access is existing to Weld County Road 66 (gravel surface)
from a small lane about 1/8 mile long.
