RESOLUTION
WHEREAS, it has been determined by the Board of County Com-
missioners, Weld County, Colorado, that Joe Seewald, Longmont, Colorado,
is the owner of approximately 61 . 8 acres of irrigated land in Weld County,
Colorado, located in a portion of the North Half of the Southwest Quarter of
Section 31, Township 3 North, Range 68 West of the 6th P. M. , and
WHEREAS, Mr. Seewald is desirous of splitting off a parcel of
1 . 14 acres, more or less, in order to convey same to his married daughter,
Marsha Willis, for residential purposes, and keeping the balance of 60. 65
acres unto himself, and
WHEREAS, it appears that a lot size variance first must be obtained
before applicant may apply for a recorded exemption from the subdivision
regulations of Weld County, as the same is defined in Section 9-4 of the Weld
County Subdivision Regulations, and
WHEREAS, in addition to evidence presented by Mr. Seewald, the
Weld County Planning Commission Staff has presented evidence and made
representations concerning the desirability of granting said variance, and
WHEREAS, the Board of County Commissioners feels that when all
the evidence and representations are considered, good cause for granting a
variance as requested from the minimum lot size requirements of the Weld
County Zoning Resolution has been shown.
NOW, THEREFORE, BE IT RESOLVED, that pursuant to the powers
granted to the County under Title 30 C. R. S. 1973 and Section 9-4 A (6), Weld
County Subdivision Regulations as amended; that Joe Seewald may proceed to
apply for a recorded exemption and the lot size variance is conditioned on
Mr. Sewwald's applying for and doing all necessary to obtain said recorded
exemption within one year, and said variance is limited to Mr. Seewald, and
will terminate if he sells or otherwise discontinues his interest in the above
mentioned land prior to obtaining approval for and recording the above
mentioned recorded exemption.

Re: Lot Size Variance Request
Dear Commissioners:
The attached materials are in reference to a request, by Joe Seewald,
for a lot size variance on a parcel of land described as part of
the N2 of the SWa of Section 31 , T3N, R68W of the 6th P.M. , Weld County,
Colorado. Said parcel is located 1, miles north and 4 miles west of
Del Camino on the western fringe of Union Reservoir to the east of
County Line Road, The subject property contains approximately 61 .8 irrigated
acres. The request is to split the property into parcels of 1 .148 acres
and 60.65 acres. The 60.65 acre parcel has existing improvements which
is Mr, Seewald's residence. The 1 .148 acre parcel has no existing
improvements, but if this lot size variance and a subsequent recorded
exemption were to be approved, for residential purposes by Mr. Seewald ' s
second daughter, Marsha Willis. Soils in this area are Class II
(Agricultural Capability Classification) . Mr. Seewald applied for
and was granted a Recorded Exemption (RE-106) on January 30, 1974.
That request was to provide a residential lot for Mr. Seewald's first
daughter. Prior to that split, Mr. Seewald transferred a small parcel
in January of 1972 to Mr. Anderson.
Based upon the information submitted, the Planning staff recommends
for denial for the following reasons:
1 . The proposed split does not comply with the Weld County
Comprehensive Plan because it would promote non-agri-
cultural use of agricultural land and it would encourage
urban encroachment on rural land use.

2. The lot size variance request is not in compliance with
the intent clause of the recorded exemption procedure
(Section 9-2 of the Weld County Subdivision Regulations).
Said clause states'.
"The intent in establishing the Recorded Exemption
procedure is to provide, in accordance with the Weld
County Comprehensive Plan, a means whereby non-pro-
ductive agricultural lands may be developed for
higher or more productive uses, in-so-far as
such uses are compatible with surrounding agricul -
tural uses in areas where such land divisions are
proposed. (Rev. 4/17/74)"
Soils in this area are Class II. The granting of this request
and a subsequent recorded exemption would allow for the con-
version of productive agricultural lands since a new set of
improvements would be allowed on the 1 .148 acre parcel .
3. The proposed split is not in conformance with the intent clause
of the Agricultural Zone District (Section 3.3 A of the Weld
County Zoning Resolution) which states:
"Intent - The intent in establishing the A-I Agri-
cultural Zone District is to allow all agricultural
and related uses in those areas in which agriculture
is and should continue to be the predominant land
use. This district is intended to discourage
agricultural uses as the highest and best use of the
land in the district as compared with other uses in
conflict therewith, and to provide for the orderly
expansion of urban growth in conformance with the
Weld County Comprehensive Plan. "
The request would not be encouraging agricultural uses as the
highest and best uses, it would not be providing for the orderly
expansion of urban growth, and it would further diminish the
size of the agricultural unit.
4. As stated earlier, Mr. Seewald was granted a Recorded Exemption on
January 30, 1974. And now, only a little more than two years
later, Mr. Seewald is requesting to further split the property.
As stated in Section 9-4 (A) of the Weld County Subdivision Regulations:
"The Board shall not approve the exemption of the pro-
posed land division unless it finds the following:

(1 ) That the proposed lots are not part of
a recorded exemption from the definition
of "Subdivision" or "subdivided land"
or a subdivision approved within less
than five (5) years previous" .
Section 9-4 (A) (3) of the Weld County Subdivision Regulations states:
"That the lots resulting from the proposed land division shall
be accessible from an existing public road with a minimum
frontage in conformance with the Weld County Zoning Resolution;"
The required road frontage in the Agricultural District is 180 feet as set
forth in Section 3.14 of the Weld County Zoning Resolution. Mr. Seewald 's
request as presented would have only 30 feet of road frontage. Therefore,
if this lot size variance is approved by the Board then Mr. Seewald should
obtain approval from the Board of Adjustments for a variance of 150 feet
from the 180 feet road frontage requirement prior to approval of a recorded
exemption on the subject parcel .
