RE: APPROVAL OF RECORDED EXEMPTION NO. 429 - MR. AND MRS. LYLE
AULT, ET AL.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 26th day of November, 1979 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of land, as shown on the plat known as Recorded
Exemption No. 429 , being the property of Mr. and Mrs . Lyle Ault,
et al. , described as Part of the Northwest Quarter of Section 24 ,
Township 5 North, Range 66 West of the 6th P.M. , Weld County,
Colorado, being more particularly described as follows :
Part of the Northwest Quarter of Section 24,
Township 5 North, Range 66 West of the 6th
P.M. , Weld County, Colorado, being more parti-
cularly described as follows :
Beginning at the West Quarter Corner of said
Section 24 and considering the West line of
the Northwest Quarter of said Section 24 as
bearing North 00°59 ' 40" West, with all other
bearings contained herein relative thereto;
Thence North 00°59 ' 40" West, along said West
line, (North, recorded) , 247 . 00 feet;
Thence North 89°00 ' 20" East, 348 . 20 feet;
Thence South 00°59 '40" East, 117 .60 feet;
Thence North 89°26 ' 01" East, 311. 80 feet,
(Easterly Recorded) ;
Thence South 00°59 ' 40" East, 132.00 feet to a
point on the South line of the Northwest Quar-
ter of said Section 24 , (South, Recorded) ;
Thence South 89°26 ' 01" West, (Westerly Recorded) ,
660. 00 feet to the West Quarter Corner of said
Section 24 , also being the Point of Beginning.
Said described parcel of land contains 2 .930
acres, more or less, and is subject to any
rights-of-way or other easements as granted
or reserved by instruments of record or as
now existing on said described parcel of land.

under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within

the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended,
and Section 2-lA(3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Mr. and Mrs. Lyle Ault, et al. , be, and
hereby is, exempt from the definition of the terms "subdivision"
and "subdivided land" pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 26th day of
November, A.D. , 1979.

RE : Recorded Exemption #429
Dear Commissioners :
The attached application, plat, and related items are in reference to
a request from Mr. and Mrs. Lyle Ault, et al, for a recorded exemp-
tion. The parcel of land on which this request has been made is des-
cribed as Pt. NW% Section 24, T5N, R66W of the 6th P.M. , Weld County,
Colorado. This property is located approximately 1/2 mile south of
U.S . Highway 34 Bypass at 3234 35th Avenue, Greeley, Colorado . The
property contains approximately 2. 930 acres of Estate Zoned property.
The request is to split the property into parcels of 0. 930 acres and
2. 000 acres.
Mr. and Mrs. Ault have sold the 0. 930 acre parcel to Mr. Dwayne Else
subsequent to the adoption of the current subdivision regulations.
The proposed Lot B has the Aults ' residence located on it. The pro-
posed Lot A has no improvements .
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons :
1. The request conforms with the recorded exemption and intent clause
of the Weld County Comprehensive Plan. The City of Greeley Com-
prehensive Plan Future Land Use Map identifies the property under
consideration as low and minimum density residential uses. The
proposed use on the property will be compatible with surrounding
land uses .

2. The 2. 930 acre parcel is located in a strip of residential lots
along the east side of 35th Avenue which has low utility for
agricultural use due to the size of the existing parcels and the
intent for residential development which the County Estate Zone
allows .
3 . The Greeley Planning Commission has set forth no objections to
this request.
4. The request complies with the provisions of Section 9-4 A. of
the Weld County Subdivision Regulations.
