RESOLUTION RE: APPROVE INTERGOVERNMENTAL AGREEMENT FOR PROVISION OF MUTUAL AID DURING DISASTER EMERGENCIES AND AUTHORIZE CHAIR TO SIGN - MESA COUNTY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Intergovernmental Agreement for Provision of Mutual Aid During Disaster Emergencies between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and Mesa County, with terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Intergovernmental Agreement for Provision of Mutual Aid During Disaster Emergencies between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and Mesa County be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. Conway Freeman arbara Kirkmey CC OAF! , PW, G6', °Ewl, Ace/4- (b (ate 2013-2886 BC0045 MCA INTERGOVERNMENTAL AGREEMENT BETWEEN MESA COUNTY, COLORADO AND WELD COUNTY, COLORADO Gi THIS INTERGOVERNMENTAL AGREEMENT (Agreement) is made this // day of Sher , 2013 by and between Mesa County and Weld County, political subdivisions and local governments of the State of Colorado, pursuant to the authority granted by §29-1-203, C.R.S. (2013). WHEREAS, due to the devastating floods that occurred in September, 2013, Weld County has endured extreme transportation infrastructure damage. Weld County has requested help from other Colorado Counties to assist in the clean-up; and WHEREAS, Mesa County is willing to send equipment and operators to Weld County for a two week period to assist Weld County, as hereafter detailed; IN CONSIDERATION of the premises and promises stated hereafter, it is agreed as follows: 1. The two week period shall commence on October 14, 2013 and end on October 25, 2013. 2. Mesa County will track all expenses and operation time during this period. Mesa County will submit actual expenses to Weld County at the end of the two week period. The parties are anticipating that Weld County will be working with the State of Colorado and FEMA for reimbursement. Mesa County will allow Weld County up to a year from the date of submittal to pay back any expenses under this Agreement. 3. Weld County will reimburse Mesa County for all expenses incurred by Mesa County during the time period while assisting Weld County. Anticipated Expenses, without limitation, are expected to be as follows: Per Diem 3 Equipment Operators 2 and 1 Equipment Operator 3 X $61.00 X 10 Days = $2,440.00 Hotel Rooms 4 Operators X 10 Nights X $100 a Night = $4,000.00 (Or Weld County can provide appropriate accommodation) 4 Trucks: Weld County will reimburse for fuel to travel to location and return and will provide fuel once on location. Approximate cost of fuel to travel to location and return = $2,000.00 1 Operator (3) for 10 days wages & benefits (approximate) = $2,349.00 3 Operator (2) for 10 days wages & benefits (approximate) = $6,525.00 The above wage and benefit amounts do not include overtime. If overtime is requested by Weld County, Weld County will reimburse Mesa County for this expense. 4. Mesa County will not charge Weld County for the use of Mesa County's equipment. However, Mesa County will track costs for use of the equipment and submit those costs to Weld County. If Weld County is able to receive reimbursement for equipment use, Weld County will reimburse to Mesa County for Mesa County's portion of the reimbursement. 5. All work by Mesa County employees and equipment will be directed by the on -site Mesa County Supervisor. Weld County on -site supervisory personnel will give instructions and/or directions to. the Mesa County Supervisor who will coordinate with Weld County, all in accordance with Weld County prepared and/or provided designs and/or plans. In the event of a disagreement between the Mesa County on -site Supervisor and the Weld County on -site supervisory personnel regarding instructions and/or directions, both will cease work and seek direction from their respective chains -of -command. 6. Workers' Compensation coverage of any Mesa County employee performing temporary services in or for Weld County pursuant to this agreement shall be the responsibility of Mesa County as if the employee was performing regular duties within Mesa County. 7. Any liability that accrues to Mesa County as the result of any act, including a negligent or otherwise tortuous act, of any Mesa County employee while performing temporary services pursuant to this Agreement shall be the responsibility of Weld County. Weld County shall indemnify, defend, and hold harmless Mesa County, its officials, officers, employees, agents, and volunteers from any costs or damages, including attorneys' fees and/or litigation costs, arising out of the performance of Mesa County and/or its employees pursuant to this Agreement, without regard to any negligent or tortuous nature of said performance. Weld County hereby waives governmental immunity as between Weld County and Mesa County regarding the performance of Mesa County and/or its employees pursuant to this Agreement. 8. This Agreement is subject to the laws of the State of Colorado and venue for any dispute hereunder shalt be in the District Court of the County of Mesa, Colorado.
