Purpose : Acquire adequate setbacks . Method : Review local regulatory agencies of municipalities and counties in the Front Runge Urban t{rowl.h Corridor • and Fire Code Regulations. Hata : five municipalities , four r•onnl. iL5 , ❑ nrl Iwu fire departments , alt located in the general region around Weld County , were conLaeted along with the Chief Inspector of the Weld County • Building Inspectio❑ Department . From contacts it was discovered that different jurisdictions are not consistent with their regulations of mobile home setbacks . Also, most jurisdiction ; were unfamiliar with the basis for setbacks although fire safety was assumed . { Fire codes reviewed showed 10 feet as a minimum distance between mobile homes . The County ' s Building Code , which references the Uniform Fire Code , allows a minimum of 3 feet between units . Summary of bindings : Upon evaluating the variety or regulations , Lh -- - median level of setback configurations were 10 feet when end to end and 15 to 20 feet when side by side . The side by side clearance { exceeds the minimum fire codes, however, offic. 1 from the fire districts felt the 15 foot 1 clearance was a valid distance for safety . 1 Recommendations : The proposed setbacks for the Mobile Home District are as follows : 1 . End to end clearance - 10 feet 2 . Side to side clearance - 15 feet 3 . ( 8 ) • • ( 1 ) Larger lot areas may be required by the Weld County Health Department where soil conditions and percolation tests i indicate that leaching fields from a septic tank require additional space . Such percolation tests shall be conducted wherever a lot is not connected to a public sewage system . ( 2 ) When a dwelling is connected to a public sewage system and to a public water system . ( 3 ) Due to varying requirements , minimum standards shall be established for each use by the Weld County Health Department. (4 ) The minimum setbacks in the Agricultural District are as follows : a . For all areas other than subdivisions or unincor- porated towns platted and recorded prior to December 26 , 1973 , the minimum setbacks are : 1 . Minimum frontyard setback : 50 feet 2 . Minimum side and rear yard setbacks : 3 feet b . For all subdivisions or unincorporated towns platted and recorded prior to December 26 , 1973 , the minimum set- backs are : Minimum frontyard setback : 20 Minimum side yard setback : 5 Minimum rear yard setback : 10 ( 5 ) The front yard setback shall be measured from the adjacent edge of the right-of-way line of the abutting public road . If the abutting public road is not designated to be upgraded to a higher classification as defined by the Weld County Thoroughfare Plan , the front yard setback shall be measured from the existing right-of-way line of the public road . If the abutting public road is designated to be upgraded to a higher classification as defined by the Weld County Thorough- fare Plan necessitating additional right-of-way , then the setback shall be measured from the future right-of-way line . The future right-of-way line is determined by adding the . distance of the additional needed right-of-way to the existing right-of-way line . The following is a list of the right-of-way needed for road designations as defined in the Weld County Thoroughfare Plan : a . Arterial or Rural Arterial - 100 ' Row b. Expressway - 130 ' Row c . Rural Expressway - 200 ' Row d . Freeway - 250 ' Row The future right-of-way line (measured from the centerline of the road ) is determined by dividing the needed right-of-way as defined above in half . ( 9) • ( 6 ) The minimullkide yard along a street on a corner lot shall be the same as the front setback requirement for such zone . ( 7 ) The minimum rear yard shall be measured from the centerline of an alley where an alley abuts the rear lot line . (8 ) Airport - Zone District Map must be checked for further height restrictions . ( 9 ) The side and rear yard setback requirements in Mobile Home Parks shall be based on the distance between mobile home units as follows : a . 10 ' between mobile homes if the units are placed end (width ) to end (width ) . b . 15 ' between mobile homes if the units are placed side ( length ) to side ( length ) . c . 12 . 5 ' between mobile homes if the units are placed side ( length ) to end (width ) . d . For the purpose of this section , the ends (width ) of mobile homes that are greater tban 16 ' in width , such as double wide mobile homes , shall be considered to be sides of the mobile home in measuring distances between mobile home units . e . A mobile home shall have a minimum setback of 5 ' from the perimeter of the mobile home park or from any adjacent property which is not approved to be utilized for a mobile home . f. Accessory buildings and structures on the same lot or space as a mobile home shall have a minimum clearance of 10 ' from any structure or mobile home on any other lot. g . Commonly owned or utilized buildings which are accessory to the park shall have a minimum clearance of 10 ' from any other structure or mobile home . ( 10) The side and rear yard setback requirements in the Mobile Home Subdivisions shall be as follows : a . The side ( length ) of a mobile home shall be placed no less than 7 . 5 feet from any rear or side yard lot line . b . The end (width ) of a mobile home shall be placed no less than 5 feet from any rear or side yard lot line . c . For the purpose of this section , the ends (width ) of mobile homes that are greater than 16 feet in width shall be considered to be sides ( lengths ) of mobile homes for the purpose of measuring setbacks . ( 10 ) • • d . Accessory buildings and structures on the same lot or space as a mobile home shall have a minimum rear and side yard setback from the lot line of 5 feet . e . December 1, 1977 Weld County Planning Commission 915 10th Street Greeley, Colorado 80631 To the Attention of: Mr. Ken Williams Dear Sir: Reference is made to our meeting November 29th, concerning the rules and regulations for mobile home parks. I support the consensus that you change the setback adjustments for the amended rules and regulations from 10 feet in front and 10 feet in back to 5 feet in front and 5 feet in back. The reason is this, in many of our lots which are ample in width, they are short in length. We would have great difficulty in meeting this regulation and could not accept any mobile home longer than a 14 X 65. The most popular size in mobile homes, today, is 14 X 70. May I remind you that none of our existing lots are back to back, which gives the tenant more privacy and avoids congestion. To reduce the size of a mobile home we could accept would put a great burden on our business and limit us to a very restricted income. We have many 14 X 70 movile homes in our park at this time with a five foot space in front and in back and a widkr of approximately 40 feet between the mobile homes. I cannot see any safety hazard or a detrement to living conditions with these changes. I would also like to indicate a complaint in reference to the inspection fee. I believe it to be excessive and unreal. It will work a hardship on many people that choose or by occupation live in a mobile home. I would like to itemize a few of the costs entailed in moving a mobile home to any park. At an average cost of $1.00 per mile, plus an average fee of $75.00 hookup fee, plus the other costs, such as a months rent, damage deposit and deposit on gas and electricity service, then add the $45.00 inspection fee and you have a total of about $300.00sto move just a few miles, say from Greeley to our park at the south end of the county. This works a hardship on a working man's income. I have called other mobile home parks in the area and in three different counties, find the fees average $20.00 with the City of Thornton charging $25.00 for a complete inspection. My suggestion to this fee be set at $25.00 for a complete inspection with two trips allowed. I realize that immediate inspection as to lights and gas with the proper setbacks would take an immediate trip by an inspector. I would also recommend a person have at least four (4) weeks to complete skirting, which gives a working person adequate time and an extra payperiod to complete it. This final inspection would be done at the convenience of the inspector and not a mandatory trip. Rarely do we have anyone move into our park that can stand the expense of moving, plus block- ing and skirting expense without a little time to recuperate his income. Page -2- 1 • We are competing with parks in Adams County, and feel that the excessive inspection charges proposed by Weld County would work an unusual hardship on us. A number of times, the excessive charges are the determining fact r, whether or not a space is rented. I believe the establi^hed fee that we have been working under and the way it is implemented is sufficient. I believe that the ruling con- cerning the extra trip an inspector makes because the mobile home is not ready for inspection, is fair. I want you to know that I am concerned with your problems and I hope you are concerned with ours.
