RE: APPROVE LOCAL AGENCY ASSURANCE AGREEMENT WITH THE COLORADO
DEPARTMENT OF TRANSPORTATION UNDER TITLE VI OF THE 1964 CIVIL
RIGHTS ACT AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Colorado Department of Transportation (CDOT) and Weld County, as
recipients of federal transportation related funds, are legally required to comply with 1964 Civil
Rights Act, 42 U.S.C. 2000d, et seq., and
WHEREAS, CDOT requires local agencies, including Weld County, to provide written
assurance of compliance with Title VI.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, hereby approves the Local Agency Assurance Agreement, as attached
hereto and fully incorporated herein, and
BE IT FURTHER RESOLVED by the Board that the Chair is authorized to sign said
agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 29th day of May, A.D., 2013.

Title VI
Local Agency Assurance Agreement
Acting as the "Local Agency," Weld County, Colorado, by and through the Board of County
Commissioners of Weld County ("Weld County"), hereby agrees and provides the following
assurances that:
1. No person shall on the grounds of race, color, national origin, sex, age, and disability, be
excluded from participation in, denied the benefits of, or be otherwise subject to
discrimination under any program or activity conducted by Weld County, regardless of
whether those programs and activities are Federally funded or not. Weld County hereby
agrees to carry out this assurance in compliance with Title VI of the 1964 Civil Rights
Act, 42 U.S.C. 2000d, et seq. ("the Act"), and related amending or implementing statutes,
and applicable regulations ("the Regulations") (all of which are cited and referred to on
page 7 of the Colorado Department of Transportation Title VI Assessment &
Implementation Plan 2011-2012), in all of Weld County's programs and activities.
2. Weld County shall promptly take any measures necessary to effectuate this Agreement.
3. Each Weld County program, activity, and facility shall be conducted and/or operated in
compliance with nondiscriminatory requirements under all Federal laws and regulations.
4. These assurances are given in consideration of and for the purpose of obtaining Federal
grants, loans, contracts, property, discounts or other Federal financial assistance. These
assurances are binding on Weld County, its recipients, sub -grantees, contractors,
subcontractors, transferees, successors in interest, and other participants.
5. Weld County, will insert a notification in all solicitations for bids for work or material
subject to the Regulations that notifies all bidders that it will affirmatively ensure that
disadvantaged business enterprises will be afforded full opportunity to submit bids in
response to all invitations and will not be discriminated against on the grounds of race,
color, national origin, sex, age, or disability in consideration for an award. Weld County
will also adapt this notification for all proposals for negotiated agreements.

6. Weld County will insert appropriate nondiscrimination clauses in every contract subject to
Title VI and the Regulations.
7. Weld County will document and display information on Weld County's nondiscrimination
obligations and an explanation of how to file a Title VI complaint, in addition will post
contact Weld County Title VI Coordinator, including the person's telephone number, fax
number, and agency's mailing address. Weld County will display a statement stating a
written complaint may be filled no later than 180 calendar days after the date of the
alleged discrimination.
8. Weld County will display Information on non-English alternative formats and how the
non-English alternatives may be obtained from the Weld County. Weld County will
display the Language English Proficiency (LEP) contact personnel's name including the
person's telephone number, fax number, and agency's mailing address.

REFAR INT OF TRANSPORTATION
The Colorado Department of Transportation partners with many local agencies and entities on
various projects for the delivery of goods and services to the traveling public. These projects
often have federal funding and, therefore, must meet certain standards under Title VI of the Civil
Rights Act of 1964 which prohibits discrimination in federally funded programs. In order to
ensure that the local agencies and entities that may receive federal funding through CDOT
programs are well-informed and in compliance, you are receiving this package of information.
As a first step toward compliance, any local agency or entity that may apply for funding through
CDOT must have a signed Title VI Assurance of Nondiscrimination on file with us. Although
you may not have been required to submit an Assurance in the past, CDOT has been instructed
by the United States Department of Transportation that these signed documents must be in place
going forward. This is to ensure that CDOT is providing proper oversight of federal funds.
Enclosed you will fmd a Title VI Assurance Form. Please review this document carefully, sign
and return it to my attention. If you have any questions about this form or your responsibilities
