SUBJECT: USR13-0037, Kenneth Everitt (Water Depot)
The Weld County Public Works Department reviewed the submitted application for critical items,
including but not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical
Soils Report, and Flood Hazard Development Permit. A detailed review of these items was not
completed at this step in the process. Comments made during this stage of the review process
will not be all inclusive; as revised materials are submitted, other concerns or issues may arise.
All issues of concern and critical issues during further review must be resolved with the Public
Works Department.
COMMENTS:
CR 111 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is
presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the
definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured
from the future right-of-way line. There is no current ADT traffic count.
REQUIREMENTS:
Section Line Access: CR 134 (right -of way)
There is 60 feet of unmaintained County right-of-way along the southern border of the site on
CR 134. This will be used as the access from the site to CR 111.
Please show the approved access point on the Plat and label it with the Access Permit number
(will be provided).
A vehicle tracking control pad will be required to prevent tracking of material from your site in
the way of mud or debris on to Weld County Roads. A double cattle guard across both lanes will
need to be installed at the County right-of-way before entering on to CR 111. The approach
roadway (CR 134) from the entrance to the double cattle guard shall have a gravel cross-
section of 12" of Aggregate Base Course and 26 feet in width. This needs to be placed and
shown on the plat drawing across both lanes.
An off -site Road Maintenance Agreement is required for the site. The standard haul route and
triggers for improvements will be a part of the agreement
Contact the Permitting/Inspection agent for Weld County Public Works, at (970) 304-6496, ext.
3764 for a Right -of -Way permit for any work that may be required in the right-of-way on County
roads. A special transport permit will be required for any oversized or overweight vehicles that
may access the site and may also be obtained through the same office.
Traffic:
Traffic to and from the USR site is dependent upon actual water user demand. Projections
suggest some 200 round-trip trucking events per day, spread over a 24 -hour period, or 400 total
trips per day, averaging 17 per hour.
There shall be no parking or staging of trucks or any vehicles on CR 111.

Noxious Weeds:
Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Section 15-1-180 of the Weld County Code.
Flood Hazard Development Standards:
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal
Emergency Management Agency (FEMA).
Grading Permit:
If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to the
start of construction.
Storm Water Drainage:
Condition of approval:
A water quality feature is required.
Notes on the plat:
The historical flow patterns and run-off amounts will be maintained on site.
Weld County is not responsible for the maintenance of drainage related features.

Environmental Health Services has reviewed this proposal for a mineral resource
development facility including an oil and gas support and service facility (water depot) in
the A (Agricultural) zone district. The application states that up to 200 truck loads per
day are anticipated.
The applicant is proposing to use an existing irrigation well (Permit No. 017028f) located
on the property for the water hauling operation. Conversion of the irrigation well to
industrial/commercial use is pending approval by the Colorado Division of Water
Resources.
The applicant is proposing to provide portable toilets for the drivers accessing the site.
The following section is from Environmental Health Services, Weld County Department
of Public Health & Environment, Septic Policies.
2.2.K Use of portable toilets and bottled water (revised 5/8/12)
Purpose: To define when portable toilets and commercially bottled water are
allowed.
Policy: Portable toilets and bottled water from a commercial source are allowed
in the following circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive
hours a day
Note: Records of maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County and shall contain hand sanitizers.
As indicated above, it is the policy of this Department that portable toilets are allowed
when employees or contractors are on site for less than 2 consecutive hours a day. As
personnel will be on site for a short duration, in accordance with Environmental Health
Services policy the use of portable toilets is allowed.
A dust abatement plan was submitted with the 7 -day review application. The access
drive will be graveled, speeds will be limited to 10 mph, and water will be applied when
necessary to control dust on site.
The waste handling plan states that a dumpster will be provided and will be serviced by
Waste Management. The portable toilet will also be serviced by Waste Management.
We have no objections to the proposal; however, we recommend that the following
requirements be met prior to allowing the plat to be recorded:
1. The applicant shall submit written evidence from the Colorado Division of Water
Resources, demonstrating that the well is appropriately permitted for the
proposed use.
We recommend the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions. The applicant shall operate in accordance with
the approved "waste handling plan", at all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.

5. This facility shall adhere to the maximum permissible noise levels allowed in
the Non Specified Zone as delineated in Section 14-9-30 of the Weld County
Code.
6. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. As employees or contractors
are on site for less than 2 consecutive hours a day portable toilets are
acceptable. Records of maintenance and proper disposal for portable toilets
shall be retained on a quarterly basis and available for review by the Weld
County Department of Public Health and Environment. Portable toilets shall be
serviced by a cleaner licensed in Weld County and shall contain hand
sanitizers.
7. The fresh water storage and loading system shall be operated in a manner to
minimize spills. Fresh water spills should be captured in above -ground
containment areas for reuse or allowed to infiltrate. There shall be no discharge
from this process to surface waters or through the facility's stormwater
management system, in accordance with the Rules and Regulations of the
Colorado Water Quality Control Commission, and the Environmental Protection
Agency.
8. The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11,
2011 memorandums to county planning directors, this office will only perform a cursory review
of the referral information and provide informal comments. The comments do not address the
adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy
any County regulations or requirements. In addition, the comments provided herein cannot be
used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or
physical availability of water.
The applicant proposes to operate a water depot for oil and gas support services on an
80 acre parcel. The plan is to convert an existing irrigation well with permit no. 17028-F to a
well permitted for commercial/industrial use. We have not received an application to change the
use of the existing well. Our understanding is that the applicant has applied to water court, in
case no. 13CW3017, to change the water right to uses consistent with the application.
While the case is in water court and before a decree or new well permit have been
issued, we cannot confirm if the proposed water supply will be legally available for use in a
water depot. Should you or the Applicant have any questions regarding this matter, please
