HEARING CERTIFICATION DOCKET NO. 2012-101.A RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR12-0070, FOR MINERAL RESOURCE DEVELOPMENT FACILITIES, INCLUDING OIL AND GAS SUPPORT AND SERVICE (OIL AND GAS PROCESSING FACILITIES AND RELATED EQUIPMENT, INCLUDING, BUT NOT LIMITED TO, FIVE (5) COMPRESSORS ASSOCIATED WITH GAS PROCESSING OR WHICH COMPRESS GAS TO ENTER A PIPELINE FOR TRANSPORT TO MARKET), AND ONE (1) TELECOMMUNICATIONS TOWER UP TO SEVENTY (70) FEET IN HEIGHT IN THE A (AGRICULTURAL) ZONE DISTRICT - WELLS RANCH, LLLP, C/O DCP MIDSTREAM, LP A public hearing was conducted on January 9, 2013, at 10:00 a.m., with the following present: Commissioner William F. Garcia, Chair Commissioner Douglas Rademacher, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Kim Ogle Public Works representative, Heidi Hansen Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated November 16, 2012, and duly published November 21, 2012, in the Greeley Tribune, a public hearing was conducted to consider the request of Wells Ranch, LLLP, do DCP Midstream, LP, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0070, for Mineral Resource Development Facilities, including Oil and Gas Support and Service (oil and gas processing facilities and related equipment, including, but not limited to, five (5) compressors associated with gas processing or which compress gas to enter a pipeline for transport to market) and one (1) Telecommunications Tower up to seventy (70) feet in height in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal, surrounding land uses, and referral responses, and entered the favorable recommendation of the Planning Commission into the record as written. He displayed a vicinity map and photographs of the site and surrounding area. Mr. Ogle requested Development Standard #9 be deleted, since it is covered by Development Standard #26. 2013-0114 PL2197 HEARING CERTIFICATION - WELLS RANCH, LLLP, C/O DCP MIDSTREAM, LP (USR12-0070) PAGE 2 El Heidi Hansen, Department of Public Works, provided a brief overview of the roadway classification, access, grading permit, and water quality area internal to the site. El Lauren Light, Department of Public Health and Environment, stated there will be no permanent employees, and she reviewed the water and sewer provisions, Dust Abatement Plan, Waste Handling Plan, and the possibility for an APEN. Fl Patrick Groom, Attorney with Witwer, Oldenburg, Barry and Johnson, LLP, represented the applicant and stated this application is part of an ongoing project to handle the increase in oil and gas operations and production and enhance the company's internal operations. In response to Commissioner Kirkmeyer, Mr. Ogle confirmed the Subdivision Exemption plat clarifies it is not a separate legal lot and Mr. Groom indicated the tower will be restricted to Noble Energy communications only. He also requested the deletion of Condition of Approval #1.A.4 due to the location of the site and the lack of need for screening. Fl No public testimony was offered concerning this matter. Following discussion, the Board agreed to modify Condition of Approval #1.A.4 to delete the third sentence and delete all of Development Standard #9. In response to Commissioner Rademacher, Mr. Groom stated all of the Fire Marshalls in the area concurred that the subject site is within the Galeton Fire Protection District and the Board agreed to modify Development Standard #20 to add the words, "if appropriate." He also confirmed 120 days will be sufficient to complete the requirements and record the plat. Mr. Ogle requested Development Standard #18 be updated to reflect adoption of the 2012 International Building Code (IBC), International Mechanical Code (IMC), International Plumbing Code (IPC), and International Fuel Gas Code (IFGC), as verified by staff upon completed adoption. Fl In response to Chair Garcia, Mr. Groom stated he and the applicant have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as proposed and modified. Fl Commissioner Conway moved to approve the request of Wells Ranch, LLLP, c/o DCP Midstream, LP, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0070, for Mineral Resource Development Facilities, including Oil and Gas Support and Service (oil and gas processing facilities and related equipment, including, but not limited to, five (5) compressors associated with gas processing or which compress gas to enter a pipeline for transport to market), and one (1) Telecommunications Tower up to seventy (70) feet in height in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion included deleting the third sentence of Condition of Approval #1.A.4 and all of Development Standard #9 regarding screening, amending Development Standard #18 to reflect adoption of the 2012 IBC, IMC, IPC, and IFGC, and modifying Development Standard #20 to add the words "if appropriate". The motion was seconded by Commissioner Rademacher, and it carried unanimously.
