RE: ACTION OF BOARD CONCERNING WAIVER OF TEN-DAY WAITING PERIOD FOR
CONSIDERATION AND INVESTIGATION OF BID #61300061, WATER IRRIGATION
RIGHTS FOR LEASE - DEPARTMENT OF FINANCE AND ADMINISTRATION
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Department of Purchasing has requested waiver of the ten-day waiting
period for Bid Request No. B1300061, Water Irrigation Rights for Lease, for the Department of
Finance and Administration, due to time constraints, and
WHEREAS, after review, the Board deems it advisable to waive the ten-day waiting
period for said bid.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the ten-day waiting period for Bid Request No. B1300061, Water
Irrigation Rights for Lease, for the Department of Finance and Administration, be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the high bid for Fulton Ditch Water from
the Fehrn Brothers at $52.00 per share and the sole bid for Lupton Bottom West Lateral Water
from Miller Farms at $1,200.00 per share, be, and hereby are, accepted.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 10th day of April, A.D., 2013.

SUBJECT: Annual Lease of Fulton Ditch and Lupton Bottom
Ditch Water Rights
On Wednesday, April 10, 2013, the Weld County BOCC will be presented with the highest bid
offers which were received for annual water rights lease of the County's 28 shares of Fulton
Ditch and 2 shares of Lupton Bottom Ditch.
The advertisement for the annual water rights lease was published in the Greeley Tribune, Fort
Lupton Press, and the Lost Creek. Additionally, the parties that have leased the shares in the
past were notified of the advertisement and the ditch company offices were notified. There were
two bids received for the lease of our Fulton Ditch water rights. There was one bid received for
the lease of our Lupton Bottom water rights. There were no bids received for the lease of our
Lake Loveland water rights.
The bidders for the Fulton Ditch shares were David Petrocco Farms, Inc and Fehrn Bros.
Petrocco Farms bid $50/share and Fehrn Bros bid $52/share. The County owns 28 shares of
Fulton Ditch water. The total price that the winning bidder will pay is $1,456.00. The winning
bid will cover the annual ditch assessment that is paid by the County. Fehrn Bros. has never
leased the Fulton Ditch shares from the County. In order to show continued use of the water
rights, it is recommended that the County accept the Fehrn Bros. bid and move forward with
signing the annual lease for the 28 shares of Fulton Ditch water.
The bidder for the Lupton Bottom shares was Miller Farms and they bid $1,200/share. The
County owns 2 shares of Lupton Bottom water. The total price that the winning bidder will pay
is $2,400. The Miller Farms bid will cover the annual ditch assessment that is paid by the
County. Miller Farms has leased the Lupton Bottom shares from the County for the last several
years. In order to show continued use of the water rights, it is recommended that the County
accept the Miller Farms bid and move forward with signing the annual lease for the 2 shares of
Lupton Bottom Ditch water.
I will plan on attending the BOCC hearing to answer any questions that the Board may have
regarding the annual leasing of the above mentioned water rights.
