RE: APPROVE AMENDMENT#1 TO FEDERAL ASSISTANCE GRANT FOR WELD COUNTY
YOUTH CONSERVATION CORPS, AMERICORPS PROGRAM, AND AUTHORIZE CHAIR
TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with Amendment#1 to Federal Assistance Grant
for the Weld County Youth Conservation Corps, AmeriCorps Program, from the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of
the Department of Human Services, to the Governor's Commission on Community Service,
commencing upon full execution of signature, and ending December 31, 2014, with further terms
and conditions being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Amendment #1 to Federal Assistance Grant for the Weld County Youth
Conservation Corps, AmeriCorps Program, from the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, on behalf of the Department of
Human Services, to the Governor's Commission on Community Service be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 23th day of September, A.D., 2013.

RE: Amendment #1 to the AmeriCorps Grant between the
Weld County Board of Commissioners on Behalf of the Weld
County Youth Conservation Corps and Serve Colorado
Enclosed for Board approval is Amendment #1 to the Department's Employment Services
AmeriCorps Grant. This item was reviewed under the Board's Pass -Around Memorandum dated
September 17, 2013, and approved for placement on the Board's Agenda.
The Board previously approved the submission of the AmeriCorps grant in July of 2013. The
grant application has been accepted by Serve Colorado and is now seeking signatures in order to
fully execute the AmeriCorps grant and is referred to as Grant Amendment #1.
AmeriCorps State funding is awarded in three (3) year cycles. Given this fact, the contract that is
currently under consideration is an amendment to the contract that was signed and approved last
year. This amendment extends last year's contract from December 2013 to December 2014,
increases the total award to include both program years (PY 2012 and PY 2013) and introduces the
two (2) additional expectations (Days of Service and Disaster Readiness). It should be noted that
the Days of Service expectation is to coordinate such activities within Weld County and not to
attend larger events outside of Weld County.
The amendment represents an increase to the total award amount, capturing last year's award and
this year's award. Funding for FY15 will increase upon executing the continuation grant for year
three (3) of the three (3) year grant cycle.

1) PARTIES
This Amendment to the above -referenced Original Grant (hereinafter called the
"Grant') is entered into by and between the Board of Weld County Commissioners,
Weld County Division of Human Services, ("Grantee") and the STATE OF
COLORADO (the "State") acting by and through the Governor's Commission on
Community Service ("GCCS").
2) EFFECTIVE DATE AND ENFORCEABILITY
This Amendment shall not be effective or enforceable until it is approved and signed
by the Colorado State Controller or designee (hereinafter called the "Effective Date").
The State shall not be liable to pay or reimburse Grantee for any performance
hereunder including, but not limited to, costs or expenses incurred, or be bound by
any provision hereof prior to the Effective Date.
3) FACTUAL RECITALS
a. The parties entered into the Grant to recruit, train, monitor and evaluate
AmeriCorps members to serve at the Board of Weld County Commissioners,
Weld County Division of Human Services.
b. The purpose of this Amendment is to (i) add a new section to the Grantee's
obligations about days of service and (ii) add a new section to the Grantee's
obligations about disaster reassignment (iii) Extend the Grant for another year
through "December 31, 2014" (iv) Increase the maximum amount of the Grant
Agreement, and (v) Specify a new budget for the extended term.
4) CONSIDERATION -COLORADO SPECIAL PROVISIONS
The Parties acknowledge that the mutual promises and covenants contained herein
and other good and valuable consideration are sufficient and adequate to support this
Amendment.
5) LIMITS OF EFFECT
This Amendment is incorporated by reference into the Grant, and the Grant and all
prior amendments thereto, if any, remain in full force and effect except as specifically
modified herein.
6) MODIFICATIONS
The Grant and all prior amendments thereto, if any, are modified as follows:
a. In subsections 5.A and 6.A. of the Grant, delete "December 31, 2013" and
replace with "December 31, 2014"
b. In subsection 7.A. Maximum Amount, delete "$194,015" and replace with
"$325,822".
c. In subsection 7.A. delete the fiscal year maximum amount table and replace
with
$162,911 in FY13
$136,845 in FY 14
$26,066 in FY 15
d. Add new Exhibit B-1.

e. All references in the Grant Agreement to Exhibit B shall also include Exhibit B-1.
f. Days of Service
Exhibit A. Grantee's Obligations is amended by adding a new provision as follows:
Program members are encouraged to participate in all four Serve Colorado Days of
Service and are required to participate in two specific Serve Colorado Days of
Service sponsored by Serve Colorado.
Days of Service shall consist of the following activities:
• 9/11 Day of Service; and,
• MLK Day of Service.
Site -specific participation shall follow a project developed by Serve Colorado.
g. Disaster Reassignment
Exhibit A. Grantee's Obligations is amended by adding a new provision as follows:
AmeriCorps members may from time to time be reassigned to serve on a
temporary basis as support for spontaneous disasters. Each program is
responsible for the decision related to when members shall be reassigned and how
to best utilize members' efforts. Programs should be mindful of continued
demands of the program members are assigned to serve as well as meeting the
performance measures submitted as part of the program deliverable.
7) START DATE
This Amendment shall take effect on the later of its Effective Date or October 1, 2013.
8) ORDER OF PRECEDENCE
Except for the Special Provisions, in the event of any conflict, inconsistency, variance,
or contradiction between the provisions of this Amendment and any of the provisions
of the Grant, the provisions of this Amendment shall in all respects supersede,
govern, and control. The most recent version of the Special Provisions incorporated
into the Grant or any amendment shall always control other provisions in the Grant or
any amendments.
9) AVAILABLE FUNDS
Financial obligations of the State payable after the current fiscal year are contingent
upon funds for that purpose being appropriated, budgeted, or otherwise made
available.

CRS §24-30-202 requires the State Controller to approve all State Grants. This Grant is not valid until
signed and dated below by the State Controller or delegate. Grantee is not authorized to begin performance
until such time. If Grantee begins performing prior thereto, the State of Colorado is not obligated to pay
Grantee for such performance or for any goods and/or services provided hereunder.
