RE: ACCEPTING OF NEW LETTER OF CREDIT FOR IDA INDUSTRIAL PARK -
FIRST FILING AND AUTHORIZATION OF CLERK TO THE BOARD OF
COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO, TO RELEASE
A LETTER OF CREDIT DATED JANUARY 12 , 1976 .
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, are vested with the authority of administering
the affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, have previously accepted a letter of credit from
Ida Industrial Park - First Filing, which letter of credit was
dated January 12 , 1976 , and authorized credit in the total sum
of Nineteen Thousand One Hundred Twenty Seven Dollars and 50/100
($19 , 127. 50) , and
WHEREAS, application has been made to the Board of County
Commissioners of Weld County, Colorado for withdrawal of the
aforesaid letter of credit dated January 12 , 1976 and substi-
tuting in its place a new letter of credit dated February 16 , 1977
on the Platte Valley Bank of Brighton, Colorado 80601 in the sum
of Sixteen Thousand Seven Hundred Twenty-seven Dollars and 50/100
($16 , 727. 50) .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the letter of credit
as hereinabove described and dated January 12 , 1976, be and
hereby is released and a new letter of credit dated February 16,
1977 on the Platte Valley Bank of Brighton, Colorado 80601 to
the Board of County Commissioners of Weld County, Colorado in
the sum of $16 , 727. 50 for and on behalf of Ida Industrial Park -
First Filing, be and the same is hereby accepted.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 9th day of
March A.D. , 1977.

TO: Board of County Commissioners
Weld County, Colorado
Dear Sirs:
Please be advised that the PLATTE VALLEY BANK, at the request of L.
Harlow Leeper, has established for Ida Industrial Park - First Filing,
a credit with our bank for $16,727.50 which shall be irrevocable until
August 16, 1978. We hereby authorize you to draw on same at sight for
any sum or sums not exceeding $16,727.50 for said period.
We hereby agree with the Drawers , Endorsers , and Bonafide Holders of
all drafts drawn under and in compliance with the terms hereof will
be duly honored and paid by ther undersigned.
Funds to be used in accordance with Subdivision Improvements Agreement
Exhibit "A".
Each draft drawn hereunder must specifically mention the number and
date of this Letter of Credit. The draft amount must be endorsed on
the reverse side of this instrument.

Subject:
I would make the following recommendations in regard to the
request made by Mr. L. Harlow Leeper in his letter dated
February 1 , 1977.
Reduce the total estimated cost of Improvements and Supervision
from $19, 127. 50 to $16 , 727. 50 due to the fact water and sewer
is installed and accepted by the City of Brighton as evidenced
by letter dated June 24 , 1976. The $2400 . 00 reduction would
be the amount stated on Exhibit A for water, sewer and fire
hydrants . No reduction of street base , supervision or
Engineering costs are recommended at this time .
Due to the fact applicant requested a six month extension to
complete the asphalt paving, I would recommend the new letter
of credit be for an 18 month period so that after initial
acceptance the street can lay one year prior to final acceptance .

Dear Mr. Smith:
Pursuant to the meeting of January 18, 1977
at which time Mr. Baumgartner and I met with yourself
and Mr. Olson of your engineering staff, we are making
the following requests in writing as was suggested.
concerning the Subdivision Improvements Agreement for
IDA Industrial Park - First Filing.
1 . We are asking for a 6 months extension
in time for the completion of North 5th
Avenue asphalt paving and one culvert
installation.
2. We ask that our requirement on Letter of
Credit be reduced the amount of the follow-
ing items because of completion:
A. Street Base $ 6,442.50
B. Sewer Mains $ 1 ,000.00
C. Water Mains 6 1 ,000.00
D. Fire Hydrants $ 400.00
E. Supervision Cost $ 350.00
F. Engineering Costs $ 550.00
Total s 9,742.50
It has cost us in excess of 6100,000.00 in cash
for water and sewer line extension, sewage lift station
installation and right-of-way acquisition to meet the
City of Brighton and Weld County requirements. We are
willing and able to furnish a letter of credit for the
balance of $9,385.00 for the completion of the remain-
ing asphalt paving as set forth in the Subdivision
Agreement Exhibit "A" dated January 8, 1976.

You are hereby notified that the following described
water lines , sewer lines and sewer lift station to serve
IDA Industrial Park, have been installed according to the
plans and specifications and are hereby accepted by the
City of Brighton for operation and maintenance hereafter
subject to the usual one year warranty on all materials
and installation by the contractor and IDA Investments and
subject to trench patching ,
1 . 12" Ductile iron water pipe from County Line Road
northerly to Weld County Road 2% and westerly on Weld County
Road 2% to North 5th Avenue.
2 . 8" Ductile iron water pipe from County Road 2%
northerly approximately 1 , 070 feet .
3 . Sewer lift station located at the northeast corner
of County Line Road and old U. S . Highway No . 85 .
4. 10" VCP from County Line Road northerly to County
Road 2% and westerly on County Road 24 to North 5th Avenue
and northerly on North 5th Avenue approximately 1 , 380 feet .
5 . 6" PVC pressure sewer line from said sewer lift
station southerly approximately 1 , 700 feet to the 21"
outfall line of the City of Brighton.
