A public hearing was conducted on February 20, 2013, at 10:00 a.m., with the following present:
Commissioner William F. Garcia, Chair
Commissioner Douglas Rademacher, Pro-Tem
Commissioner Sean P. Conway - EXCUSED
Commissioner Mike Freeman - EXCUSED
Commissioner Barbara Kirkmeyer

The following business was transacted:
I hereby certify that pursuant to a notice dated November 16, 2012, and duly published
November 21, 2012, in the Greeley Tribune, a public hearing was conducted on January 2,
2013, to consider the request of David and Kayleen Hunt, c/o A&W Water Service, Inc., for a
Site Specific Development Plan and Use by Special Review Permit, USR12-0064, for a Mineral
Resource Development Facility, including Oil and Gas Support and Service (water hauling) in
the A (Agricultural) Zone District, at which time the matter was continued to February 20, 2013,
to allow the applicant additional time to address requirements of the Colorado Department of
Transportation. On February 20, 2013, Brad Yatabe, Assistant County Attorney, made this a
matter of record.
ID Diana Aungst, Department of Planning Services, referred to a letter from the applicant
requesting withdrawal of the case due to changes in market conditions and decreased demand
for the use. In response to Commissioner Rademacher, Ms. Aungst confirmed this case was
withdrawn prior to the Planning Commission hearing.
IR Commissioner Rademacher moved to accept the request to withdraw the application of
David and Kayleen Hunt, do A&W Water Service, Inc., for a Site Specific Development Plan
and Use by Special Review Permit, USR12-0064, for a Mineral Resource Development Facility,
including Oil and Gas Support and Service (water hauling) in the A (Agricultural) Zone District.
The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. There
being no further discussion, the hearing was completed at 10:11 a.m.
