RE: VACATING LOTS 5 through 12 IN WESTERN HILLS SUBDIVISION,
LOUIS BRIGHT, APPLICANT.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 17th day of October, 1977 , in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the reduction
of lots on land owned by Louis Brighi in Western Hills Subdivision,
which were to be developed as commercial lots, would be advantageous
and in the best interest of Weld County, and
WHEREAS, said developable commercial lots are more particu-
larly described as follows, to-wit:
KNOW ALL MEN BY THESE PRESENTS: That I, Louis J. Brighi,
being the sole owner in fee of Lots 5, 6, 7, 8, 9, 10, 11
and 12, Western Hills Subdivision, a subdivision of Weld
County, Colorado, being a part of the Southeast Quarter
(SE4) of Section 4, Township 5 North, Range 66 West of the
6th P.M. , Weld County, Colorado, according to the recorded
map or plat thereof, do hereby vacate thatpart of Western
Hills Subdivision being more particularly described as
follows:
Beginning at the Southeast Corner (SE Cor) of said Section
4, and considering the East line of the 5Ea of said Section
4 as bearing North 06°30'30" East, with all other bearings
contained herein relative thereto;
Thence North 06°30'30" Fast, along said East line, 57.00 feet;
Thence North 89°29'00" West, 783.96 feet to the True Point
of Beginning; Thence continuing North 89°29'00" West, 686.78
feet; Thence North 06°30'30" East, 290.13 feet;
Thence North 80°20'00" East, 50.71 feet; Thence South 89°29'00"
East, 606.58 feet; Thence South 00°31'00" West, 297.50 feet
to the True Point of Beginning, shown on the attached map as
embraced within the heavy exterior lines thereon; and do hereby
certify that the dimensions of the Lots and the names and
numbers thereof are correctly designated and that the scale
thereof is one inch to fifty feet (1" = 50' .)
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners, after considering the favorable recommendations of the
Weld County Planning Commission, and of the applicant, that the
request for vacation of Lots 5 through 12 , Western Hills Sub-
division, be, and hereby is , granted.

Moved by Bill Elliott that the following resolution be introduced for
passage by the Weld County Planning Commission:

be recommended (favorably) (OOIfErffriOialx) to the Board of County Commissioners
for the following reasons:
1. The approval of this vacation plat of Lots 5 through 12 of Western
Hills Subdivision in conjunction with the recorded exemption
request effectively reduces the number of lots from eight to two.
It is the opinion of the Planning Commission that this reduction in
developable commercial lots is advantageous for and in the best
interests of Weld County.
The Planning Commission recommendation for approval is conditional upon
the vacation plat and recorded exemption plat accurately reflecting the
policy decision between the City of Greeley and Weld County with regards
to the necessity for a public frontage road along the north side of
State Highway 34. The recorded exemption plat shall be amended to
accurately indicate the access points off State Highway 34.
