(Phase II) Pawnee Groundwater Loadout & Recycling Facility The Weld County Public Works Department reviewed the submitted application for critical items, including but not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood Hazard Development Permit. Comments made during this stage of the review process will not be all inclusive; as revised materials are submitted other concerns or issues may arise. All issues of concern and critical issues during further review must be resolved with the Public Works Department. COMMENTS: CR 95 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. CR 95 ADT Count: 20 (7/1/2011) CR 118 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. CR 118 ADT Count: 26 (3/2/2012) CR 122 is a collector road and requires an 80 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. CR 122 ADT Count: 385 (1/28/2011) CR 390 is a collector road and requires an 80 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. CR 390 ADT Count: 186 (12/9/2011) IMPROVEMENTS AGREEMENT: This Use by Special Review will be subject to a designated haul route and any intersection improvements such as adequate turning radiuses, dust control if needed, on -site improvements or upgrades necessary to accommodate this type of use. TRAFFIC STUDY: The applicant has provided a Traffic Impact Study dated May 5, 2011, for the Dietzler loading facility aka Pawnee Groundwater Loadout & Recycling Facility prepared by Fox Higgins. After reviewing the submitted traffic study and visiting the project site I have prepared the following comments: C:\Users\kford\AppData\Local\Microsoft\Windows\Temporary Internet Files\Low\Content.lE5\073BN12H\USR12-0077[2].docx 1. Please submit a revised copy of the Traffic Study that is signed, stamped, and dated by a registered professional engineer licensed in the State of Colorado. 2. The applicant is proposing approximately 320 round trips per day to the facility. 3. Public Works staff has identified the haul route for this facility to travel 2 miles north on WCR 95 to WCR 122 traveling 3 miles west to the paved portion of WCR 122. Additional routes or modification to the haul route will be determined within the Improvements Agreement. 4. An annual road inspection will be performed in the spring to establish the condition of the haul route and surrounding roadways to determine if any road damage was caused by the operation of the loading facility. 5. The applicant will be responsible excavate, repair, or patch any damage on the roadways to mitigate for heavy truck traffic volumes created by the loading facility. The type and method of repair will be determined by the Department Public Works. 6. If road damage is beyond repair, the applicant will pay their proportional share for the reconstruction to restore the road. 7. Roadways Improvements may be triggered due to heavy truck traffic associated with the facility: a. Full Depth Mag-Chloride will be required when the traffic volumes reach 200 vpd. b. CTB (Concrete Treated Base) with a Chip Seal or RAP is required when the traffic volumes reach 300 vpd. c. Pavement is required when the traffic volumes reach 500 vpd. 8. Turn lanes will be triggered once traffic volumes meet the following warrants: a. 25vph turning right into the facility during a peak hour. b. 10vph turning left into the facility during a peak hour. c. 50vph turning right out of the facility during a peak hour. 9. A stop sign will be required to be installed at the facility access onto WCR 95. 10. The access will have 60' radius to accommodate the larger trucks entering and existing the site. 11. No parking or staging of commercial vehicles on the county road is allowed. Use on -site parking area. 12. Show the approved access on the plat and label it with the approved access permit number (AP11- 00268). PRELIMINARY DRAINAGE: The applicant has provided a Phase II Drainage Amendment memo and plan for the Pawnee Water Management and Groundwater Loadout & Recycling Facility. The preliminary drainage report from Patrick Engineering, dated November, 2012, was not signed, stamped, and dated by a registered professional engineer licensed in the State of Colorado. Please provide a copy of the memo that has been wet stamped, signed, and dated by a registered professional engineer licensed in the State of Colorado. The water quality calculations use a 24 -hour drain time for the pond. In order to correctly size the water quality feature, the calculations have to be based on a 40 -hour drain time. Additionally, the outlet on the water quality feature has to be sized in accordance with the accepted methodologies outlined in the drainage criteria manual. The easiest way to size the water quality feature is to utilize the UD-Detention spreadsheet. Please add the following development standards to the plat: 1. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. 2. The applicant must take into consideration storm water capture/quantity and provide accordingly for best management practices. 3. Weld County shall not be responsible for the maintenance of on -site drainage related areas or medians. Grading Permit: Prior to recording of the final plat, the applicant needs to submit a grading permit showing: proposed grading, erosion control placement, typical details for all BMPs to be utilized, and a Construction Stormwater permit from the Colorado Department of Public Health and Environment. The permit must be wet stamped by a registered professional engineer licensed in the State of Colorado. Environmental Health Services has reviewed this proposal for an oil and gas support operation consisting of a water supply storage and upload facility, produced/flowback wastewater recycling facility, and tanker washout. We have no objections to the proposal; however, the Department's recommendation of approval is dependent upon the adoption of the following conditions: Prior to allowing the plat to be recorded: 1. The applicant shall file an Air Pollution Emission Notice (A.P.E.N.) with the Colorado Department of Health and Environment's (CDPHE) Air Pollution Control Division. Evidence of such shall be submitted in writing to the Department of Planning Services. 2. A Ground Water Monitoring Plan shall be submitted to the Weld County Department of Public Health & Environment and CDPHE Solid Waste Unit for review and approval. The plan shall include unloading pad(s) and sump(s) leak detection. Evidence of approval shall be submitted in writing to the Department of Planning Services. 3. The applicant shall be designated by the CDPHE Hazardous Materials and Waste Management Division's Solid Waste Unit as a Recycling Facility, which does not require a Certificate of Designation. Evidence of recycling designation shall be submitted in writing to the Department of Planning Services. 4. A detailed design for the secondary containment areas shall be submitted to Weld County Dept. of Public Health and Environment for review and approval. A concrete secondary containment structure (floor and walls) surrounding each tank or battery of tanks shall be constructed. The volume retained by the structure shall be greater than the volume of the largest tank inside this structure and include sufficient freeboard for precipitation. A Colorado registered professional engineer shall design the structure. 5. A detailed design for the concrete loading/unloading pads shall be submitted to Weld County Dept. of Public Health and Environment for review and approval. The design shall demonstrate how all spilled waste, stormwater, and wash down water will be contained within the receiving areas and sumps. The design shall also include the method in which seams will be sealed to prevent leakage through the pad. A leak detection system shall be designed and installed beneath the concrete unloading pad(s) and associated sump(s). A Colorado registered professional engineer shall design the structure. 6. Solids and sediment will accumulate in the processing and storage tanks and be produced during the recycling process. The facility shall submit a detailed waste handling plan to Weld County Dept. of Public Health and Environment for approval that describes the method of solids removal, on -site waste handling, waste storage and disposal. 7. A dust control plan for fugitive particulate emissions shall be submitted to the Weld County Department of Public Health & Environment for review and approval. Evidence of approval shall be submitted in writing to the Department of Planning Services. 8. A Closure Plan shall be submitted to the Weld County Department of Public Health and Environment and the CDPHE Hazardous Materials and Waste Management Division's Solid Waste Unit. The Closure Plan shall include a plan for the disposition of wastes collected on -site at the time of closure. Development standards: 1. The facility shall be constructed and operated to ensure that contamination of soil and groundwater does not occur. 2. A manager, knowledgeable in operation of the facility shall be on site when the facility is receiving waste. 3. No recycling of wastes other than exploration and production wastewaters is permitted. Any changes from the approved use may require an amendment to this Special Use Permit. 4. In accordance with Section 8 of the Regulations Pertaining to Solid Waste Sites and Facilities (6 CCR 1007-2, Part 1), the facility is required to register as a recycling facility and file an annual report with the CDPHE Solid Waste Unit, which includes the amount of exploration & production wastewater (produced water/flowback water) recycled. This annual report shall be copied to the Weld County Dept. of Public Health & Environment. 5. Any wastes generated on the facility shall be disposed of in accordance with the Colorado Solid Waste Act, Section 30-20-100.5, C.R.S., or other appropriate rule, regulation or law. The facility shall comply with their approved waste handling plan and any amendments to the approved plan shall be submitted in writing to WCDPHE for approval. 6. All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 7. This facility shall adhere to the maximum permissible noise level of 70 dBA as allowed in the Industrial Zone, as delineated in 25-12-103 C.R.S. 8. Fugitive dust and fugitive particulate emissions shall be controlled on this site and the facility shall comply with the approved dust control plan. 9. The facility shall comply with Colorado Air Quality Control Commission Regulations and any air permits issued by the CDPHE Air Pollution Control Division. 10. All liquid wastes received at the facility shall be unloaded on the unloading pad. The concrete unloading pad shall be cleaned at a frequency that prevents oils and other wastes from building up on the pad. During winter months, the facility shall maintain the unloading pad free of ice. 11.Analytical data on wastes and recycled product and environmental monitoring data shall be made available to WCDPHE and CDPHE Solid Waste Unit, who reserve the right to require additional more extensive monitoring. 12. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 13. The fresh water storage and loading system shall be operated in a manner to minimize spills and fresh water spills shall be captured in containment areas for reuse or allowed to infiltrate if uncontaminated. There shall be no discharge from the fresh water process to the facilities stormwater management system. 14. Any petroleum contaminated soils on the facility shall be removed, treated or disposed of in accordance with all applicable rules and regulations. 15. The concrete unloading pad and secondary containment areas shall be constructed and operated in accordance with the approved design and the facility shall comply with the approved groundwater monitoring and leak detection monitoring plan. 16. Any required Spill Prevention and Control and Countermeasure (SPCC) Plan(s) shall be prepared and maintained on -site in accordance with 40 CFR 112. 17. Adequate drinking water, hand washing, and toilet facilities shall be provided. It seems like most of the stuff up north would eventually end up coming to SH 14 or SH 392, and sometimes US 85. But I never know. And without that information, I can't really comment about the traffic impacts. According to our records, the site is serviced by existing well permit nos. 76773-F (replacing 74874-F) in the Laramie -Fox Hills aquifer and 76769-F (replacing 74877-F) in the Upper Laramie aquifer. These existing permits are approved for industrial, irrigation, commercial, livestock, fish rearing, recreation and pond filling on 5,054.46 acres generally described as the E1/2 of Section 11, all of Section 13, the NE1/4 and S1/2 of Section 14, the NE1/4 of Section 23, the N1/2, N1/2 of S1/2 of Section 24, All in Township 10 North, Range 61 West of the 6th P.M.
