RESOLUTION RE: APPROVE NON -FINANCIAL MEMORANDUM OF UNDERSTANDING AND PROTOCOL FOR NORTHERN COLORADO CHILD ABDUCTION RESONSE TEAM (CART) AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Non -financial Memorandum of Understanding and Protocol for the Northern Colorado Child Abduction Response Team (CART) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services in conjunction with the Greeley Police Department, Weld County Sheriff's Office and Evans Police Department, commencing upon date of execution, with further terms and conditions being as stated in said memorandum of understanding and protocol, and WHEREAS, after review, the Board deems it advisable to approve said memorandum of understanding and protocol, a copy of which is attached hereto and incorporated herein by reference. Griego, Director, Human Se RE: Memorandum of Understanding and Protocol with the Northern Colorado Child Abduction Response Team (CART) Enclosed for Board approval is a Memorandum of Understanding and Protocol with the Northern Colorado Child Abduction Response Team (CART) between the Department and various law enforcement agencies. This Memorandum of Understanding was reviewed under the Board's Pass -Around Memorandum dated May 15, 2013, and approved for placement on the Board's Agenda. The purpose of the Protocol and MOU establishes an inter -agency child abduction team that will respond to abducted as well as missing and endangered child cases, as set forth by certain criteria. The principal mission of the Child Abduction Response Team is the rescue of abducted children and the location of otherwise missing children whose safety may be endangered. An equally important goal is the successful prosecution of an abductor. The Protocol and non -financial Memorandum of Understanding were developed in conjunction with the Greeley Police Department, Weld County Sheriffs Office and Evans Police Department. The term of this MOU will be effective as of the date of execution by each party, and shall be perpetual. If you have any questions, please give me a call at extension 6510. 2013-1396 Northern Colorado Child Abduction Response Team Memorandum of Understanding WHEREAS, the undersigned law enforcement agencies have joined together in a multi - jurisdictional effort to rescue abducted children and allocate resources to missing and endangered children; and WHEREAS, the undersigned law enforcement agencies are participants in a multi - agency effort known collectively as the Northern Colorado Child Abduction Response Team ("Northern Colorado CART"); and WHEREAS, the undersigned law enforcement agencies agree to utilize applicable state and federal laws to prosecute criminal actions against identified violators, as appropriate; and WHEREAS, the undersigned law enforcement agencies have the authority under the Law Enforcement Authority Act of 1969, § 30-11-410. C.R.S. to enter into a voluntary agreement for cooperation and assistance of a routine law enforcement nature that crosses jurisdictional lines; and the parties are authorized to enter into this MOU, by virtue of Section 29-1-203, C.R.S. WHEREAS, the undersigned law enforcement agencies are so located in relation to each other that it is to the advantage of each to receive and extend mutual aid in the form of law enforcement services and resources to adequately respond to continuing, multi - jurisdictional criminal activity, so as to protect the public peace and safety, and preserve the lives and property of the citizens; and WHEREAS, the human services members of the Northern Colorado CART agree to provide timely and pertinent information to the law enforcement members, for the purpose of assisting the immediate and ongoing investigation and rescue of missing and endangered children. WHEREAS, this Memorandum of Understanding ("MOU") does not supersede or take the place of any other agreement entered into by the various members of the Northern Colorado CART — those agreements shall remain in full effect. THEREFORE, the undersigned member agencies agree to the following: Pursuant to executing this MOU, each of the undersigned member agencies approve, authorize and enter into this MOU at the request of the member agencies of the Northern Colorado CART to implement within the jurisdictional and other limits as noted herein for the purposes and goals indicated. 1 o7028- /39� I. MEMBERSHIP a. Original members of this Agreement are: Greeley Police Department Weld County Sheriffs Office Evans Police Department Weld County Department of Human Services b. Additional parties may, at the request and with the approval of the Northern Colorado CART, enter into this Agreement at a later date as evidence by their signing of the Certificate of Acceptance of this MOU. Once accepted by the CART, such Certificate of Acceptance pages shall be considered an addendum to this original Agreement and will be fully incorporated herein. II. TERM The term of this MOU will be effective as of the date of execution by each party, and shall be perpetual. III. TERMINATION Any party to this MOU may withdraw from the Northern Colorado CART upon providing written notice to the Northern Colorado CART Commander. IV. NORTHERN COLORADO CART a. Each undersigned party to this Agreement shall be a member of the Northern Colorado CART. A voting member is defined by the Protocol. Attendance of a majority of voting members at a regularly scheduled or properly noticed meeting shall constitute a quorum. The Northern Colorado CART shall meet at the direction of the Northern Colorado CART Commander with 24 hours' notice. Notice may be by phone, in writing, or by e-mail or other electronic means. Each member is responsible to keep contact information updated. b. The Northern Colorado CART Commander shall be appointed and removed as provided for in the Northern Colorado CART Protocol. c. The Northern Colorado CART Protocol is incorporated herein, and is subject to changes made in accordance with the terms provided in the protocol. Changes to the Protocol may be made after annual review, or otherwise on an as -needed basis. V. GOALS AND COOPERATION TO BE RENDERED a. The primary goal of the Northern Colorado CART is to provide specialized personnel who are available to focus dedicated and intensive investigative, 2 preventative, and general law enforcement efforts primarily with regard to cases involving abducted or missing/endangered children. b. The Northern Colorado CART law enforcement agencies approve and enter into this MOU to assist the lead agency in the following: missing/endangered children, to rescue abducted children, and investigate, arrest and prosecute perpetrators involved in child kidnapping, abduction, false imprisonment and similar or related violations. c. The primary goal of the Northern Colorado CART human services agencies is to provide relevant information to the Northern Colorado CART law enforcement agencies in a timely and effective manner. The human services agencies collect and retain information related to children. Such information may be relevant and particularly helpful to a law enforcement investigation of missing or endangered children. i. The Northern Colorado CART human services agencies agree to cooperate in providing information to Northern Colorado CART law enforcement agencies as permitted by State law, and in as timely and efficient manner as possible. Specifically, based upon information provided to the human services agencies by the law enforcement agencies, the human services agencies will expedite provision of the report described in C.R.S. 19-3-307 to the requesting law enforcement agency. ii. All Northern Colorado CART members recognize the human services agencies' requirement to comply with the confidentiality requirements under State and federal law. Should there be a dispute as to what information can legally be provided to the requesting law enforcement agency, the human services agencies agree to immediately seek an appropriate court order authorizing or denying the release of the disputed. d. This MOU shall not limit the ability of participating Northern Colorado CART members to provide assistance in any enforcement action. e. The parties to the MOU are contributing personnel and resources in support of Northern Colorado CART activities, during a CART incident activation, as provided in the Protocol. VI. JURISDICTION Pursuant to Law Enforcement Authority Act of 1969, § 30-11-410 employees and agents of the undersigned agencies participating in the Northern Colorado CART shall, when engaging in authorized mutual co -operational and assistance pursuant to this MOU, have the same powers, duties, rights, privileges and immunities as if the employees were performing duties inside the political subdivision in which the employee is normally employed. By executing this MOU, law enforcement agencies enter into a general reciprocal continuing request for and granting of assistance between members of the 3 Northern Colorado CART; no additional request for assistance is required. Northern Colorado CART law enforcement officers operating outside the jurisdiction of their respective agencies shall not enjoy extra jurisdictional authority unless engaged in Northern Colorado CART activities consistent with this MOU. VII. PROCEDURE FOR REQUESTING AND AUTHORIZING ASSISTANCE Northern Colorado CART activities shall be authorized only when approved and directed as provided herein by a Northern Colorado CART supervisor or command designee. Northern Colorado CART will normally function as a force multiplier for the requesting agency, and the requesting agency will remain as the lead agency in overall control of the investigation. VII. DISPUTES AND TERMINATING OPERATIONS a. The undersigned parties stipulate that in the event of a significant investigative or jurisdictional dispute, the issue shall be immediately forwarded to the requesting agency chief executives for resolution. The Northern Colorado CART supervisor or command designee may terminate Northern Colorado CART's involvement in any operation in a manner assuring the safety of all involved law enforcement officers. b. Complaints against any member of the Northern Colorado CART must be submitted in writing to the Northern Colorado CART Commander, and will be forwarded to the subject law enforcement agency for investigation and, if necessary, disciplinary action. c. Any member of the Northern Colorado CART may be removed as provided for in the Protocol. IX. PROPERTY AND EVIDENCE All property and evidence seized or obtained in connection with a Northern Colorado CART operation shall be taken into custody and processed in accordance with the Requesting Agency's policies and procedures, unless otherwise agreed upon. X. LIABILITY AND EXPENSES. a. Each undersigned party hereby agrees to assume its own liability and responsibility for the acts, omission or conduct of its own employees while such employees are engaged in rendering aid, cooperation and assistance pursuant to this MOU. Each Agency shall compensate its own employees, and shall be responsible for their own liabilities and expenses. b. No term or condition of this contract shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protection, or other provisions for the parties, of the Colorado Governmental Immunity Act, C.R.S. 4 §24-10-101 et seq. or the Federal Tort Claims Act, 28 U.S.C. 2671 et seq. as applicable, as now or hereafter amended. XI. Written Notice Written notice should be directed to the Northern Colorado CART Commander as provided in the Protocol. XII. MISCELLANEOUS a. No Waiver No term or condition of this contract shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protection, or other provisions for the parties, of the Colorado Governmental Immunity Act, C.R.S. §24-10- 101 et seq. or the Federal Tort Claims Act, 28 U.S.C. 2671 et seq. as applicable, as now or hereafter amended. b. Severability If any term or condition of this MOU shall be held to be invalid, illegal, or unenforceable, this MOU shall be construed and enforced without such provision, to the extent that this MOU is then capable of execution within the original intent of the parties. The parties further agree to attempt in good faith to modify this MOU as necessary to comply with changes in State or federal law and applicable State rules and regulations, in order to effectuate the purpose of this MOU. c. No Third Party Beneficiary Except as herein provided otherwise, this MOU shall inure to the benefit of and be binding upon, the parties and respective successors and assigns. It is expressly understood and agreed that the enforcement of the terms and conditions of this MOU, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties and nothing in this MOU shall give or allow any claim or right of action whatsoever by any other person not included in this MOU. It is the express intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under this MOU shall be an incidental beneficiary only. d. Complete Agreement The parties expressly recognize that this MOU contains the complete agreement between the parties as to the subject matter of this MOU. This MOU replaces and supersedes any and all prior agreement between the parties which may be in conflict with the terms of this MOU. 5 e. Amendment This MOU may be amended by agreement of the parties. Any such amendment shall not be effective unless completed with the same formality of execution as the original MOU. f Confidentiality All parties shall comply with all applicable standards, rules, and regulations regarding confidentiality as may be related to their responsibilities. g. Authority Upon execution this MOU is a valid and binding obligation between the undersigned parties, and the making and performance of this MOU has been duly authorized by all necessary corporate or official action, and will not constitute a violation of any law or requirement imposed by law, including any order of a judicial or arbitral body or governmental entity. The making or performance of this MOU does not require the consent or approval of any governmental entity or, if such consent or approval is required, such has been obtained. Certificate of Acceptance: We, Board of County Commissioners, hereby certify that we have read and understand the Northern Colorado CART MOU. Furthermore, we have the authority to enter into this agreement on behalf of the Weld County Department of Human Services. Deputy Cl-' to the Board WELD COUNTY DEPARTMENT OF HUMAN SERVICES 6 ??©/3-/326 NORTHERN COLORADO CART CHILD ABDUCTION RESPONSE TEAM (CART) PROTOCOL Section 1: Intent and Purpose The purpose is to establish an inter -agency child abduction team that will respond to abducted as well as missing and endangered child cases, as set forth by certain criteria. When a child is abducted, time becomes a critical factor in effecting a safe rescue. Rapid response requires pre -identified multi -agency resources, an operational plan and protocols, and a well-equipped, trained, and prepared team. In an effort to enhance each agency's ability to respond quickly and effectively to a missing or abducted child, participating agencies in Northern Colorado have joined together to establish an inter -agency Child Abduction Response Team (CART). The team will be called Northern Colorado CART. The principal mission of the Child Abduction Response Team is the rescue of abducted children and the location of otherwise missing children whose safety may be endangered. An equally important goal is the successful prosecution of an abductor. The latter requires close coordination with prosecuting authorities, both in state and federal courts. Member agencies of the Child Abduction Response Team are obligated to coordinate their efforts in such a way as to support the efficient prosecution of cases. Civil and/or administrative actions derived from Child Abduction Response Team operations are likewise to receive coordinated support efforts from team members. Principal goals of the regional CART: • Establish and maintain standards to respond to child abductions or incidents of missing and endangered people • Increase effectiveness during CART activation • Establish standards for teamwork, interagency cooperation and unified response • The rescue and safe return of abducted children through dedicated and intensive investigative, preventative, and general law enforcement efforts • The arrest and successful prosecution of criminal abductors Section 2: Statement of cooperation The members of CART are currently comprised of the following agencies: Please see Addendum A. These agencies have committed resources to respond to a child abduction or endangered missing child event. This interagency approach will significantly enhance the ability of individual agencies to respond to a missing or abducted child by: 1 • Maximizing benefit from shared financial and personnel resources • Providing access to specialized equipment and devices • Integrated unique investigative, prosecutorial, child victim, and community expertise • Maintaining preparedness through continued training and exercises • Assuring family and community that all appropriate resources are integrated and focused on the successful rescue and reunification of the child Section 3: Team composition The CART is a multi -jurisdictional team comprised of local, state, and federal law enforcement and human services agencies. The Northern Colorado CART Commander shall be appointed or removed by a majority vote of the voting members. Each agency's chief administrator, or his or her designee, shall constitute a voting member for this purpose. The CART members are selected by their agencies and approved by the CART Commander based on experience, exemplary service, and expertise. The CART member will be assigned a CART position based on their experience, expertise, and desire. Each CART member agency agrees to dedicate at least one investigator for training. organizational and preparedness meetings, and response to a call for assistance for an incident of child abduction. The CART shall vote on who they believe should be the CART Coordinator. A voting member will have attended a Department of Justice sponsored training relevant to CART. The team will then give their recommendation to the CART Commander for approval. Whenever possible, to insure cohesiveness of the team, the CART Commander and CART Coordinator should be selected from different agencies. The CART Commander, or designee, will be responsible for: • CART operations during an activation • Ensure CART positions are sufficiently staffed during a CART activation • Oversight of CART deployment • CART equipment • Ensure CART members receive proper training • Updating the CART member contact information and partner spreadsheet The CART command structure is as follows: • CART Commander • CART Coordinator • Logistics Coordinator • Investigative Coordinator • Search and Rescue Coordinator • Leads Coordinator • Volunteer Coordinator • Public Information Coordinator 2 A complete CART organization chart, showing CART members, their assignments, and contact information will be posted at the Emergency Operations Center on all CART activations. Upon the confirmation of an incident of a missing child that reasonably appears to be a case of child abduction or missing and endangered circumstances, the agency's Chief Administrator from the jurisdiction, or designee, may request assistance from CART by contacting the CART Commander, or designee, from CART. CART will function as a force multiplier for the requesting agency, while the requesting agency will remain as the lead agency in overall control of the investigation. The lead agency should defer to the expertise and guidance of the CART Coordinators during the investigation. The participating agencies stipulate that in the event a significant investigative or jurisdictional dispute should arise, the issue will immediately be brought to the attention of the relevant agency's Chief Administrator, or designee, for resolution. The participating agencies stipulate that they will allow their CART representative(s) to respond to the requesting agency for a minimum of five (5) working days, or at the successful conclusion of the case —whichever is less. Should the investigation require a commitment for longer than the five (5) working days, the CART Commander, or designee, shall make a request to the member agencies for an additional five (5) day commitment. The agency administrator of the responding agencies may recall their personnel at any time regardless of the original commitment, but generally only for extreme emergencies in their own community. Section 4: Resources CART should maintain a current list of equipment and any expert personnel who can be utilized to operate and/or troubleshoot the equipment during the CART activation such as aviation or aquatic equipment, personnel with special skills (canines, translators, communications equipment, etc). This inventory should be updated at least semi-annually and should be accessible to all members of the team. The inventory should provide specific details for gaining and securing the operational access to each specified item of equipment or resource. This standard requires the inventory of resources and assets to include each item of equipment or resource, pre - agreement for use by the owner of such equipment or resource and an assumption of cost agreement by the CART from the agency/persons/business possessing the equipment or resource. The CART inventory should demonstrate the team has capacity to respond to the child abduction with an appropriate amount of physical and asset resources. The Resource Guide can be utilized to maintain a current list of all available resources possessed by local governmental agencies that can be utilized to assist in the event of CART activation, or any other emergency event. Each member agency should coordinate 3 with each other to ensure that the resource guides are being used to track an inventory of available resources such as aviation or aquatic equipment, personnel with special expertise, canines, translators, communications equipment, etc. Section 5: Identification Identification will be issued to all sworn and non -sworn Northern Colorado CART members. The identification shall distinguish sworn and non -sworn members of the CART. The identification worn will be the basic identification for all CART members. Identification shall follow a consistent format, and their issuance shall be the responsibility of the CART. All identification shall be collected from CART members at such time they are no longer an active participant in CART or when they leave employment with their agency. Section 6: Meeting and training requirements In order to enhance the cohesiveness of the CART members to work together as a team in the event of activation; the CART Commander or designee will be responsible for coordinating the quarterly meetings. CART will meet at least once a quarter and should hold at least one tabletop or field exercise annually. The tabletop or field exercise can count as a quarterly meeting. A CART activation can also count as one of the required tabletop or field exercises. In the event the CART goes for one year without an activation, the CART Commander will arrange for a mock activation to ensure the CART member's skills remain current. The CART Commander will also provide training opportunities to all members of the CART. The CART Coordinators of Logistics, Investigative, Search and Rescue, Leads, Volunteer, and Public Information will provide on -going training opportunities to the CART members assigned to their individual discipline to ensure they practice and train together. CART members who require specialized skills, such as investigators, crime scene, search/rescue and K-9 will receive training by their agencies for these skills. It is the responsibility of the CART member's agency to keep their employees' training records and specialized certifications current. A CART shall work toward and obtain their certification from the U.S. Department of Justice. 4 Section 7: Authority and response criteria CART members are authorized to investigate the abduction or endangerment of children within their region upon the request of an agency's Chief Administrator. Investigations can also be initiated pursuant to an existing Memorandum of Understanding (MOU). The occurrence of any of the following predicate incidents may initiate investigative and forensic involvement, assistance, or coordination by CART members: • The non -family abduction of a minor child (under the age of 18) • The family abduction of a minor child (under the age of 18) with endangerment circumstances • Any other abduction or missing individual investigation that requires immediate response in order to protect the well-being of a minor child (under the age of 18) • Any other event involving a missing person with endangered circumstances These circumstances must clearly be articulated to the CART Commander or designee in order to activate the team members. The child's disappearance or abduction shall meet the endangerment criteria if the child's life or well-being is perceived to be at risk (due to violence or health conditions), or if the identified parental abductor has a potential for violence or could endanger the child. Section 8: Team activation To initiate a request for assistance, the originating agency's Chief Administrator, or his/her designee, should contact the CART Commander, or his/her designee, who will approve or disapprove the request based upon the activation criteria. If a CART member, other than the CART Commander receives the initial request for assistance, the member should contact the CART Commander. Once the decision is made to activate, the CART Commander will establish a staging location and ensure notification is made to all CART members. In some cases, only a portion of the team may initially be required to respond. CART members should make efforts to respond immediately upon receiving notification of team activation. The CART Commander shall insure an up-to-date list of all CART members and their contact phone and/or pager numbers is maintained, for notification purposes. The primary agency responsible for CART activations and making notifications will be the CART Commander via the Communications Center. When the Communications Center receives a request for CART assistance, they will immediately contact the CART Commander or his/her designee. Upon contact with the 5 requesting agency, the CART Commander should try and obtain the following from the requesting agency: • Identity of the person calling and agency requesting assistance • Date and time of call/request for assistance • Date and time incident occurred • Location of and directions to incident • Brief synopsis of incident • A callback number where the caller can be immediately reached Prior to activation, it is recommended that each CART member agency assemble appropriate response supplies and equipment for use until a Mobile Command Post can be established. Items that an agency may consider including in such a response kit includes: • Copies of forms and/or document templates of investigative forms • Notepads and pens/pencils • Dry erase boards and markers • Local and regional maps Section 9: Assignments and responsibilities The CART is made up of members from different agencies, each with individual capabilities. Thus, assignments and responsibilities for individual members may change with each activation. CART Command Structure Commander: The CART Commander or designee will coordinate the CART activation, establish a staging location, ensure that CART members are notified and respond to the scene of the incident. The CART Commander will meet with the Incident Commander. The CART Commander or designee will determine the role of CART and facilitate the investigation by: • Establish law enforcement (involved agency) contact • Obtain a comprehensive incident briefing • Coordinate all activities on scene with requesting agency • Ensure that the Communications Center has made all required notifications • Make investigative assignments, as necessary • Coordinate activities on scene, with requesting agency • Ensure that all CART resources are utilized and initiated immediately, including volunteers, EOC, private organizations, media, etc 6 • Coordinate with the Public Information Officer on media issues • Provide summary for immediate briefing for responding local and CART personnel • Coordinate critical incident briefings with all team members, and any other appropriate personnel for a comprehensive review concerning the investigation • In the event of CART equipment failure, the CART commander, or designee, will contact the venue agency to ask for back-up equipment Coordinator: The CART Coordinator will be responsible for directing the investigation and working in concert with the CART Commander. The CART Coordinator will be tasked with coordinating the investigation with the CART Investigative Coordinator and the agency lead investigator to direct the investigation. The CART Coordinator will be tasked with coordinating appropriate assignments and responsibilities, to include: • Overall team coordination • Keep the equipment inventory updated and ensure it is maintained and accessible in the event of a CART activation • Analytical assignments • Resource allocation • Assigning CART members to designated positions and establish Investigative organization • NCMEC Coordination (Amber Alert, leads contact/coordination, photo, etc.) • Coordinating the utilization of crime scene unit(s) - * If the member agency's crime scene unit is not available, personnel from another agency may be utilized • Coordinate with the Volunteer Coordinator to identify missions for civilian volunteers • Work with legal counsel to obtain court orders, search warrants and any other legal matters, as they arise • Coordinate with victim advocate team member to ensure family support Logistics Coordinator: The CART Logistics Coordinator is responsible to maintain a complete list of resources that may be needed on a CART activation. This includes, but is not limited to: K-9 tracking dogs, search and rescue services, dive teams, air support, FLIR units, cell phones, GPS tracking, polygraphers, and misc. equipment. The CART Logistics Coordinator is responsible for: • Transporting the CART equipment to the appropriate venues • Ensure venue agency has arranged locations for the CART venues 7 • Securing an Ops channel through the communications center • All computer equipment is properly set up in the Emergency Operations Center • Ensuring CART forms are available to the search and investigation venues • Arrange resources as needed • Coordinate with CART Commander and originating agency to manage the planning and logistical support for the event • Maps Investigative Coordinator: • Oversee all of the investigative assignments, leads, intelligence, and case investigative activity • Brief the CART Commander on all significant developments • Consult with CART Commander and Coordinator, and other relevant parties on all investigative matters and requirements • Shall maintain a liaison with the requesting agencies lead investigator • Prepare for briefings incorporating facts, witness statements, photos, and a draft timeline of events Search and Rescue Coordinator: • Encompasses the actions taken to determine the physical location of the abducted child and/or the abductor • Coordinates the identification and exploitation of physical evidence or clues that establish a location or direction of travel • Search and rescue includes the use of specialized resources, personnel, tactics and possibly civilian volunteers • Provide status updates on all search and rescue efforts at the briefings Leads Coordinator: • Ensure the collection, organization, tracking and assignment of all leads in the designated system • Work with the Investigative Coordinator and consult on prioritizing leads • Provide status updates on all high -priority leads and assist in team and media briefings Volunteer Coordinator: • Serves as the point of contact for the volunteer personnel support at the incident • Serves as the lead person overseeing the obtaining, tracking and disposition of necessary resources for volunteer personnel • Provide status updates on all volunteer efforts at the briefings 8 Public Information Coordinator: • Updates CART information released to the public through Facebook or other social media venues as they pertain to active investigations • Prepares flyers and other media used for public dissemination and for law enforcement sensitive dissemination Recognizing the need, based upon the scale and scope of an event, additional assignments may become necessary during activation. Section 10: Critical incident briefings Briefings should be held every four (4) hours during the first twenty-four (24) hour period. Additional critical incident briefings should be conducted as appropriate based on investigative activities. During the briefings, the following will be discussed: • Investigative team issues • Witness statements • Officer statements • Amber Alert status • Incident Command issues • Evidence collected and it's status/pending analysis ("turnaround time") • Issues or items that need revisiting, i.e. aerial photographs, computer assisted sketching, etc. • Legal issues • Resource assignments and needs • Media issues and utilization • Input from the Victims Advocate and/or Family Liaison A briefing should be conducted for all parties, after each 72 hour period. During the 72 hour briefings, the following should be reviewed: • Case progress • Coordinate any unresolved evidence and legal issues • Ensure all leads are being pursued • Ensure timely completion of investigative incident documentation • Discussion related to continuation of team activation Section 11: Media relations The responsibility for media releases rests with the lead agency where the abduction occurred. The designated Public Information Officer of the jurisdiction shall work closely with the coordinators of the CART. Information will not be released to the media without the Incident Commander's approval in regards to its potential consequences on the successful outcome of the case. 9 Section 12: Property and evidence All property and evidence, including currency, seized in connection with state violations pursuant to this agreement will be processed and maintained by the lead agency, or as otherwise agreed upon. Section 13: Forfeiture and seizure Forfeiture actions based upon seizures made by CART members during the investigation may be pursued in either state or federal actions. Distributions of the proceeds shall be shared equally among participating agencies, or as otherwise determined by written agreement. Section 14: Legal guidance Members of the local District Attorney's Office may be present to provide legal advice to CART, acting as advisors only. This includes, but is not limited to, providing guidance in reviewing arrest warrants, search warrants, and to address other legal questions that may arise during an investigation and/or child recovery. Any legal advisor from the local District Attorney's Office shall not become involved in any investigative capacity. Section 15: Volunteers Volunteers used during a CART activation must meet one of the following: • Be a recognized Law Enforcement volunteer, already working with a law enforcement agency, and having already been vetted, or • Must provide a valid driver's license or picture ID issued by a governmental agency, be age 18 or older, complete a registration form, and pass a background check Once meeting the standards listed above, all volunteers must wear CART approved identification; all provided by CART during the event. The CART Volunteer Coordinator shall be responsible for maintaining a log of all volunteers during the activation. Section 16: Reunification Upon recovery of a missing or abducted child, members of the team should consult with all involved parties, including the child's parents. The primary goal in the reunification of the child with the family should be in the interest and welfare of the child. Considerations in the reunification should involve the child's medical needs, the need for a forensic 10 interview, and the family's wishes. This should be accomplished through discussions involving the stakeholders, to find the best resolution of the incident and the welfare of the child. When appropriate, the child should be interviewed by forensic interviewers at an appropriate location. Additionally, should the child need any medical treatment, the child should be taken to the closest recognized medical facility. Acknowledging the wishes of any media in the recovery and reunification of a lost or abducted child, those shall be weighed against the wishes of the family and the family's desires. Should the family desire to address the media, this should be coordinated between the family, the CART and Local Law Enforcement Agency. Section 17: Team deactivation When a child has been recovered or located, the team shall be notified through the same system used for activations. When each member receives the notification, the member should contact the CART Commander to confirm recovery of the child, or that the child has been located. Section 18: Debriefing and After Action Report (AAR) Following each activation, CART members participating in an investigation should attend a debriefing scheduled by the CART Commander, usually within 72 hours after the team's deactivation. An After Action Report (AAR) will be prepared by the CART Commander. Section 19: Notice Unless otherwise provided for in this protocol, notice shall be in writing and as provided in Addendum A. Section 20: Removal of a Northern Colorado CART member Any member of the Northern Colorado CART may voluntarily withdraw in accordance with the applicable Memorandum of Understanding. Any member may be involuntarily removed by a majority vote of all voting members.
