There were two sales of groups of lots in the Silver Peaks subdivision in 2012 (totaling 32 lots) that were identical to the subject lots. The first sale occurred on on May 7, 2012, in which twenty-two identical lots were conveyed by Mutual of Omaha LoanPro, LLC to Red Tierra Equities, LLC. As evidenced by the deed recorded at Reception No. 3846709, the purchase price was $396,000. However, the purchase included twenty-two Town of Lochbuie Water Resource Credit Certificates (see attached assignment). As reflected on the correspondence from the LOCHBUIE LAND, L.L.C. Weld County Board of Equalization July 12, 2013 Page 2 district administrator, the price of the Water Resource Credit Certificates as of the date of sale was $9610.84 per certificate, or $211,438.48 for the twenty-two certificates. Deducting $211,438.48 from from the total purchase price of $396,000 leaves a value of $184,561.52 or $8,389.16 per lot. The second transaction took place on September 14, 2012 in which Respond Peregrine, LLC conveyed ten identical lots in Silver Peaks to Red Tierra Equities, L.L.C. As evidenced by the deed recorded at Reception No. 3874057, the purchase price was $100,000.00 or $10,000 per lot. Given that the first sale occurred two months prior to June 30, 2012, the value of the subject lots should properly be considered to be $8,389.16 per lot. Alternative calculations would be $8,892.55 per lot (the average of the two 2012 sales), or at most $10,000 per lot (the higher of the two, sales). There is no legitimate basis for the Assessor's decision to ascribe a value of $35,000 per lot to the subject lots, which in all respects are identical to the other lots sold in 2012.
