Garcia, Chair Commissioner Douglas Rademacher, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Chris Gathman Public Works representative, Don Carroll Health Department representative, Mary Evett The following business was transacted: I hereby certify that pursuant to a notice dated August 2, 2013, and duly published August 7, 2013, in the Greeley Tribune, a public hearing was conducted to consider the request of Kenneth Everitt, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0037, for a Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility (water depot) in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written for a water depot facility up to 20,000 gallons. He said 200 maximum daily truck round -trips are anticipated; the trucks will disperse north and south on CR 11 and east on CR 134; and there will be no on -site employees. One letter was received from a surrounding property owner expressing concern about impacts to their existing livestock well. Mr. Gathman said the applicant has a Water Court case pending for the same volume as the existing irrigation use, and Condition of Approval #1.A requires proof of the well permit. He further stated a Lighting Plan has been submitted. Don Carroll, Department of Public Works, provided a brief overview of the transportation plans and requirements. He said both roads are county maintained, the applicant will provide a vehicle tracking pad to keep mud off CR 11, and a triggered off -site Road Improvements �i . Mary Evett, Department of Public Health and Environment, reviewed water and sewer provisions, noted a Dust Abatement Plan was submitted, and said a well permit is pending. ! Linn Leeburg, Leeburg and Associates, represented the applicant. He stated this is a typical water depot in a remote area of the County. No public testimony was offered concerning this matter. Mr. Leeburg had no requested changes to the Conditions of Approval or Development Standards. The Board also had no suggested changes. In response to Chair Garcia, Mr. Leeburg said he and the applicant have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. Commissioner Rademacher moved to approve the request of Kenneth Everitt for a Site Specific Development Plan and Use by Special Review Permit, USR13-0037, for a Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility (water depot) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Freeman, and it carried unanimously. There being no further discussion, the hearing was completed at 10:38 a.m. This Certification was approved on the 9th day of September, 2013.
