RE: CALLING FOR AN ELECTION ON PROPOSED AMENDMENTS TO THE WELD
COUNTY HOME RULE CHARTER AND CERTIFYING THE APPEARANCE OF
SAID AMENDMENTS ON THE BALLOT.
WHEREAS, the Board of County Commissioner of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has directed to be published, certain
amendments to the Weld County Home Rule Charter, and
WHEREAS, Section 30-11-506, CRS 1973 and Section 17-1 of
Article XVII of the Weld County Home Rule Charter require the
Board to call an election on the proposed amendments.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that there be called an
election on the proposed amendments of the Weld County Home Rule
Charter, said election to be held on November 7, 1978 , the date
of the next general election, and
BE IT FURTHER RESOLVED that said amendments to the Weld
County Home Rule Charter appear on the ballot in the following
order and in the following form:
1. Shall the Weld County Council be Yes
abolished? No
2. An amendment to Paragraph (4) (b) Yes
of Section 3-8 of Article III of No
the Home Rule Charter for Weld
County, Colorado deleting the
requirement that the Board of County
Commissioners act only by ordinance
in matters of contracts.
3. An amendment to paragraph (5) of Yes
Section 14-9 of Article XIV deleting No
the requirement that there be a ten-
day waiting period for consideration
and investigation of all bids received
by the Board of County Conanissioners
over $2,000.
4. An amendment to Section 5-2 of Article V Yes
of the Hone Rule Charter for Weld County, No
Colorado clarifying that section so as to
clearly require that the County Attorney
be an attorney duly licensed by the State
of Colorado for at least five (5) years
immediately prior to his appointment.

5. An amendment to paragraph (3) of Yes
Section 5-3 of Article V of the Home No
Rule Charter deleting the requirement
that formal written opinions of the
County Attorney on questions of law be
maintained by the County as public
documents.
6. An amendment to paragraph (5) of Yes
Section 5-3 of Article V of the HdtT No
Rule Charter for Weld County, Colorado
deleting the requirement that in the
event of conflict between the Board of
County Commissioners and any other County
Officer, such county officer shall be
represented by a special counsel.
7. An amendment to paragraph (B) (2) (f) of Yes
Section 4-2 of Article IV of the Home No
Rule Charter for Weld County, Colorado
deleting the requirement that any person
employed with Weld County, except an
elected official, who seeks election to
a partisan public office, must request
a leave of absence, without pay, imme-
diately after announcement of his candi-
dacy.
8. An amendment to Article III of the Hone Yes
Rule Charter for Weld County, Colorado, No
. repealing paragraph (3) of Section 3-4
of Article III of the Home Rule Charter
for Weld County, Colorado, which pre-
sently prohibits a person from serving
nore than two full consecutive terms as
County Commissioner.
9. An amendment to Article XVI of the Hone Yes
Rule Charter for Weld County, Colorado, No
repealing Paragraph (2) of Section 16-8
of Article XVI of the Hone Rule Charter
for Weld County, Colorado, which presently
prohibits a person from serving more than
two consecutive terms on any one appointive
hoard or commission.
10. An amendment to Article XIII of the Home Yes
Rule Charter for Weld County, Colorado No
repealing paragraph (3) of Section 13-3
of Article XIII of the Hone Rule Charter
for Weld County, Colorado, which presently
prohibits a person from serving nore than
two consecutive terms as a county councilman.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 20th day of
September, A. D. , 1978 .
