HomeMy WebLinkAbout20133045.tiffRESOLUTION RE: ACTION OF THE BOARD CONCERNING AMENDMENT TO THE WELD COUNTY BUILDING TRADES ADVISORY COMMITTEE BYLAWS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution #870397, dated May 20, 1987, the Board ratified the Bylaws for the Weld County Building Trades Advisory Committee, and WHEREAS, after review, the Board deems it advisable to refer said bylaws, a copy of said amended Bylaws being attached hereto and incorporated herein by reference, back to the Building Trades Advisory Committee for further revision and review in a work session. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the proposed revisions to the Bylaws for the Weld County Building Trades Advisory Committee be, and hereby are, referred back to the Committee for further review. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 28th day of October, A.D., 2013. Article II - Functions of the Committee The functions of the Committee, which are designed to guide the activities of the Committee, are the following: A. To review proposed changes to Chapter 29, Building Regulations, of the Weld County Code and make recommendations concerning such proposals to the Weld County Building Inspection Division and Board of County Commissioners. B. To review legislative proposals which mandate changes in construction codes and code enforcement procedures and make recommendations concerning such proposals to the Building Inspection Division and Board of County Commissioners. C. To make recommendations to the Building Inspection Division and Board of County Commissioners concerning needed changes to Chapter 29, Building Regulations, of the Weld County Code which the Committee feels are appropriate. D. To review complaints concerning code enforcement, administration, and related matters which may be set forth by members of the various construction trades associations, individual contractors or the staff of the Building Inspection Division, and make recommendations concerning possible solutions to such problems to the Building Inspection Division and the Board of County Commissioners. E. To serve as a communication link between the Building Inspection Division, the Board of County Commissioners, and the various members of construction trades associations and individual contractors who function in Weld County. F. Such other functions as may be, from time to time, defined by the Board of County Commissioners. Article III — Basis for Committee Recommendation A. Before setting forth recommendations formulated as a result of the functions enumerated in Article II, the Committee shall determine that such recommendations are: 1 (1) Consistent with the spirit of Chapter 29, Building Regulations, of the Weld County Code; (2) Consistent with sound construction trade practices; and (3) Consistent with the overall goal of protecting the health, safety and welfare of the citizens of Weld County. B. Recommendations to be set forth by the Committee shall require the affirmative vote of a majority of the Committee membership. Article IV - Membership of Committee A. Membership — The Committee shall consist of nine (9) members. The membership shall include: (1) One (1) representative of the Home Builders Association of Northern Colorado; (2) One (1) representative of the Weld County Builders Association; (3) One (1) representative of a "small" independent commercial or residential general contractor (less than 10 employees) with a business address in Weld County; (4) One (1) representative of a "large" independent commercial general contractor (10 or more employees) with a business address in Weld County; (5) One (1) representative of a plumbing contractor with a business address in Weld County; (6) One (1) representative of an electrical contractor with a business address in Weld County; (7) (8) One (1) representative of a mechanical contractor with a business address in Weld County; One (1) representative of a concrete contractor with a business address in Weld County; (9) The Chief Building Official of the City of Greeley Building Inspection Department. B. Appointment of Members - The members of the Committee shall be appointed by the Board of County Commissioners. C. Terms of Members - A term for members of the Committee shall be for three (3) consecutive years. 2 D. Alternate Members - Each member may designate an alternate member from his own firm, who, upon acceptance of the alternate by the Committee, may attend Committee meetings in the member's absence and have the full rights and responsibilities of membership. If an alternate member attends more than three consecutive regular meetings, the regular member may be subject to replacement on the Committee. E. Reappointment of Members - Members may be reappointed to the Committee at the discretion of the Board of County Commissioners. However, members of the Committee are limited to serving two (2) consecutive terms on the Committee with the exception of position filled by the Chief Building Official of the City of Greeley, who will serve for the length of their employment in that position. F. Attendance of Members — Members who miss two or more consecutive, regular meetings may be subject to replacement on the Committee by the Board of County Commissioners. G. Remote Attendance: Upon approval of the Chairman, members of the Committee may remotely attend meetings by tele-conferencing, video-conferencing or other methods approved by the Chairman. The Chairman shall approve the equipment required to participate in meetings remotely. When attending meetings remotely, members of the Committee who seek recognition, wish to obtain the floor and who submit motions shall do so verbally and the Chairman shall verbally confirm their requests. The Chairman shall verbally confirm members attending the meeting remotely to establish the presence of a quorum and when taking and verifying votes. The Secretary shall note in the minutes of the meeting when members attend a meeting remotely, the confirmation of the quorum and the confirmation of votes of members attending a meeting remotely. Article V - Committee Officers A. List of Officers - The Committee shall have a Chairman, Vice Chairman, and Secretary. B. Selection of Chairman and Vice Chairman - The Chairman and Vice Chairman, shall be elected by a majority vote of the Committee membership at the meeting held in April of each calendar year for one (1) year terms of office. Article VI - Duties of Officers A. Chairman - The Chairman shall: (1) Preside at meetings of the Committee; (2) Define duties of Committee members necessary to carry out the work of the Committee; 3 (3) Create subcommittees composed of Committee members when such is necessary to properly carry out the functions of the Committee; and dissolve such subcommittees when appropriate; and (4) Select a Secretary to serve for a one (1) year term. B. Vice Chairman - The Vice Chairman shall perform all the duties of the Chairman in the case of any temporary absence or disability of the Chairman. C. Secretary - The Secretary shall: (1) Attend meetings of the Committee; (2) Complete and maintain minutes and other appropriate records of all meetings; and (3) Conduct the correspondence of the Committee and send out all notices, letters and informational materials related to meetings. Article VII - Meetings of Committee A. Regular Meetings. (1) Time — The Committee shall meet at least two times a year on the third Wednesday of April and October at a regular time to be set by the Chairman of the Committee. If the date of the regular meeting of the Committee must be changed, notice shall be mailed or emailed to Committee members by the Department of Planning Services no later than two (2) business days prior to the regular meeting date. Special meetings may be held in accordance with Article VII B. of these Bylaws when there is business to conduct. (2) Place — Regular meetings of the Committee shall be held in the Offices of the Weld County Department of Planning Services. (3) Notice — Notice of regular meetings shall be mailed or emailed to Committee members by the Department of Planning Services no later than five (5) business days prior to regular meeting dates. B. Special Meetings. (1) Special meetings may be held at any time upon the call of the Chairman or by a majority of the members of the Committee, or upon request of the Board of County Commissioners. (2) Place — Special Meetings of the Committee shall be held in the Offices of the Weld County Department of Planning Services or at such other location as determined by the Chairman. 4 (3) The Secretary shall give notice of special meetings to Committee members at least twenty four (24) hours prior to such meetings. C. Quorum - A majority of the members of the Committee entitled to vote shall constitute a quorum for the transaction of business. D. Deadline for Agendas - Deadline for Placement on the Agenda for matters to be reviewed by the Committee shall be ten (10) business days prior to consideration by the Committee. E. Absences by Members - Each member of the Committee who has knowledge of the fact that he will not be able to attend a regular meeting of the Committee shall notify the Building Inspection Division at the earliest possible opportunity and, in any event, prior to 4:00 p.m. on the day immediately prior to the date of the regular meeting. The Secretary shall notify the Chairman and the Chief Building Official of the Building Inspection Division in the event that the projected absences will produce a lack of quorum. Article VIII - Subcommittees A. Appointment - When necessary to efficiently carry out the work of the Committee, the Chairman may appoint subcommittees to carry out specifically assigned tasks. B. Membership - Subcommittees shall be composed of members of the Committee and may include members of the staff of the Building Inspection Division. In those instances where staff members are assigned to subcommittees, such staff members shall have a voice but shall not have a vote in the transaction of subcommittee business. The Chairman shall be an ex -officio member of all subcommittees. C. Dissolution of Subcommittees - The Chairman may dissolve such subcommittees when they are no longer necessary to carry out the Committee's work. Article IX - Reconsideration of Decisions Made by the Committee The Committee may reconsider any of its decisions if it receives pertinent information which was not before it when it initially made the decision. All requests for reconsideration from interested persons must be submitted in writing and must include the specific facts believed by the interested person(s) to justify the Committee to review its earlier decision. Requests for reconsideration of decisions made by the Committee must be received by the Committee within 120 days following the effective date of the decision in question. Article X - Roberts Rules of Order Roberts Rules of Order, Newly Revised, are hereby adopted for the government of the Committee in all cases not otherwise provided for in these Bylaws or in resolutions of the Board of County Commissioners. Article XI - Amendment of Bylaws 5 These Bylaws may be amended at any meeting of the Committee by vote of the majority of the membership of the Committee, provided five (5) business days' notice of the proposed amendments has been given to each member of the Committee and upon approval by the Commissioners.
