RE: APPROVAL OF RECORDED EXEMPTION NO. 405 - GARY BOOTH, ET AL.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 25th day of July, 1979 in the Chambers of the Board of County
Commissioners of Weld County, Colorado, that the division into
two parcels of land, as shown on the plat known as Recorded
Exemption No. 405, being the property of Gary Booth, et al,
described as the East Half of the Southeast Quarter and the
Southeast Quarter of the Northeast Quarter of Section 2 , Town-
ship 2 North, Range 68 West of the 6th P.M. , Weld County, Colorado,
being more particularly described as follows :
The East Half of the Southeast Quarter and
the Southeast Quarter of the Northeast
Quarter of Section 2, Township 2 North,
Range 68 West of the 6th P.M. , Weld County,
Colorado.
Said described parcel of land contains
117.00 acres, more or less, and is subject
to any rights-of-way of other easements as
recorded by instruments of record or as
now existing on said described parcel of
land.
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described

parcel of land owned by Gary Booth, et al. , be, and hereby is,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 25th day of
July, A.D. , 1979 .

Dear Commissioners :
The attached application, plat and related items are in reference
to a request from Gary S. Booth, et al for a recorded exemption.
The parcel of land on which this request has been made is described
as the E*SE* and SEINE* Section 2, T2N, R68W of the 6th P.M. , Weld
County, Colorado. The property is located approximately 1 mile
east of Del Camino. The property contains approximately 117 acres
of Class II , III and IV irrigated soils. The request is to split
the property into parcels of 3.685 acres and 113 acres.
It is the applicant ' s desire to sell the 3.685 acre parcel which
contains a residence, corrals and a small dairy barn. The use of
this property will continue as a small dairy operation. The 113
acre parcel is in agricultural production at the present time.
The applicants operate a feedlot to the east and adjacent to the
3.685 acre parcel. The sale of the smaller parcel is to permit the
most economic and practical use of the entire properties owned by
the applicants.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons :
1. The proposed request conforms with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County
Subdivision Regulations) , the intent clause of the Agricultural
Board of County Commissioners

Zone District (Section 3. 3.A. of the Weld County Zoning Resolu-
tion) , and the Weld County Comprehensive Plan in that the uses
will be compatible with the surrounding agricultural uses. The
request will allow agriculture and related agricultural uses to
be the predominant land uses. There will be no reduction in the
amount of land currently being used for agricultural production.
2. The request complies with the provisions of Section 9-4 A. of
the Weld County Subdivision Regulations.

Interstate Feeders
To the Department of Planning Services:
With regard to the above referenced Application, please be advised that
the owners desire to sell Lot A, consisting of approximately 3. 685 acres,
more or less, for a small dairy operation. Please be advised that the
property comprising Lot A consists of a residence, a few corrals and a
small dairy barn together with related and adjacent land area. The property
is an essentially distinct operational unit from the remaining portion of the
property owned by Interstate Feeders. Interstate Feeders operates a feedlot
to the East and adjacent to the property described as Lot A. Also, there is
certain farmland connected therewith.
It should be emphasized that the motivation for the Application is to permit
the most economic and practical use of the entire premises by permitting
the separate, small dairy operation.
Adequate water can be provided and is being provided by the Central Weld
County Water District. There is a septic system for sewage purposes.
