WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, are vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners of Weld County, Colorado, have previously accepted a letter of credit from Ida Industrial Park - Second Filing, which letter of credit was dated November 9 , 1976 , and authorized credit in the total sum of Twenty Six Thousand Two Hundred Fifty-eight Dollars and 87/100 ($26 , 258. 87) , and WHEREAS, application has been made to the Board of County Commissioners of Weld County, Colorado for withdrawal of the aforesaid letter of credit dated November 9 , 1976 and substi- tuting in its place a new letter of credit dated February 16 , 1977 on the Platte Valley Bank of Brighton, Colorado 80601 in the sum of Twelve Thousand Four Hundred and Four Dollars and 87/100 ($12 , 404. 87) . NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the letter of credit as hereinabove described and dated November 9 , 1976 , be and hereby is released and a new letter of credit dated February 16 , 1977 on the Platte Valley Bank of Brighton, Colorado 80601 to the Board of County Commissioners of Weld County, Colorado in the sum of $12 , 404. 87 for and on behalf of Ida Industrial Park - Second Filing, be and the same is hereby accepted. Harlow Leeper be granted, for Ida Industrial Park 2nd Filing. As evidenced by letter from the City of Brighton dated June 24, 1976 all sewer and water lines have been installed and accepted by the City of Brighton , therefore , the total estimated cost of Improvements and Supervision- can be reduced by the dollar amounts under sewer mains , water mains , and fire hydrants as shown on Exhibit A. We discussed in your office on January 18, 1977 the possibility of the deletion from the amount of our "Letter of Credit" furnished by the Platte Valley Bank of Brighton in favor of Weld County the amount of the water mains, sewer lines and fire hydrant installation as set forth in the Subdivision Improvement Agreement Cxhibit• "•' " dated October 21 ; 1976 (a copy of which is attached) . The City of Brighton has supervision and inspection of all installation of the utilities per our agreement with them. We must meet all of their requirements as set forth in Paragraphs 2, 3, 4, 5 and 6 of the here- tofore mentioned utility contract or we don't get any water or sewer service. It would seem to us that this is a duplication of jurisdiction and it definitely works a hardship on us in obtaining financing for development. The development of IDA Industrial Park—Second Filing is not going to move along as rapidly as anticipated due to the energy crisis and economic problems now being experienced.
