HomeMy WebLinkAbout20131664.tiffMEMORANDUM TO: Chris Gathman, Planning Services DATE: April 29, 2013 FROM: Heidi Hansen, P.E., Public Works Department SUBJECT: USR13-0016, Whiting Gas Plant A Use by Special Review permit for a natural gas processing facility. The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: CR 127 is a collector road and requires an 80 -foot right-of-way at full build out. There is presently a 60 - foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant shall delineate an additional 10 -foot of right-of-way parallel to the WCR 127 right-of-way for future build -out. There is 30 feet of unmaintained County Section Line Right -of -Way along the CR 116 section line (northern boundary of the property) please show and label this right-of-way on the plat. There is 30 feet of unmaintained County Section Line Right -of -Way along the CR 114 section line (southern boundary of the property) please show and label this right-of-way on the plat. The traffic information provided with the submittal states that the site (after construction) will generate around 10 passenger vehicle roundtrips per day and 8 large truck roundtrips per day. An improvements agreement is required for this site. Public Works will provide a draft of the agreement after the Board of County Commissioners hearing for this project. An example Improvements Agreement is available on the County Planning website under Application Assistance. Road maintenance including dust control and damage repairs will be a part of the agreement. A new access has been proposed for this project. The new access will be reviewed by the County Traffic Engineer and either approved or denied. Please show the approved access point on the Plat and label it with the Access Permit numbers (will be provided). The applicant must submit a design that will prevent tracking of mud and debris onto the County roadway. Standard tracking control for accesses onto gravel roads includes double cattle guards at the access point. Another option is submitting the gravel section design used for the onsite roadways, if Public Works believes this section is adequate for tracking control it will be included as a part of the improvements and road maintenance agreement. Contact the Permitting/Inspection agent for Weld County Public Works, at (970) 304-6496, ext. 3764 for a Right -of -Way permit for any work that may be required in the right-of-way on County roads. A special transport permit will be required for any oversized or overweight vehicles that may access the site and may also be obtained through the same office. In the event that 1 or more acres are disturbed during the construction and development of this site, the applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and Environment. The grading permit application must contain: an erosion and sediment control plan, a grading plan, installation details of all BMPs to be utilized, typical installation and maintenance notes for all BMPs to be utilized, and a copy of the approved CDPHE stormwater permit. The applicant provided a "Whiting Red Tail Gas Plant Site Drainage Narrative - Revised" dated May, 2 2013 and signed and stamped by John Enochs with Diamondback Engineering. The site imperviousness calculations show a minor change in imperviousness with the development of the 35 acre site (2% to 7.5%). This increase would not have triggered a full drainage report but the applicant has opted to include "future" improvements with this application rather than coming back through the process later. The applicant has stated that they will submit a full drainage report prior to the Planning Commission hearing for this project. This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). REQUIREMENTS: 1. Show on the Plat: a. County Road 127 is designated on the Weld County Road Classification Plan as a collector roadway, which requires 80 feet of right-of-way at full build out. The applicant shall verify the existing 60 feet of right-of-way and the documents creating the right-of- way and this information shall be noted on the plat. All setbacks shall be measured from the edge of future right-of-way. If the existing right-of-way cannot be verified, it shall be dedicated. This road is maintained by Weld County. b. There is 30 feet of unmaintained County section line right-of-way along the northern property line (CR 116 Section Line). The applicant shall verify the existing 30 feet of right- of-way and the documents creating the right-of-way and this information shall be noted on the plat. c. There is 30 feet of unmaintained County section line right-of-way along the southern property line (CR 114 Section Line). The applicant shall verify the existing 30 feet of right- of-way and the documents creating the right-of-way and this information shall be noted on the plat. d. Show the approved access(es) on the Plat and label with the approved access permit number (will be provided). 2. Before recording the Plat: a. The applicant shall submit a Final Drainage Report stamped and signed by a Professional Engineer registered in the State of Colorado and following the Weld County Drainage Criteria is required. b. An Improvements Agreement including collateral for all on -site and off -site improvements as well as road maintenance is required for this site. Road maintenance including dust control and damage repairs will be required. c. The applicant shall submit a design to prevent the tracking of mud and debris from the facility onto the County roadway. 3. Before Construction: a. In the event that 1 or more acres are disturbed during the construction and development of this site, the applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and Environment. b. If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of construction. Add the following notes to the plat: a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. b. Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, recycled asphalt base, concrete or the equivalent and shall be graded to prevent drainage problems. c. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. d. The applicant must take into consideration storm water capture/quantity and provide accordingly for best management practices. e. Weld County is not responsible for the maintenance of onsite drainage related features. The facility will have an office/shop building. It is proposed to have up to 1-2 people employed at the site, along with up to 18 drivers accessing the site on a daily basis. Permanent water and sewage disposal are proposed for employees and other personnel. An engineer designed septic system is required and the septic permit will require Weld County Board of Health approval. An individual well is proposed. The applicant will need to submit documentation from the Colorado Division of Water Resources that the well is approved for commercial use. The waste handling plan stipulates that refuse will be removed by Construction Services of Cheyenne. Waste water will be removed by Bar -S Services of Cheyenne, and will be disposed at High Sierra Water Service's water disposal facility in Grover. The plan will need to be revised to include a list of types and quantities of chemicals to be stored on site, procedures for cleanup and disposal of spilled hazardous materials. A Spill Prevention Control and Countermeasure plan (SPCC) will be required and the plan shall be available on site at all times. On site dust will be controlled by having access drives and inner roads graveled. A water truck will be utilized if necessary. The applicant submitted documentation from the Colorado Air Pollution Control Division that they are in receipt of the applicant's air permit applications. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall designate the location of the proposed septic system on the plat. The septic system must be protected from vehicle traffic. 2. The applicant shall submit written evidence from the Colorado Division of Water Resources, demonstrating that the well is appropriately permitted for the commercial use. 3. Submit documentation demonstrating that the secondary containment to be constructed around the aboveground tanks complies with the Colorado Oil and Gas Conservation Commission's Rule 604. 4. The applicant shall submit a revised waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of the type and volume of chemicals expected to be stored on site. We recommend that the following requirements be incorporated into the permit as conditions that must be met one month prior to construction activities: 1. A State stormwater discharge permit may be required for a development / redevelopment / construction site where a contiguous or non-contiguous land disturbance is greater than or equal to one acre in area. Contact the Water Quality Control Division of the Colorado Department of Public Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit for application more information. We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to the issuance of the Certificate of Occupancy: 1. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirement be incorporated into the permit as a condition that must be met one month prior to operation: 1. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be provided to Environmental Health Services Division of the Weld County Department of Public Health & Environment. We recommend that the following requirements be incorporated into the permit as development standards. 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and 2 Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 6. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 7. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 8. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 9. This application is proposing a well as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. We strongly encourage the applicant to test their drinking water prior to consumption and periodically test it over time. 10. Adequate toilet facilities (portable toilets) and hand washing units shall be provided during the construction of the facility. 11. The findings are as followed: An inspection by a Structural Engineer would need to be performed and evidence submitted for any structures or buildings related to the existing USR11-0041 if the applicant intends to complete and record the plat for this site. Building Permits including engineered foundation and plans will be required. A Soils Report will need to be submitted with the plans as well. For any electrical work done, Electrical Permits will be required. Effective January 1, 2013, Weld County has adopted the 2012 International Building Codes along with the 2011 National Electric Code and 2006 Energy Code. Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, or to cause any such work to be done, shall first make application to the building official and Weld County to obtain the required permit. Director This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. The applicant is seeking a Site Specific Development Plan and Use by Special Review permit for a gas processing plant, known as the Redtail Gas Plant. The plant will be located on a parcel of 34.9 acres, created by recorded exemption RECX13-0014. The site will have 1-2 employees, with 3-4 people anticipated to visit the site each day. The water supply for Lot A is a proposed well. Bottled water will be used during construction. The Applicant has indicated that a well permit is in the process of being applied for. A well permit application has not yet been received by this office. It is anticipated that the proposed well would be an exempt commercial well used for drinking and sanitation purposes inside the facility. No outside uses of water are allowed for this type of well and the use must also meet other requirements as described in the attached policy. A well permit for additional commercial or industrial uses could only be issued with a court -approved plan for augmentation. The Applicant has indicated that water will be trucked in for dust control purposes when the plant is operating. The ability of the applicant to obtain a well permit for Lot A will be determined at the time a well permit application is submitted to this office.
