The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: CR 100 is a collector road and requires an 80 -foot right-of-way at full build out. There is presently a 60 - foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Please show the access on the Plat and label it with the approved Access Permit number (will be provided). The applicant estimates a maximum of 4 trips per day. The largest trucks accessing the site will be 1 -ton pickups. Traffic is minimal so a road maintenance agreement is not required. The access must be constructed with adequate turning radiuses and of an all weather surface to prevent tracking onto CR 100. In the event that 1 or more acres are disturbed during the construction and development of this site, the applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and Environment. If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of construction. The grading permit application must contain: an erosion and sediment control plan, a grading plan, installation details of all BMPs to be utilized, typical installation and maintenance notes for all BMPs to be utilized, and a copy of the approved CDPHE stormwater permit. A Water Quality Feature has been designed for this site and is acceptable. This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). REQUIREMENTS: 1. Add the following conditions of approval to the plat: a. Show and label the approved access point on the Plat with the Access Permit Number (will be provided). b. The access shall be constructed with adequate turning radiuses (45' min) of an all weather material to prevent tracking onto the County roadway. c. Add the following development standards to the plat: a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. b. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. c. NOVEMBER 29, 2012 Environmental Health Services has reviewed this proposal for an explosive storage facility to support oil and gas activities. The site will only be accessed a couple of times per day by one to two employees to pick up materials; no onsite employees. According to the applicant, the employees accessing the storage site work from a commercial building at 829 HWY 85 in Nunn, which is — 1 1/2 miles from the storage site. The commercial facility is equipped with bathroom facilities for the employees; therefore, sewage disposal will not be required for this proposed storage site. The applicant submitted a dust abatement plan which states that 100 feet of the access drive will be covered in recycled asphalt, speeds will be limited to 10 miles per hour, and a dust inhibitor will be applied on the remaining access drive and storage area to control dust when necessary. The waste handling plan states that no waste will be generated at the site. According to the applicant, any debris or trash that accumulates inside the site will be removed and taken to their commercial building located at 829 HWY 85 in Nunn for removal and disposal by Waste Management. We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of Explosives Permits from the Colorado Department of Labor & Employment, Oil and Public Safety Division (7 C.C.R. 1101-9) and from the Bureau of Alcohol, Tobacco and Firearms, Federal Explosives Licensing Center (18 U.S.C. Chapter 40, Explosives). Alternately, the applicant can provide evidence from the Division that they are not subject to these requirements. 2. The applicant shall submit a list of the explosives being stored at the facility. We have no objections to the proposal; however, we recommend the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in Section 14-9-30 of the Weld County Code. 7. The operation shall comply with the Colorado Department of Labor & Employment, Division of Oil and Public Safety Explosive Regulations (7 C.C.R. 1101-9) as well as Federal Bureau of Alcohol, Tobacco and Firearms regulations. 8. Case Number USR12-0071 Parcel Number: 045529000011-R0331486 After reviewing the application and documents submitted the Building Department has the following comments: A building permit will be required for the explosive bunker. All site improvements will be required to follow all ATF regulations A building permit application must be completed and two complete sets of engineered plans including engineered foundation plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted for review. A geotechnical engineering report performed by a registered State of Colorado engineer shall be required or a open hole inspection.. Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2006 International Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code: 2006 International Energy Code; 2006 International Fuel Gas Code; 2011 National Electrical Code; 2003 ANSI 117.1 Accessibility Code and Chapter 29 of the Weld County Code. A plan review shall be approved and a permit must be issued prior to the start of construction.
