A Use by Special Review permit for Oil and Gas office/Shop/Parking
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
This site is located on CR 40 and CR 25.5. Access is from CR 40 approximately 1 mile east of HWY 60.
The parcel number is 105730300013.
CR 40 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 30 -
foot right-of-way on the north side of CR 40. This road is maintained by Weld County. Pursuant to the
definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the
future right-of-way line.
CR 25.5 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 30 -
foot right-of-way on the north side of CR 25.5. This road is maintained by Weld County. Pursuant to the
definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the
future right-of-way line.
A Weld County access permit was approved in 2012 for a residential access. AP12-00046. Please submit
a new access permit application to change the access to a commercial use. An access permit application
can be found on the Public Works website:

Once the access change of use is approved, please label the plat with the approved access permit
number (will be provided).
Per the application vehicles include approximately 40 pickup trucks, 15 eighteen wheelers and 15 ten
wheelers. Approximately 60% of the traffic will be between 6am and 10am; 20% between 10am and 6pm;
20% between 7pm and 6am. Per discussion with the application on September 16, 2013, 100% of the
traffic will be between the site and HWY 60 utilizing CR 40 and the traffic narrative describes the number
of vehicle trips on the high end. The average daily trips calculated using the information in the application
and confirmed by the applicant is approximately 61 trips/day. The average daily traffic on CR 40 in 2012
was 185 vehicles per day. The number of additional vehicles on the County maintained roadway triggers
Magnesium Chloride application for dust control. A road improvements and maintenance agreement is
required for this project.
Tracking control is required to ensure mud and debris from the site does not track onto County
maintained roadways. Double cattle guards are the County standard for access onto a gravel roadway.
Double cattle guards were included in the application site plan.
A Drainage Report was submitted by Eric Dunker, P.E. #0033915. The drainage report is being reviewed.
An accepted drainage report is required prior to recording the plat.

Show on the plat the County standard 60' turning radius to accommodate large commercial tractor trailers
turning into and out of the site. An alternative turning template may be submitted showing that an
alternative turning radius can adequately handle the expected tractor trailer turning movements.
If more than one acre is disturbed a Weld County grading permit and State construction stormwater
permit will be required.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
REQUIREMENTS:
1. Prior to recording the plat:
A. An accepted Final Drainage Report stamped and signed by a Professional Engineer
registered in the State of Colorado is required. (Department of Public Works)
B. An Improvements and road maintenance agreement for offsite improvements is required for
this site. Road maintenance including dust control, damage repair, and triggers for
improvements will be included.
C. Plat shall be amended to delineate the following:
1. County Road 40 is designated on the Weld County Road Classification Plan as a
local road, which requires 60 feet of right-of-way at full build -out. The applicant
shall verify and delineate on the plat the existing right-of-way and the documents
creating the right-of-way. All setbacks shall be measured from the edge of future
right-of-way. This road is maintained by Weld County.
2. County Road 25.5 is designated on the Weld County Road Classification Plan as
a local road, which requires 60 feet of right-of-way at full build -out. The applicant
shall verify and delineate on the plat the existing right-of-way and the documents
creating the right-of-way. All setbacks shall be measured from the edge of future
right-of-way. This road is maintained by Weld County.
3. Show the approved accesses on the plat and label with the approved access
permit number (will be provided).
2. Prior to Construction:
A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to
the start of construction.
Development Standards (notes on the plat):
1. Should noxious weeds exist on the property, or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code.
2. The historical flow patterns and runoff amounts will be maintained on the site.
3. Weld County is not responsible for the maintenance of onsite drainage related features.
4. There shall be no parking or staging of vehicles on County roads. On -site parking shall be utilized.

Environmental Health Services has reviewed this proposal for an oil and gas service
facility including equipment storage, and vehicle and equipment repairs and
maintenance. An office/shop building and a mobile home for security housing are
proposed for the facility. There will be up to 36 employees accessing the site, with 4
employees working onsite, and the remaining driving and crew members that will come
and go throughout the day.
Water for the facility will be provided by Central Weld County Water District. A can -
serve letter, dated July 9, 2013, was provided with the application. The applicant is
proposing to install an engineer -designed septic system. The commercial septic permit
will require Weld County Board of Health approval.
The proposed shop building will be equipped with a wash bay that will discharge to a
watertight vault. Any floor drains in the vehicle maintenance areas shall also drain to the
watertight vault. The vault will be serviced by Conquest Disposal.
A diesel fueling area is proposed and secondary containment will be provided for
aboveground fuel tanks. The fuel tanks may require registration through the Colorado
Department of Labor and Employment (CDL&E), Oil Inspection Section. The secondary
containment shall comply with Oil Inspection Section's Above Ground Storage Tank
Regulations (7 CCR 1101-14). A Spill Prevention, Control and Countermeasure Plan
may be required for the aboveground storage tanks. A copy of the plan shall be
submitted to Weld County Environmental Health Services.
The dust abatement plan stipulates that the access drives and circulation areas will be
covered in gravel or recycled asphalt. Water or magnesium chloride will be utilized to
mitigate onsite dust.
The waste handling plan stipulates that Safety Kleen will remove and dispose of used
vehicle fluids generated from vehicle maintenance and repairs, and Conquest Disposal
will dispose the wash bay/floor drain wastes. The waste handling plan needs to be
revised to include removal and disposal of employee trash and garbage, and other
wastes generated from vehicle and equipment maintenance and repairs, such as tires,
scrap parts, and batteries. Include the names, addresses and phone numbers of all the
waste handlers and disposal/recycling facilities to be utilized.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit documentation that the secondary containment for the
aboveground fuel tanks complies with the Colorado Department of Labor and
Employment (CDL&E), Oil Inspection Section's Above Ground Storage Tank
Regulations (7 CCR 1101-14). (Department of Public Health and Environment)
2. The applicant shall submit evidence of an Aboveground Storage Tank permit
from the Colorado Department of Labor and Employment (CDL&E), Oil
Inspection Section for any aboveground storage tanks located on the site.
Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection
Section that they are not subject to these requirements. (Department of Public

3. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be
provided to Environmental Health Services Division of the Weld County
Department of Public Health & Environment, in accordance with Section 3-6 of
the Colorado Department of Labor and Employment Division of Oil and Public
Safety Storage Tank Regulations (7 C.C.R. 1101-14) as well as EPA regulations
(40 CFR Part 112). (Department of Public Health and Environment)
4. The applicant shall submit a revised waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) The waste handler and facility where refuse (trash and garbage) will be
disposed (including the waste handler and disposal facility name, address,
and phone number).
2) The addresses and phone numbers of the companies disposing the wash
bay and shop floor drain waste, and the used vehicle fluids.

3) Disposal or recycling of other wastes generated from vehicle and equipment
maintenance and repairs, such as batteries, tires, other scrap parts (including
the waste handler and disposal facility name, address, and phone number)

Prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations. The septic system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County Individual
Sewage Disposal Regulations. (Department of Public Health and Environment)
2. The applicant shall submit evidence of an Underground Injection Control (UIC)
Class V Injection Well permit from the Environmental Protection Agency (EPA)
for any large -capacity septic system (a septic system with the capacity to serve
20 or more persons per day). Alternately, the applicant can provide evidence
from the EPA that they are not subject to the EPA Class V requirements.

We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination. (Department of Public Health and Environment)
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,

3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The facility shall operate in accordance with the approved
"waste handling plan", at all times. (Department of Public Health and

4. The applicant shall comply with all provisions of the State Underground and
Above Ground Storage Tank Regulations. (Department of Public Health and

5. Any vehicle or equipment washing areas shall capture all effluent and prevent
discharges in accordance with the Rules and Regulations of the Water Quality

Control Commission, and the Environmental Protection Agency. (Department of

6. Floor drain wastes in vehicle maintenance facility shall be captured in a
watertight vault and hauled off for proper disposal. Records of installation,
maintenance, and proper disposal shall be retained. (Department of Public

7. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall operate in accordance with the approved "dust abatement plan",
at all times. (Department of Public Health and Environment)
8. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.

9. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. (Department of Public Health

10.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. The facility shall utilize the existing public water supply (Central Weld
County Water District). (Department of Public Health and Environment)
11. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems. (Department of Public Health

12. All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling and in a manner that minimizes the release of
hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All
chemicals must be stored secure, on an impervious surface, and in accordance
with manufacturer's recommendations. (Department of Public Health and

13. The Spill Prevention, Control and Countermeasure Plan shall be available on

14. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control

15. The operation shall comply with all applicable rules and regulations of State and

Based upon the information that Jennifer has in the memorandum, the applicant will need a new permit for SH
60/WCR 40. And I really should have information regarding the movements of traffic at this intersection. They
appear to be high enough to warrant turn lanes on SH 60. Was a traffic impact study completed for this site? If
so, did it look at this intersection or only at the county roads.
Also, will traffic be prohibited from going east to US 85?
