HomeMy WebLinkAbout780863.tiff RESOLUTION RE: PARTICIPATION BY WELD COUNTY IN PROGRAM SET FORTH IN H.B. 1041 (1974) REGARDING THE IDENTIFICATION AND ADMINISTRATION OF MATTERS OF STATE AND LOCAL INTEREST. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, Weld County, Colorado, has received a letter dated July 10, 1978 , from the Executive Director, Department of Local Affairs, setting forth requirements of Counties for eligibility for financial assis- tance pursuant to H.B. 1041 (1974) , and WHEREAS, the Board has determined that it is in the best interests of the County to continue to participate in the pro- gram and to fully comply with the requirements of H.B. 1041 to effectuate proper planning within Weld County, and WHEREAS, the Board has determined that the present Zoning Resolution is in need of revision or rewriting in order to make it more responsive to the intent and purpose of the Weld County Comprehensive Plan and to make it more easily understood and administered, and WHEREAS, the revision or rewriting of the Weld County Zoning Resolution is an eligible project under the H.B. 1041 (1974) Pro- gram. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that: 1. This County will request financial assistance from the Department of Local Affairs in order to undertake the project of rewriting the Weld County Zoning Resolution. 2. This County will meet and continue to pursue standards established by the Department of Local Affairs relative to scope, detail and accuracy and comparability and to meet deadlines in accordance with the work program. 3. This County will submit a detailed, updated work plan in compliance with the requirements of said letter indicating p� aymc- 780863 . how supplemental funds under the H.B. 1041 (1974) program will be used to further land use identification and supplemental planning. Weld County intends to use the funds requested, the required match and some carry over regular HB1041 funds to finance rewriting the County ' s Zoning Resolution. The present County Zoning Resolution was originally adopted in 1961. Since that time, we have made several modifications to the Resolution; however, the approach to land use regulation has remained the same. We adopted a Comprehensive Plan in 1973 and are realizing now that our current zoning regulations and system need revision in order to aid implementation of the Plan. Weld County proposes to rewrite our Zoning Resolution according to the attached outline. There you will find answers to your questions concerning our purpose, scope of services, time-table for completion, estimated costs and source of matching funds. Ed Dunbar, Chairman Weld County Board of Commissioners ED:kmh PROPOSED HOUSE BILL 1041 SUPPLEMKNTAL FUNDING WORK PLAN Project : Re-Write of Weld County ' s Zoning Resolution Purpose, The Weld County Zoning Resolution will be re-written to achieve several objectives: 1 . Make the rules of the "Zoning Game" easier to understand; 2. Provide administrative and decision-maker ' s guidelines in the Resolution. 3 . Implement a system of performance standards or guarantees which will protect all land users in Weld County ; and 4. Bring zoning and land use controls into better harmony with the Comprehensive Plan. Scope of Services The re-write of Weld County' s Zoning Resolution will be under- taken by staff Planner Thom Rounds. Review of the completed sections will be undertaken by Mr . Rounds and other members of the Department of Planning Services; however , only Mr. Rounds ' salary will come from the HB1041 budget . It is Weld County ' s intent to re-write the Zoning Resolution to the following format : I . The Amendment Procedure Section This section will include the information on what process for amending the zone district map or zoning regulations text will be , what information will be required, what parties are responsible for what actions , and what infor- mation will be considered by the Planning Commission and Board of County Commissioners to approve or deny the amend- ment to the map or text . The amendment process will he combined with the HB1041 permit hearing process when applicable (work to be accomplished using HB1041 Regular Funds during 1978) . II . The Zone District Regulations Section Each district regulation section will include statements of intent and purpose, enough information to determine whether a proposed use is appropriate for the zone , and enough information to determine whether a proposed use is compatible with adopted plans and existing uses in the area. A. Industrial District(s ) The Industrial District ' s regulations will be geared to the use of performance standards in determining the activities which may take place in each of the districts. There should probably be three individual performance districts. The decision ' n the number of performance districts will be made once Federal , State , and County environmental protection regulations have been analyzed. The Industrial zones will be subject to site plan review procedures. B. Commercial District(s) The uses in the Commercial Districts will be regulated with a use by right and dimension approach for the individual districts. Special Uses and/or uses that are not enumerated as uses by right will be regulated with a performance standard approach. The Commercial zones will be subject to site plan review procedures. C. Residential District(s) Residential Districts will be regulated primarily through a use by right and dimension approach. Special Uses will be regulated through performance standards . Weld County ' s four Residential districts: Estate, Residential , High Density, and Mobile Home , will be analyzed with respect to the agricultural land preservation policies of the Comprehensive Plan . Residential districts will be subject to Subdivision Regulations when appropriate. D. Agricultural District(s) The Agricultural District will be regulated primarily through use by right and dimension regulations. Any use which is related to agriculture but not direct crop or livestock production (e.g. fertilizer and feed processing) will be regulated through performance standards designed to protect agricultural productivity. E. Special Uses This section will specify the procedure to be followed for gaining a Special Use Permit for uses specified as such in the Commercial , Residential , and Agricultural Districts. The procedure will include application in- formation requirements and decision-making criteria. F. Site Review Process This section of the regulations will specify the pro- cedure, information requirements, and decision-making criteria to be used in reviewing the site development plan for the Industrial and Commercial zone districts. III . The Definition Section The Definition Section will include all the terms used in the regulations which need to be specially defined for their proper use . All the terms with special meanings will be typed in italics when they appear in the text . IV. The Enforcement Section This section of the regulations will follow the traditional form in explaining what is illegal and specify penalties for breaking the code requirements. V. The Board of Adjustment/Variance Sections This section of the Weld County Zoning Resolution will specify the membership , duties, and process of the Board of Adjustment . The requirements of State Statute and the Weld County Home Rule Charter will be included in designing this section. VI . The Introductory Information Section This section will include statements concerning the author— ity, purpose and intent of the Zoning Regulations. Again, Statutory and Home Rule Charter references will be made.
