Box 1015 MAY 0 8 2043 Wellington, CO 80549 WELD COUNTY COMMISSIONERS RE: No Further Action 2012 Financial Assurance - Waste Grease Transporting All Pro Septic Dear Mr. Mackey: RECEIVED Colorado Department of Public Health' and Environment May 2,2013 The Colorado Department of Public Health and Environment, Hazardous Materials and Waste Management Division (the "Division") issued All Pro Septic a Compliance Advisory on December 21, 2012 (the "Compliance Advisory") for deficiencies related to fmancial assurance outlined in Sections 1.8 and 18.3.5 and/or 18.4.7 of the Regulations Pertaining to Solid Waste Sites and Facilities, 6 CCR 1007-2 (the "Regulations"). The Division hereby conditionally approves All Pro Septic's Insurance Policy No. 104632-74280501-13 for use as Financial Assurance for Waste Grease Transporting. The Division requests that a Certificate of Insurance or an ACORD form be sent to the Division indicating the Policy Number and the Division's cancellation provisions of a 60 (sixty) day notice. The Division requests this information to be received within 30 days after receipt of this letter. This correspondence will serve as the No Further Action letter required by Section 1.9.2 of the Regulations. This No Further Action letter shall not preclude the Division from issuing an Administrative Enforcement Action, bringing a civil action or seeking a civil penalty pursuant to 30-20-113, C.R.S. for violations cited in the Compliance Advisory. If the violations cited in the Compliance Advisory occur in the future, the Department may issue a subsequent Compliance Advisory and/or Compliance Order. The Division is authorized to bill for the financial assurance review pursuant to Section 1.7 of the Regulations and an invoice will be transmitted under separate cover once review of Financial Assurance compliance is completed.
